Quarterly Report Q2 — 2011 (April 2011 through June 2011) This Letter to Commission (LTC) provides a combined report and data analysis on the enforcement and compliance efforts of the Building Department's Code Compliance Division (Code) regarding the City's Noise Ordinance. This report encompasses both the Annual Noise Report, which reflects data from July 1, 2010 through June 30, 2011; and the Second Quarterly Report for 2011, which reflects data from April 1, 2011 through June 30, 2011. The metrics and analysis reflected in both noise reports is aggregated by calendar year quarters, and reflects all of the information required by the Administrative Guidelines approved in October 2008. As in previous annual reports, the analysis of commercial related noise cases is explored and evaluated in greater depth than that of residential noise cases. It is also noteworthy to enumerate several procedural changes initiated by Code earlier this year including: • The training of new Code Compliance Officers (CCOs) and re- training of current staff; • The reconfiguration and re- deployment of CCO grids and geographic zones (officer assignments) • The addition of new case status classifications and case resolutions to the Permits Plus database; and lastly, and of key importance, • The development of a formal Noise Ordinance Standard Operating Procedure (SOP) As a direct result of these combined factors, the Code Compliance Division expects to continue to improve its overall performance, efficiency and service delivery. The report includes the following support documentation: • Attachment A — Annual Report for 2010 -2011, detailed information of all noise cases opened during the reporting period • Attachment B — Annual Report - an analysis for Commercial Noise Cases, for the reporting period • Attachment C — Annual Report - table depicting the reason commercial noise cases were deemed non - valid; and • Attachments D through G - data for the 2 Quarter, 2011 Letter to Commission Annual Noise Report (July 2010 – June 2011) & 2 Quarter 2011 Page 2of9 SUMMARY OF ANNUAL REPORT DATA As aforementioned, Attachment A to this report provides the overall annual data for Quarters 3 and 4 for Calendar Year 2010, and Quarters 1 and 2 of Calendar Year 2011, which collectively reflect the fifth year since the inception of the Noise Ordinance. During the reporting period of July 1, 2010 through June 30, 2011, a total of 4,664 noise cases were opened, which represents a 21.5% increase compared to last year (2009 -10: 3,836 cases). Of these cases: * 180 cases were cancelled by the complainant (e.g. complainant called back to cancel call) * Forty eight (48) were voided as a result of a clerical /staff error * Thirteen (13) were deemed a duplicate complaint * Eleven (11) cases were closed /not applicable to Code Therefore, 4 412 noise cases remained where the disposition was valid or non - valid. A historical analysis reflects that the number of noise - related cases continues to increase when compared to prior years. (See Chart #1 below). This phenomenon may be related to a number of factors, including increased awareness by the general public regarding the Noise Ordinance; the effective dissemination of information regarding City services through marketing and other efforts; and the general public's accessibility to reporting this issue. The chart reflects a higher number of cases in Quarter 1 (October through December), in line with an increased amount of Special Events, holiday - related festivities during the end of the year, as well as an increase in the number of visitors and tourists that come to the City for its weather and amenities. Inversely, there is a decrease in noise - related cases during the spring and summer months (Quarters 2 and 3), when the number of visitors subsides. As defined in previous reports, valid cases are those where noise is identified to be "excessive, unreasonable, unusual, and unnecessary' at the time of arrival by a Code Compliance Officer (CCO) or a Police Officer, and as reflected in Section 21 -28 of the Miami -Dade County Code, and Article IV, Section 46 -152 of the City of Miami Beach Code. Additionally, between the hours of 11:00 pm and 7:00 am, a noise violation is deemed valid if "plainly audible at 100 feet", as reflected in both sections of the county and city code referenced above. It is worth noting that as a result of a number of initiatives [including multiple staff training sessions to ensure consistent application of the Code, and removal of outliers (incidences outside the general trend)]; the noise validity rate increased a number of percentage points in the last quarter. OVERALL TRENDS A historical analysis since the inception of the Noise Reports (Chart #3 below) consistently indicates that the majority of noise - related cases take place within residentially zoned areas. Below is a historical analysis, by quarter, going back to the 4 Quarter of 2007, through the 2nd Quarter of 2011. O- C3 6 c c c O' o- O- ( .....