RESOLUTION NO. 2001-24645
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING A WAIVER OF
DEVELOPMENT REGULATIONS UNDER SECTION 142-425(d) OF THE
CITY CODE, APPLICABLE TO THE 17TH STREET GARAGE, TO PERMIT
AN INFORMATIONAL SIGN ON THE GARAGE IDENTIFYING ITS
PROXIMITY TO LINCOLN ROAD, WHICH SIGN WOULD EXCEED THE
APPLICABLE SIZE REGULATIONS, AND WOULD BE SUBJECT TO
DESIGN REVIEW APPROVAL.
WHEREAS, Lincoln Road is one of the most significant commercial centers in the City of
Miami Beach; and
WHEREAS, Lincoln Road's location and accessibility are not readily apparent to visitors
approaching from the north on 17th Street, or from the Convention Center complex; and
WHEREAS, in order to improve the awareness to visitors of the location and accessibility
to Lincoln Road, and the availability of parking to access Lincoln Road in the 17th Street Garage, the
Lincoln Road Marketing Association has proposed placing an informational sign on the facade of
the 17th Street Garage, to inform visitors of the proximity of the garage to Lincoln Road; and
WHEREAS, such proposed sign would exceed the applicable size limitations under the Land
Development Regulations, however, the sign would be subject to design review approval; and
WHEREAS, plans were presented to the Commission depicting the proposed design and
dimensions of the sign, which thereafter will be subject to design review approval procedures; and
WHEREAS, a waiver of development regulations under section l42-425(d) of the Land
Development Regulations for the 17th Street Garage is requested to permit the proposed sign and
allow it to exceed the applicable size limitations.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the above request for
waiver of development regulations is hereby approved, permitting the placement of an informational
sign on the facade of the 17th Street Garage, to inform visitors of the proximity of the garage to

Adopt the Resolution
ANALYSIS
Lincoln Road is one of the most significant commercial centers in the City of Miami Beach,
however, its location and accessibility are not readily apparent to visitors approaching from the
north on l7'h Street, or from the Convention Center complex. In order to improve the awareness
to visitors of the location and accessibility to Lincoln Road, and the availability of parking in the
17th Street Garage, the Lincoln Road Marketing Association has proposed placing an informational
sign on the facade of the 17th Street Garage. The desigu and size of the sigu shall be determined
by the design review process.
Because the proposed sign would exceed the applicable size limitations under the Land
Development Regulations, pursuant to Section 142-425(d), the Mayor and City Commission may
waive development regulations following a noticed public hearing advertised in a newspaper and
also a mailed notice to owners ofland lying within 375 feet of the property, at least fifteen (15)
days prior to the public hearing. On September 20, 2001, the Mayor and City Commission adopted
a Resolution setting the public hearing to consider the development regulation waiver on today's
date.

Conclusion
The Mayor and City Cormnission should adopt the resolution waiving the development regulations
pursuant to Section 142-425(d) of the city code for the sign proposed by the Lincoln Road
Marketing Association. The waiver that is being requested is for the size of the sign, and a five-
sevenths vote of the City Commission is required for approval.
