98-22920 RESO RESOLUTION NO. 98-22920 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN MIAMI-DADE COUNTY, CITY OF MIAMI BEACH, CITY OF MIAMI, VILLAGE OF BAL HARBOUR, AND THE GREATER MIAMI CONVENTION AND VISITORS BUREAU AND APPROVING THE EXTENSION OF THE NOTIFICATION PERIOD REQUIRED TO TERMINATE THE INTERLOCAL AGREEMENT TO OCTOBER 30, 1998. WHEREAS, the City of Miami Beach is currently one of the parties to an Interlocal Agreement ("Agreement"), dated September 30, 1993, with the Greater Miami Convention and Visitors Bureau (Bureau) which also includes Miami-Dade County, City of Miami, and Village of Bal Harbour; and WHEREAS, the Agreement stands to be automatically renewed at the end of each fiscal year (September 30, 1998), unless a participating public agency delivers written notice to terminate the Agreement to the Bureau ninety (90) days prior to the end of the current fiscal term; and WHEREAS, on June 17, 1998, the Mayor and City Commission approved a Letter Agreement between the City and the Bureau, waiving the ninety (90) day notice required to terminate the Interlocal Agreement, and giving the City of Miami Beach until September 29, 1998, to terminate same; and WHEREAS, the Administration has negotiated the attached Amendment to the Interlocal Agreement ("Amendment") and is recommending the following changes: 1. Extend the notification period to October 30, 1998. (See attachment 1.) 2. The term of the Agreement will be for five (5) years, with a ninety (90) day cancellation clause, with or without cause, prior to the end of each fiscal year during said term. 3. Commencing on October 1, 2003, the County will assume the functions of Beach Patrol and Beach Maintenance up to the boardwalk (or the dune--where a boardwalk does not exist), the County will continue to provide the equivalent level of service provided by the City, or better; and WHEREAS, Miami Dade County will be submitting the proposed Amendment for approval to the County Commission in October 1998; and WHEREAS, the Administration recommends that the Mayor and City Commission approve the attached Amendment to the Interlocal Agreement which includes, among other things, the extension ofthe notification period to terminate the Agreement to October 30, 1998. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute the attached Amendment to the Interlocal Agreement between Miami-Dade County, City of Miami Beach, City of Miami, Village of Bal Harbour, and the Greater Miami Convention and Visitors Bureau and approving the extension of the notification period required to terminate the Interlocal Agreement to October 30, 1998. In the event that the Bureau is unable to contribute said thirteen million dollar ($13.000.000) grant to Miami Beach. or any portion thereot: then the Bureau shall cause the Countv. and the County herein covenants. to pay such amount on behalfofthe Bureau. as ifsame were paid directly bv the Bureau to Miami Beach as specitied herein. Transfer of the grant funds to Miami Beach shall be accomplished in the same manner as set forth in Section 2.02(a) herein. I Section '-1- on page 1-+ of the Interlocal Agreement entitled. "Duration of this Agreement." is amended as follows: -+. STfERHEIM COUNTY MANAGER Honorable Neisen Kasdin Mayor, City of Miami Beach and Sergio Rodriguez, Manager City of Miami Beach 1700 Convention Center Drive Miami Beach, FL 33139 Dear Mr. Mayor and Manager: The purpose of this letter is to confirm our understanding mutually agreed upon at our meeting on Friday, September 18th which included Commissioner Bruno Barreiro, Greater Miami Convention & Visitors Bureau (GMCVB) Past Chair Richard Fain and Acting President & CEO Bill Talbert. This understanding will be memorialized in a written agreement to be negotiated and submitted for the approval of the Miami-Dade County and City of Miami Beach Commissioners respectively, and the GMCVB Executive Committee. Essentially, the County will assume responsibility for lifeguards and beach cleanliness. The agreement shall also deal with concessions, revenue therefrom, and City police protection. Substantively, it was agreed that Miami-Dade County would provide $500,000 in Fiscal Year (FY) 98/99 to support the operation of the Miami Beach Convention Center, which should assist Miami Beach in freeing up otherwise committed dollars for additional tourist-oriented services on Miami Beach. The GMCV8 will, in FY 98/99, pay $900,000 in two installments