2001-24660 RESO RESOLUTION NO. 2001-24660 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER AND DESIGNEES TO TAKE ALL NECESSARY ACTION, INCLUDING FUNDING FROM FY 2002 RESORT TAXES TO PAY FOR ALL NECESSARY EXPENDITURES, TO SUPPORT THE *NSYNC FREE BENEFIT CONCERT AND ALL RELATED CITY PRODUCED SPECIAL EVENTS PLANNED FOR VETERAN'S DAY WEEKEND 2001; DECLARING A PUBLIC EMERGENCY EXISTS THAT NEGATIVELY AFFECTS PROPERTY OF THE TOURISM INDUSTRY IN THE CITY AND CITIZENS OF MIAMI BEACH AS A WHOLE. WHEREAS, as a result of the devastating events of September 11, 2001 resulting in a public emergency that has negatively affected property of the tourism industry in the City and citizens of Miami Beach as a whole, the City of Miami Beach and its tourist-related industries and resident businesses have been adversely impacted and to this end, various regional efforts are being implemented such as the Greater Miami Chamber of Commerce's (GMCC) Economic Generation and Recovery Task Force and a tourism marketing campaign initiated by the Greater Miami Convention and Visitors Bureau (GMCVB); and WHEREAS, in an effort to be responsive and supportive of our local commercial businesses. the City has evaluated a variety of additional measures that will provide temporary relief while confidence is restored in the economy and the tourism industry; and WHEREAS, these initiatives include a deferral of business related fees, reduced parking and transportation costs, a contribution to the GMCVB ''What Makes You Happy" marketing campaign (geared to reactivate tourism in the City) and financial and logistical support for a City-produced, in conjunction with Ocean Drive Association, special event; and WHEREAS, the aforementioned initiatives and proposed policy recommendations, assisting in part the local business sector and visitors to our community, are authorized as emergency economic revitalization relief pursuant to Section 2.05 of the City Charter, which section requires that a declaration of public emergency exists negatively affecting property; and WHEREAS, as part of the City's further efforts to assist the victims of the September 11, 2001 terrorist attacks and assist the local hospitality industry and displaced workers, the City of Miami Beach and Ocean Drive Association will produce and sponsor a free Veteran's Day benefit concert featuring *NSYNC and other artists at Lummus Park on Sunday November 11, 2001; and WHEREAS, it is estimated that the concert production and event coordination costs will approximate $250,000 - $300,000 and it is the City and Ocean Drive Association's intent to raise corporate donations to underwrite the full cost of production; and WHEREAS, the concert production will be coordinated by Fantasma Productions, and corporate sponsorships will be coordinated by the Ocean Drive Association through Ocean Drive Magazine, which will publish a commemorative program, and has committed $150,000 towards the production costs of the concert event; and WHEREAS, the City will implement its Major Events Plan to assure that planning and resources are appropriately allocated during the Veteran's Day weekend, beginning Friday, November 9th through Monday, November 12th. It will be necessary for the City to incur costs associated with the procurement of City services, such as increased staffing and overtime. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that that the Mayor and City Commission declare a public emergency exists that negatively affects property of the tourism industry in the City and citizens of Miami Beach as a whole, and accordingly authorize the City Manager and designees, to take all necessary action, including funding all necessary expenditures, to support the *NSYNC free benefit concert and all related City produced special events planned for Veteran's Day weekend 2001, beginning Friday November 9th through Monday, November 12th, 2001. ANALYSIS As a result of the devastating events of September 11, 2001, the City of Miami Beach and its tourist-related industries and resident businesses have been adversely impacted. To this end, various regional efforts are being implemented such as the Greater Miami Chamber of Commerce's (GMCC) Economic Generation and Recovery Task Force (see Exhibit A) and a tourism marketing campaign initiated by the Greater Miami Convention and Visitors Bureau (GMCVB). In an effort to be responsive and supportive of our local commercial businesses, the City has evaluated a variety of additional measures that will provide temporary relief while confidence is restored in the economy and the tourism industry. These initiatives include a deferral of business related fees, reduced parking and transportation costs, a contribution to the GMCVB "What Makes You Happy" marketing campaign and financial and logistical support for a City produced, in conjunction with Ocean Drive Association, special event. In order to implement these initiatives, it is necessary to adopt the proposed legislation. In accordance with Section 2.05 of the City Charter, it is necessary to declare that a public emergency exists that negatively affects the property of the tourism industry in the City and the citizens of Miami Beach as a whole. It is recommended that the Mayor and City Commission amend the referenced City Code provision to authorize a temporary (60 day) deferral of payment for unpaid FY 2002 occupational license fees and FY 2002 unpaid sidewalk cafe fees for a period of 60 days from October 1, 2001 to December 1, 2001, abating any late payment fees and delinquency penalties in connection therewith. It is projected that FY 2002 Occupational Licenses will generate $3,000,000 of which $1,577,000 had been collected as of September 30, 2001. Likewise, FY 2002 Sidewalk Cafe fees are projected to generate $494,000, of which $139,000 had been collected as of September 30, 2001. The proposed amendment will defer any unpaid fees not yet collected and abate any late or delinquency fees in connection therewith. It is further recommended that the Mayor and City Commission amend City Code Chapter 106-55 authorizing parking at no cost for the first hour at the City's 7th Street, 17th Street, and 42nd Street garages and authorizing a $1.00 reduction off the