2011-27803 Reso RESOLUTION NO. 2011-27803 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO ACCEPT EASEMENTS FROM HEAFEY/BENTLEY MANAGEMENT, LLC, LOCATED AT 101 SOUTH OCEAN DRIVE; SOUTH OF FIFTH CONDOMINIUM ASSOCIATION, LOCATED AT 121 SOUTH OCEAN DRIVE; AND KOMAR INVESTMENTS, INC., LOCATED AT 161 SOUTH OCEAN DRIVE; FOR THE CONSTRUCTION AND MAINTENANCE OF AN EXTENSION TO A PUBLIC ACCESS BICYCLE AND PEDESTRIAN PATH KNOWN AS THE BEACHWALK. WHEREAS, the City has an agreement with the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida to manage the state owned beaches east of the Erosion Control Line within City limits; and WHEREAS, the Beachwalk is one of the main trail systems of the Atlantic Greenway Network, which is a series of bicycle/pedestrian/greenway facilities; and WHEREAS, as part of the management, the City is developing an at-grade pathway known as the Beachwalk, which runs along the western edge of the dune system; and WHEREAS, portions of the hardpack area west of the Erosion Control Line and the dune system are privately owned; and WHEREAS, the City will need to obtain easements to construct the Beachwalk in these areas; and WHEREAS, staff has successfully negotiated easements with the three properties between 1st Street and Marjory Stoneman Douglas Park. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept easements from Heafey/Bentley Management, LLC, located at 101 South Ocean Drive; South Of Fifth Condominium Association, located at 121 South Ocean Drive; and Komar Investments, Inc., located at 161 South Ocean Drive; for the construction and maintenance of an extension to a public access bicycle and pedestrian path known as the Beachwalk. Individual projects are being constructed to create a continuous trail network providing better access for alternative transportation along the beach.To date,the City has completed the segments from Government Cut to South Pointe Drive and from Lummus Park to 23rd Street, has a boardwalk from 23rd Street to 47th Street, and has completed the segment from 64th Street to 79th Street where a connection is made to the North Shore Open Space Park that extends to 87th Street The City is also negotiating with a consultant to begin designing the segment from 47th Street to 64th Street. The portion of the Beachwalk between South Pointe Drive and Lummus Park is under design. Beachwalk II Easements December 14, 2011 Page 2 of 2 ANALYSIS At this time, staff has successfully negotiated easements with the three properties between 1St Street and Marjory Stoneman Douglas Park (Attachments C, D, and E).
