This Letter to Commission is to provide you the current status of the Pine Tree Drive and
La Gorce Drive safety improvement project. The project is scheduled to, start
construction during the week of November ,14 The project is funded by .the County;
however, the City has advanced construction funding in the amount of $353,506 in order
to start the- project as soon as possible. The project award and construction is- being
managed by the City.
As a final preparation to the start of the project, the City's and County's standard
procedure is to obtain signatures of approval from the adjacent property owners where.
the speed cushions are to be installed (Attachment A). In our experience, it is best to
obtain approval from the adjacent property owners prior to the installation of - the speed
cushions. It prevents a property owner from objecting to the installation .of the speed
cushions, :delaying the project, or worse, stopping the project all together.
The City has, advised the Home Owners Association (HOA) that obtaining signatures of
approval from all the adjacent property owners reduces risks to the project. However,
the HOA has concerns about the City or the HOA obtaining approval from all the
adjacent property owners. The City offered the HOA the. option of sending a letter to the
City where the HOA would assume total responsibility for resolving objections from any
of the adjacent property owners regarding the installation of the speed cushions in front
of their property once the project has started. The HOA has subsequently provided that
letter (Attachment B).

Pursuant to your request and in regard to the City /County
installation of "speed cushions" at the far end of each of the center
islands on 'La Gorce and Pinetree Drives from 52d St. to 61 St. please be
assured that not only is the neighborhood in overwhelming support of this
joint effort to address and hopefully cure the horrendous life safety
issue but in addition the Homeowners' Association stands ready, willing
and able to do whatever it takes to assist this effort, including, but not
limited to addressing whatever questions or situations may arise regarding
this installation now and in the future.
Be assured that you, the City and the County have our complete
assurance that we will not rest until our streets are once again safe and
pleasant for ourselves, our children, our neighbors and all the visitors
to our great City and our outstanding neighborhood.
We look forward to the immediate installation of the new cushions,
signs and markings. Should you have any further questions or concerns,

As a follow up to our conversation last night, please find attached the plan indicating location of proposed speed
cushions with the corresponding adjacent property addresses. We are requesting the HOA to assist the City in
obtaining written approval from the adjacent property owners. This is the City's standard procedure before the
installation of speed cushion proceeds, it prevents anyone from coming out while the installation is underway in front of
their property and stopping it, or worse yet, in stopping the project.
However, as discussed last night, the City would accept a letter from the HOA assuming total responsibility in resolving
objections from any of the affected property owners on speedcushion installation once the project has started. Please
be advised that if someone objects while the contractor is installing it, we'll have to move to the next speed cushion and
return to this location once the objection is resolved. Again, it is a lot less risky if the HOA obtains approval signatures
from all adjacent property owners prior November 14th.
Regarding the variable message board announcing the start of the project on November 7 ", the City did not place this
board. As I mentioned last night the project is not scheduled to start until the week of November 14 ". We'll continue to
try to find out who in the County installed the board and request they modify the date.