flat parking rate at the 12th Street and 13th Street garages for a period of 44 days from October 18, 2001 to December 1, 2001. A separate item is being presented on the Redevelopment Agency Board Agenda authorizing parking at no cost for the first hour at the 16th Street Garage for the same time period. The City has consistently emphasized the need to change the behavioral pattem of the October 17,2001 Commission Memorandum Page 3 of 5 City's residents and visitors to focus on increased off-street parking vs. on-street parking, that should service short-term transient cars. The proposed initiative is consistent with these proposed behavioral modifications the City is desirous of achieving. On October 1, 2001, the Transportation and Parking Committee (T & P) unanimously recommended in favor of implementing the first hour at no cost andlor a reduction of $1.00/hour off the flat rate at City's garages. The T & P Committee discussed the reduction of meter hours and rates and opted for a reduction in garage parking rates for the first hour vs. any reduction in meter rates. As a result of the need to change behavioral patterns. The parking system revenues are pledged to service the outstanding debt and the bond Covenants, Section 710, which provides for "No Free Parking" within the parking system. To assure the City is in compliance with its Bond Covenants, the City will pay to the Parking Enterprise Fund the revenues which otherwise would have been collected from users of the garages. Thus, this temporary measure will have no financial impact on the Parking Enterprise Fund. In line with the efforts to reduce parking costs to help sustain local businesses, it is also proposed that the Electrowave transportation service be provided at no charge after 9:00 p.m. during the 44 day period from October 18, 2001 to December 1, 2001. Therefore, it is necessary to amend Resolution No. 99-23129, authorizing no charge for electrowave patrons after 9 p.m. for a period of 44 days from October 18, 2001 to December 1,2001. On September 20, 2001, the president of the GMCVB, Bill Talbert, addressed the City Commission and requested $250,000 to support the GMCVB's marketing initiative being developed. The GMCVB marketing campaign, "What Makes You Happy", consists of a $2.3 million campaign receiving funding assistance from Miami-Dade County, the Beacon Council and the Miami Beach Visitors and Convention Authority (VCA). On October 3, 2001, the VCA voted to contribute $150,000 towards the GMCVB marketing campaign. As such, it is recommended that the City Miami Beach appropriate and contribute $100,000 from FY 2002 resort taxes towards the GMCVB marketing campaign, for a combined allocation of $250,000 in support of the GMCVB's efforts. Lastly, as part of the City's efforts to assist the victims of the September 11, 2001 terrorist attacks and assist the local hospitality industry and displaced workers, the City of Miami Beach and Ocean Drive Association will produce and sponsor a free Veteran's Day benefit concert featuring *NSYNC and other artists at Lummus Park on Sunday November 11, 2001. Additional initiatives the City is involved in to assist local businesses and displaced workers include the following: . City staff is working with the Beacon Council and the GMCVB, to discuss implementation of a tracking system for un-employment/employment in all industry sectors similar to hotel occupancy tracking. This information will allow the City to target federal and state funding incentives that are available to distressed businesses and displaced workers. · The Department of Code Compliance is deferring action or granting extensions of time on compliance for non-life safety or non-quality of life violations, when feasible. . The BuildinglFire Departments are enhancing services provided for plans review and inspection services on non-work hours. Effectively, we are increasing hours and increasing efficiency to assist current projects. . Th City is working with the Hispanic Community Center's (Unidad) Workforce Miami Beach One-Stop Career Center, located at the 6th Street Community Center, to assist displaced workers. . The City is updating its tourism link on the City website with special hospitality promotions throughout the City and initiating a "Why I want to vacation on Miami Beach" contest, with special prizes from local hotels and restaurants. . The City of Miami Beach Hotline remains functional 24/7 - (305) 673-7400. . In today's City Commission agenda package, there is a separate item listing the City of Miami Beach State legislative priorities and the City is aggressively working with our lobbyists to review State mandated fees and timelines to compile a recommendation of relief efforts that may be implemented in this year's legislative special session. The City of Miami Beach is positively impacting the local economy with over $400 million of planned capital projects over the next five (5) years. In aggregate, the aforementioned initiatives and proposed policy recommendations will, in part, assist the local business sector and visitors to our community, Section 2.05 of the City Charter requires that a declaration of public emergency exists negatively affects the property of the tourism industry in the City and citizens of Miami Beach as a whole when adopting an emergency Ordinance. As a result of the September 11, 2001 terrorist attacks and its devastating effects nationwide, and particularly, on the local tourism market, it is recommended that the Mayor and City Commission adopt the proposed resolutions. The accompanying proposed ordinance and resolutions will defer business related fees and reduce parking and transportation costs, for a time certain, authorizes an appropriation of $100,000 towards the GMCVB marketing campaign and authorizes the City Manager to fund all necessary expenditures in connection with the free *NSYNC Benefit Concert and all related events on Veteran's Day weekend. Furthermore, the proposed emergency Ordinance, authorizes the City Manager to extend the business permit fee and reduced parking and transportation costs by a period not to exceed an additional 90 days beyond December 1, 2001, without further approval by the Mayor and City Commission.