*Residential # 6—Commercial # Chart #3 I ' Letter to Commission Annual Noise Report (July 2010 — June 2011) & 2nd Quarter 2011 Page 4 of 9 During the annual rating period, which measures data between July 2010 and June 2011, more than three (3) of every four (4) noise - related cases (75.8 %) were deemed to be residential in nature, as opposed to 16.2% for Commercial, and 8.0% for "Other." (See chart below). BREAKDOWN OF TOTAL CASES BY TYPE July 2010 — June 2011 RESIDENTIAL 3,345 75.80% COMMERCIAL 713 16.20% OTHER 354 8.00% TOTAL 4,412 100% Chart #4 Further analysis indicates that noise cases for apartments (2,069) represent nearly half (46.9 %) of all noise cases opened, followed by condominiums (764 — 17.3 %), and single family homes (512 — 11.6 %). By comparison, of the commercial noise cases, hotels reflected the highest incidence of commercial noise - related cases opened with a total of 232 or 5.3% of all noise cases opened (4,412). (See Attachment B). Consistent with previous reports, loud music continues to be the noise type that generates the most cases, representing 79.8% of all noise cases (3,519); followed by barking dogs (12.8% - 563 cases); and construction noise (7.0% - 311 cases). SUMMARY OF ANNUAL REPORT DATA — COMMERCIAL CASES In light of previous discussion, which centered on the impact of commercial noise cases, the following summary will focus on the results for the past year as it relates to noise cases opened for commercial establishments. Commercial cases, as identified in the report, includes cases opened for noise complaints in bars, clubs, hotels, condo /hotels, restaurants, retail and construction sites. Of the 4,412 noise cases with a disposition, 713 were deemed to be commercial in nature. An analysis of the 713 commercial cases with a valid /non -valid disposition for the period running from July 2010 through June 2011, indicates that: ✓ 31.4% of all cases for retail were closed as valid ✓ 21.5% of all cases for restaurants were closed as valid ✓ 20.0% of all cases for condo -hotel establishments were closed as valid ✓ 19.5% of all cases for bars were closed as valid ✓ 18.5% of all cases for hotel were closed as valid ✓ 10.6% of all cases for clubs were closed as valid As noted, the valid closure rate for commercial cases ranged from a high of 31.4% to 10.6 %. As a result, in the aggregate, the average valid closure rate for commercial cases is 19.2% Letter to Commission Annual Noise Report (July 2010 — June 2011) & 2nd Quarter 2011 Page 5 of 9 The chart below reflects the breakdown by type of commercial establishment of all of the 713 Commercial Cases for the period of July 2010 through June 2011 (See Attachment B). Type of Noise - Commercial Cases As reflected in previous historical analyses, loud music was the most common type of noise reported for all commercial noise cases opened. For commercial violations, this type of noise accounted for 93.1% of all cases opened in the measured year, with 5.8% (41 cases) identified as construction noise. The remaining eight (8) cases were for barking dog (5); crowd noise (1); live entertainment (1); and honking cars /alarms (1). As it relates to the reasons why commercial noise cases were identified as non - valid, the vast majority of the cases (257 - 45 %) were closed as non -valid because at the time of arrival, the noise or music did not meet the noise ordinance criteria for a valid complaint, or it was deemed to be not excessive. Other reasons for deeming the complaint not valid include there being "no noise at the time of the CCOs /PDs arrival" (121 - 21%); and that, in addition to the noise cr the noise was not audible at 100 feet (after 11:00 PM) (121 cases - 21%) (See Attachment C). B. Time/Day of Week of Commercial Noise occurring Following the same pattern as in previous reports, it is interesting to note that an analysis of the time the violation was reported reflects a relatively even balance — including for commercial cases - between noise cases opened /reported for noise occurring between the hours of 11:00 PM and 7:00 AM (53.2 %), and those between 7:00 AM and 11:00 PM (46.8%). The expectation of a