TO THE PROFESSIONAL ARCHITECTURAL
AND ENGINEERING (A/E) SERVICES AGREEMENT
BETWEEN
THE CITY OF MIAMI BEACH, FLORIDA
AND
EAC CONSULTING, INC.
DATED JULY 27, 2005
FOR THE PROVISION OF
PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES FOR THE BISCAYNE
POINT RIGHT -OF -WAY INFRASTRUCTURE IMPROVEMENT PROJECT.
T is Amendment No. 10 to the above referenced Agreement is made and entered this Z2 - day of
to a4 , 2011, by and between the CITY OF MIAMI BEACH, a municipal corporation existing
under the laws of the State of Florida, having its principal offices at 1700 Convention Center Drive,
Miami Beach, Florida 33139 (hereinafter referred to as the City), and EAC Consulting, Inc. a Florida
Corporation, having its principal office at 815 NW 57 Avenue, Suite 402, Miami, Florida, 33126
(hereinafter referred to as the Consultant).
RECITALS:
WHEREAS, on July 27, 2005, the Mayor and City Commission adopted Resolution No. 2005-
25973, approving and authorizing the Mayor and City Clerk to execute an Agreement with the
Consultant, for Professional Architectural and Engineering Services for the Biscayne Point
Neighborhood Right -of -Way (ROW) Improvement Project (the Project); and
WHEREAS, the Agreement provides for the planning, design, bidding and award,
construction administration, and reimbursables for the Project; and
WHEREAS, the Agreement was executed in the amount of $1,186,807; and
WHEREAS, on March 6, 2006, the Mayor and City Commission approved Resolution No.
2006 - 26133, approving Amendment No. 1 to the Agreement, in the amount of $129,325, for
professional services for the design, permitting and construction of an additional 11,000 linear feet
of water main infrastructure required by the City's Public Works Department; and
WHEREAS, on January 6, 2009, Amendment No. 2 to the Agreement was approved, in the
amount of $24,924, for additional storm water system modeling services; and
WHEREAS, on January 28, 2009, the Mayor and City Commission approved Resolution No.
2009 - 26979, approving Amendment No. 3 to the Agreement, in the amount of $27,000, for additional
professional services for the inclusion of Pavement Markings and Signage drawings which were not
included in the original design; and
WHEREAS, on September 9, 2009, the Mayor and City Commission adopted Resolution No.
2009 - 27191, modifying the approved Basis of Design Report (BODR) to change the design of
Stillwater Drive, the 77 Street entryway, provide improvements to the Tatum Waterway Bridge, and
provide additional neighborhood signage; and

Dear Ms. Arencibia:
Pursuant to discussions with our staff relating to obtaining jurisdictional Miami Dade DERM Tree
Removal /Disposition Approval Permit as required to supplement the construction contract package, please find
as follows anticipated tasks and corresponding fee proposal(s) required to perform the requisite work. Please
note that this tasks and services are not included in our current original scope of services /contract with the City
of Miami Beach.
Our services on this supplemental scope of services will require the following:
• Task 1 — Tree Surveying Services : This service includes all the topography surveying services needed to
provide tree surveying services in accordance with Miami Dade DERM's Tree Survey Guidelines. The
survey will be provided as a "trees only" update to the existing topography survey prepared in 2005.
Please find enclosed a fee proposal and scope definition statement to undertake this services as submitted
by our sub consultant — FR Aleman and Associates, inc.
• Task 2 — DERM Tree Removal Permit Package and Approval: This includes landscape architecture
services for field verification of all existing trees, provision of scientific names for all trees as required by
Miami Dade DERM, Preparation of Tree Management Plans Package for DERM Tree removal Permit
Application and attendance at one permit coordination meeting with Miami Dade DERM staff. Please find
enclosed a fee proposal and scope definition statement to undertake this services as submitted by our sub
consultant — Savino Miller Design Studios, inc.
As noted previously, these tasks detailed above constitute a variance from the established Basis of Design (i.e.
BODR) / contractual obligations of EAC Consulting, Inc and as such, our proposal to undertake the requisite
work is consistent with the City's policies to compensate for work done or to be performed in addition to the
established Basic Scope of Services. Please find attached our fee proposal tabulation consistent with the scope
of work itemized above.
Please forward to us amendment to our current contract and Notice -to- Proceed (NTP) as we will require these
docum- ::t or to commencing and finalizing this scope of services.

