99-23069 RESO RESOLUTION NO. 99-23069 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO SUBMIT AN APPLICATION TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS (DCA) FOR A TECHNICAL ASSISTANCE GRANT FROM THE LOCAL GOVERNMENT TECHNICAL ASSISTANCE PROGRAM TO DEFRAY THE COSTS ASSOCIATED WITH COMPLETING THE EVALUATION AND APPRAISAL REPORT (EAR) PROCESS; AND AUTHORIZING THE ACCEPTANCE OF THE GRANT, IF AWARDED. WHEREAS, the City of Miami Beach Planning Department is currently in the process of completing the Evaluation and Appraisal Report (EAR) process; and WHEREAS, the Florida Department of Community Affairs (DCA) has funds available to assist local governments in completing the Evaluation and Appraisal Report (EAR) process through the Local Government Technical Assistance Program; and WHEREAS, the City was informed by the DCA that said funds were available and encouraged by the DCA to apply for said funds, as the City qualified for said funds as a local government in the process of completing the EAR process; and WHEREAS, the City proceeded to prepare an application to meet the February 15, 1999 deadline for submission and future consideration, and submitted an application to the Florida Department of Community Affairs for said funds to defray costs associated with completing the Evaluation and Appraisal Report (EAR) process. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida, retroactively authorize the City Manager, or his designee, to submit an application to the Florida Department of Community Affairs for a grant from the Local Government Technical Assistance Program to defray the costs associated with completing the Evaluation and Appraisal Report (EAR) process; and authorizing the acceptance of the grant, if awarded. Forthman, Director, dated January 14, 1999, indicating that the Department of Community Affairs was in the process of making EAR technical assistance funds available to local governments. As the City's EAR was found to be insufficient by DCA, we understand that the City is being offered the funds to assist in completing the EAR process. To that end, Planning Department staff has prepared a Scope of Work which addresses the items in our EAR which were found to be insufficient. Additionally, staff has prepared a list of deliverables and a deliverable timetable for this Scope of Work. The Scope of Work and the list of deliverables . and timetable are attached. The delivery date for the referenced work products shall be no later than November 1, 1999. At this time the City is requesting financial assistance from the Department in the amount of $9,990.00, which should allow us to prepare the work products as detailed in the referenced attachments. We look forward to proceeding with the EAR process, and to the DCA's continued support and assistance. DJG/RGL/rgl EXHIBIT 1 Scope of Work/or DCA Assistance Contract 1. Conduct field work, evaluate aerial photography, review property records and/or conduct such other research as may be useful to prepare a new existing land use map. 2. Prepare preliminary existing land use map. 3. Prepare tabulation of existing land uses and appropriate bar graph or similar depiction of existing land uses. 4. Collect and evaluate available data relevant to the analysis of the following: Future Land Use Objectives 1,3,4 and 5; Traffic Circulation Objectives 1,2,3 and 4; Mass Transit Objective 5; Infrastructure Objective 2; Recreation and Open Space Objectives 1 and 4; and Conservatiory'Coastal Objectives 1, 6, 7, 10, 11, and 12. In collecting and evaluating such data, emphasis shall be placed on the data which meets the "best available" standard established by Rule 9J-5, F AC for comprehensive plans. Deliverables and Deliverables Timetable for DCA Assistance Contract 1. Preliminary existing land use map. 2. Preliminary tabulation of existing land uses. 3. Preliminary bar graph or similar depiction of existing land uses. 4. Text and/or tabular analysis based on best available data of Future Land Use Objectives I, 2, 4 and 5. 5. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND: The City of Miami Beach Planning Department is currently in the process of completing the Evaluation and Appraisal Report (EAR) process. The EAR is a statutory requirement of the State Growth Management Act; each local government must periodically prepare an EAR for submittal to the Florida Department of Community Affairs (DCA). The City's adopted EAR received a fmding of insufficiency from the DCA on September 15, 1998. The Planning Department has undertaken to work with the City's Comprehensive Planning Consultant, Robert Swarthout and Associates, to address the DCA's concerns and prepare the appropriate data and analysis necessary to insure a finding of sufficiency from the DCA. ANALYSIS The Planning Department recently received correspondence from the DCA dated January 14, 1999, indicating that DCA has funds available to assist local governments in completing the Evaluation AGENDA ITEM e--,F 2- - ll-Cf1 DATE and Appraisal Report (EAR) process and encouraging the City to apply for said funds. The City qualifies for said funds as a local government in the process of completing the EAR process. The correspondence from DCA indicated that the deadline for application for the subject technical assistance funds was February 15, 1999. To meet this deadline, the City proceeded to prepare and submit an application to DCA for consideration. There was insufficient time to prepare a resolution beforehand to request City Commission approval prior to the submittal of the application. A copy of the application letter to DCA is attached. See Exhibit 1. With the adoption of this resolution, the City Commission and Mayor are retroactively authorizing the City Manager, or his designee, to submit an application; prepare and submit any back-up or supporting documents, as may be needed, and receive the referenced technical assistance funds as granted for the completion of the EAR process. CONCLUSION: The Administration recommends approval of the attached Resolution of the Mayor and City Commission of the City of Miami Beach, Florida, retroactively authorizing the City Manager, or his designee, to submit an application to the Florida Department of Community Affairs for a grant from the Local Government Technical Assistance Program to defray the costs associated with completing the Evaluation and Appraisal Report (EAR) process; and authorizing the acceptance of the grant, if awarded.