higher incidence after 11:00 pm appears not to be supported by the evidence. For commercial cases closed as valid, the rate expectedly flips (higher commercial activity during the day) to 59.1% of the noise cases valid between 7 AM to 11 PM, as opposed to 40.9% valid between 11 PM and 7 AM. Letter to Commission Annual Noise Report (July 2010 — June 2011) & 2nd Quarter 2011 Page 6 of 9 As it relates to days of the week, it is not surprising to reflect that the overwhelming majority of commercial noise cases are opened / received on weekends. The three -day period of Friday through Sunday accounts for nearly 2/3 of these cases (59.5%), with the remaining 40.5% taking Y Y ( )� 9 9 place Monday through Thursday, in an increasing fashion. As expected, the busiest day of the week (in regard to noise - related cases) is Saturday, accounting for 23.4% of commercial cases, followed by Friday (18.4 %) and then Sunday (17.7 %). C. Arrival Time During the rating period, data analysis on "arrival time" obtained from the Computer Aided Dispatching (CAD) System at the Parking Department, reflects a visible difference between valid and non -valid commercial cases, with an arrival time difference of about 5% minutes. On average, the valid commercial violations took 19 minutes, 36 seconds; while the non -valid cases took 25 minutes and 7 seconds. This may indicate some correlation between the response times impacting the noise enforcement outcomes for commercial cases. Notwithstanding, Code has targeted reducing the response time as one of its key goals within the current fiscal year. The reduction in the response time has become evident with the addition of new part -time CCOs, which are making an impact in the comprehensive service delivery. The average time for CCO arrival is provided below. These events included Memorial /Urban Beach Weekend, Spring Break, and Ultra Music Festival, where the incidence of noise - complaints escalated when compared to instances where there were no special events. Inversely, not all special events impacted noise - related cases. There were other events throughout the City where the data reflects that there was either a marginal effect or not a significant effect on noise complaints. These other events include the SoBe Wine and Food Festival, the Miami Beach International Boat Show, the Festival of the Arts, Art -Deco Weekend and, perhaps surprisingly, Winter Music Conference (WMC). Letter to Commission Annual Noise Report (July 2010 — June 2011) & 2 " Quarter 2011 Page 7 of 9 CASES REFERRED TO POLICE DEPARTMENT In the last LTC and quarterly report (Quarter 1 — 2011), training sessions, both internal and external were outlined. During the last quarter, there were additional training sessions with both the Police Department (PD) and the Parking Department (which handles dispatching responsibilities for Code and all calls made to (305) 604- CITY(2489) related to the Noise Ordinance). One of the key topics discussed was noise - related cases and the conditions when Dispatch would refer a noise complaint directly to PD. As previously noted, when a call is received regarding vehicular noise, or unruly behavior (disturbance of the peace) the call is reassigned to PD. Code continues and has never ceased to address complaints regarding crowd noise, except when they are related to potential criminal behavior. Data research reflects that between July 2010 and June 2011, there were a total of 271 cases routed to PD as Code staff was unavailable (Monday through Wednesday, 1:00 AM through 6:00 AM). In addition, there were an additional 46 cases that were associated with disturbance of the peace, vehicular noise, etc. These were referred to PD for their review and appropriate action. The validity rate for noise complaints addressed by the Police Department is significantly lower than those noise complaints addressed by Code. In an effort to bridge this gap, Code will expand and enhance training sessions for the Police Department. COMPARISON TO PREVIOUS ANNUAL NOISE REPORTS This report marks the third full year of coverage and evaluation since the final amendment to the Noise Ordinance in July 2008. As previously noted, a comparative analysis indicates that there is an increasing trend of noise cases opened, with a 21.5% increase relative to last year, and a substantive 73.06% increase relative to 2006 -07. Other issues include the following: ➢ The total number of valid cases (for all types) increased by 29.7% when compared to last year ➢ The overall validity rate also increased, from 15.1% in 2009 -10, to 