RE: TREE SURVEY FOR BISCAYNE POINT (Revised)
Dear Mr. Adeife:
This is our estimate for updating the Tree Survey at Biscayne Point Site in City of Miami Beach, Florida.
The following is the proposed scope of work.
Scope of Works:
Updating the Specific Purpose Survey prepared by FRA on the Biscayne Point Neighborhood, to show all
existing tree within the Right of Way. Survey will also show the following information as per "TREE
SURVEY GUIDELINES AND SPECIFICATIONS ", by DERM.
(a) Identification number of each tree.
(b) Scientific and/or common name of each tree.
(c) Diameter at breast height of each tree.
(d) Canopy diameter or square footage.
(e) Prepare the tree information on an electronic spread sheet (Excel).
Scientific Name will be provided by a certified Arborist or Landscape Architect.
Specific Purpose Survey according to Minimum Technical Standards, Chapter 5J17 -6, Florida Administrative
Code.
Specific Purpose will be revised to include the new tree information. No other information of the Specific
Purpose Survey will be updated since is not part of this scope.
Survey Fees:
Field Crew 3 men /DAY 64 HOURS $148.21 $9,485.44
Survey Tecnician 7 HOURS $60.00 $420.00
Surveyor and Mapper 6 HOURS $120.00 $720.00
CADD Tech /HOUR 18 HOURS n $55.00 $990.00
TOTAL SURVEY FEES $11,615.44
Miami - Orlando - Tampa - Jacksonville - Tallahassee
These fees do not include Miami Dade ade DERM package for Tree relocation, removal and mitigation.
FRA will not be involved in any Tree relocation, removal and mitigation.
FRA will not label any tree as to remain, to be relocated, or to be removed.
EAC Consulting, Inc. will be responsible of the printing of eight (8) sets of 24X36 Surveys.
FRA will then sign and seal the eight printed sets.
Deliver:
FRA will deliver all drawings in CD, in AutoCAD release 2007.
FRA will deliver three (8) signed and sealed sets of the Specific Purpose Survey.

Dear Mike:
As per your request, we are requesting additional services to prepare the necessary documents for a DERM
application. Services would not commence until a certified tree survey locating all trees and palms with trunk
sizes equal to or greater than four inches caliper and labeling in an Excel spreadsheet the tree /palm, trunk
DBH, overall height and canopy spread is received.
Savino Miller Design Studio services would include:
1. Field verification of existing trees /palms to include providing scientific names;
2. Revisions to Tree Survey Excel file provided by prime consultant to include verified information;
3. Preparation of tree management plan; and
4. One on -site DERM meeting.
The total hours and fee needed for these services is described in the attached spreadsheet.
*Fee does not include: certified survey, arborist/horticulturist fees, tree replacement value, DERM permit fees
or DERM permit acquisition.*
Please indicate your approval by signing and returning a copy of this request to our office, and let us know

SUBJECT: Biscayne Point Neighborhood Improvements
Architectural /Engineering (A/E) Amendment No. 10
Attached please find the aforementioned amendment between the City of Miami Beach and EAC
Consulting, Inc. (the A/E Consultant). The scope of work of this agreement consists of an update
to the Encroachment Tabulation produced at the commencement of the design phase of the
project; the production of a tree survey; the development of a Miami -Dade Department of
Environmental Resources Management (DERM) Tree Removal Permit Package; and the
procurement of said permit by the A/E Consultant.
At the beginning of the design phase of the Biscayne Point Right -of -Way Improvements project,
the NE Consultant was required to provide an Encroachment Tabulation that delineated
elements located within the project right -of -ways that may or may not require removal during the
construction of the proposed improvements. With time the listed encroachments have changed
throughout the neighborhoods; additional trees have been planted or removed; new driveways
have been constructed; and other encroachments have been installed within the right -of -way
which may require removal for the implementation of the project design that are not identified in
the original survey. In addition, the original scope of services of the A/E Agreement did not
require the consultant to produce the documentation required to submit and procure the DERM
Tree Removal Permit. The required documentation includes the preparation of a tree survey, the
development of a Tree Removal and Disposition Plan, and the development of a Tree Mitigation
Plan; all of which are required to be signed and sealed by a Registered Landscape Architect.
This permit package is required for the removal of any tree designated as an encroachment to
be removed as part of the project. This amendment approves these additional services to the
NE Consultant's Agreement.
Please review Amendment No. 10 and the additional services request attached. If acceptable,
please sign the tabbed pages and forward to the City Clerk's Office for final execution or contact
Janette Fernandez Arencibia, P.E., CIP Capital Projects Coordinator, at the CIP Office for pick-