16.2% in 2010 -11 ➢ The validity rate for Commercial Noise Cases has remained about the same, increasing by less than 1 percentage point (0.7 %) vis -a -vis last year > The validity rate for residential noise violations increased by 1.2% relative to last year o 15.5% in 2010 -2011 o 14.3% in 2009 -2010 > Loud music continues to be the predominant type of noise complaint, comprising the majority of all, as well as commercial cases o 79.8% of all noise cases in 2010 -11 were deemed to be loud music o 84.9% of all noise cases in 2009 -10 were deemed to be loud music • Letter to Commission Annual Noise Report (July 2010 — June 2011) & 2 Quarter 2011 Page 8 of 9 SUMMARY OF 2 QUARTER 2011 DATA In an attempt to avoid being repetitive, the analysis for the 2 quarter will focus on salient issues. For the period encompassing April 1, 2011, through June 30, 2011, Code opened 940 cases. Of these: • Sixty -four (64) were canceled by the complainant • Seven (7) were voided • Four (4) were deemed to be duplicate complaints • Two (2) were closed as a result of the Special Master's ruling on preceding cases and • Five (5) were not applicable to Code. Thus, the total number of cases with a valid or non -valid disposition was 858 cases. Of these, 662 cases (77.2 %) were identified to have taken place at a residentially zoned location; 139 cases were deemed commercial (16.2 %); and 57 (6.6 %) of identified as "other ". There is a consistent and specific pattern of cases opened, whereby the incidence of cases opened in the second quarter is the second lowest number opened in the year. Q1 Q2 Q3 Q4 Chart #7 During the 2 Quarter of 2011, 182 of the 858 cases with a valid / non -valid disposition were deemed valid, with an overall validity rate of 21.2% Further analysis by establishment type indicates a higher than usual validity rate of 21.5% for Residential properties, 21.6% for Commercial properties, and 17.5% for "other ". This reflects an increase of 5% percentage points in the validity rate vis -a -vis the 1 Quarter of 2011, and a 7.4% increase versus Q2 of 2010. One of the many factors contributing towards the higher validity rate in residential properties can be identified to a number of illegally leased Short-Term Rental Properties that have been linked to events involving noise violations. Letter to Commission Annual Noise Report (July 2010 — June 2011) & 2 Quarter 2011 Page 9 of 9 Several other factors may explain the higher validity rate during the 2 Quarter of 2011; these include: ✓ Multiple Training Sessions, [three (3) separate sessions in calendar year 2011), for all staff to ensure consistent application of the Code] ✓ Ongoing review of data with supervisory staff to ensure consistent application of the Code ✓ Comprehensive review of process, to include input from the Office of the City Attorney ✓ Development and establishment of a formal Noise Ordinance Standard Operating Procedures (SOPs). Attachment D to this report provides the data for Quarter 2 of 2011. SPECIAL MASTERS APPEAL HEARINGS - During the reporting period encompassing April 1, 2011 through June 30, 2011,' there were a total of seven (7) appeals filed with the Special Master for noise - related cases. There were 20 cases actually heard by the Special Master, including three (3) of the cases appealed during the current quarter and 16 cases where appeals were filed prior to the current reporting quarter. During this quarter, fines for appeals upheld totaled $5,250. The respective status of the 24 cases is reflected in Attachment G. As reflected in the attachment, of the twenty (20) appealed cases heard during the current quarter, one (1) case was granted a continuance, seven (7) cases were heard and upheld (three with reductions), one (1) case was withdrawn (and paid by petitioner), and eleven (11) were dismissed by the Special Master. Further analysis reflects that a number of dismissals were due to the fact that the witnessing CCO was unavailable to attend the hearing due to sick and /or educational leave. CONCLUSION As you are aware, during the annual reporting period, we had a change in the Division Director and increased staffing (Part-Time Quality of Life). Much emphasis has been placed by Code, Division Director Robert Santos- Alborna in identifying areas for improvement and emphasizing our expectation for accountability. The Noise Report reflects the efforts implemented in the last ten (10) months to better formalize and standardize process, increase training, improve interdepartmental communication in response to complaints and enhance data collection.