of $450,000 each in accordance with a previous bilateral agreement between the GMCV8 and the City of Miami Beach. In FY 98/99, the GMCV8 will contribute an additional $600,000 perhaps to further assist Miami Beach in funding the new Loews and African-American Hotel projects. In FY 99/2000 Miami-Dade County will assume responsibility for S 1.2 million of the expenses related to beach expenses, the "beach" being defined as that land from the dune line to the water's edge. This represents the first annual payment with increasing contributions which, after four years, will ultimately lead to the establishment of the beach as a regional park operated by Miami-Dade County. 125 STEPHEN P. Further. in FY 99/2000, the GMCVB will contribute $800,000 to support the new convention hotel projects In FY 2000/01, Miami Dade County will contribute a total of 52,000000 (approximately 50% of the operating cost of the beach), subject to the terms in the aforementioned agreement. There will be no further payments by the GMCVB. In 01/02, Miami-Dade County will assume $3,000,000, and in 02/03, Miami-Dade County will assume $4,000.000, at which time, the County will take over the operation of the Beach as a regional park. It was agreed that as a condition of this agreement, the City of Miami Beach and/or its agencies would make no further financial demands nor change its funding formula for the GMCVB for the 5-year duration of this agreement and hopefully beyond. One of the primary reasons for County support is that Miami Dade County, as the major contributor to the GMCVB, believes that the marketing and promotion of the Greater Miami destination for tourism and conventions is of vital importance to the overall economy of our community. We wish to extend our appreciation for your support and encouragement of these negotiations and look forward to mutually defining the more exact terms of our agreement in the coming weeks. Kasdin and Members of the City Co . sion DA TE: September 23, 1998 FROM: Sergio Rodriguez City Manager SUBJECT: A RESOL ION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN MIAMI-DADE COUNTY, CITY OF MIAMI BEACH, CITY OF MIAMI, VILLAGE OF BAL HARBOUR, AND THE GREATER MIAMI CONVENTION AND VISITORS BUREAU AND APPROVING THE EXTENSION OF THE NOTIFICATION PERIOD REQUIRED TO TERMINATE THE INTERLOCAL AGREEMENT TO OCTOBER 30, 1998. ADMINISTRA TION RECOMMENDATION: Adopt the Resolution. BACKGROUND: The City of Miami Beach (City) is currently one of the parties to an Interlocal Agreement ("Agreement"), dated September 30, 1993, with the Greater Miami Convention and Visitors Bureau (Bureau) which also includes Miami-Dade County, City of Miami and the Village ofBal Harbour. The Agreement stands to be automatically renewed at the end of each fiscal year (September 30, 1998), unless a participating public agency delivers written notice to terminate the Interlocal Agreement to the Bureau ninety (90) days prior to the end of the current term. On June 17, 1998, the Mayor and City Commission approved a Letter Agreement between the City and the Bureau, waiving the ninety (90) day notice required to terminate the Interlocal Agreement, and giving the City until September 29, 1998, to terminate same. ANAL YSIS: The Administration has negotiated an Amendment ("Amendment") to the Interlocal Agreement with the Bureau and Miami-Dade County and is recommending the following changes: 120 1 AGENDA ITEM KJ A DATE ~-23-crg 1. Extend the notification period to October 30, 1998. (See attachment 1.) 2. The term of the Agreement will be for five (5) years. 3. Commencing on October 1, 2003, the County will assume the functions of Beach Patrol and Beach Maintenance up to the boardwalk (or the dune--where a boardwalk does not exist). The County will continue to provide the equivalent level of service provided by the City, or better. Miami Dade County will be submitting the proposed Amendment for approval to the County Commission in October 1998. As of the writing of this memorandum, the Bureau's Executive Committee is being individually polled by Mr. Bill Talbert in an effort to obtain approval of this Amendment. CONCLUSION: The Administration recommends that the Mayor and City Commission adopt the Resolution approving the Amendment to the Interlocal Agreement which includes, among other things, the extension of the notification period to terminate the Agreement to October 30, 1998. STIERHEIM COUNTY MANAGER Honorable Neisen Kasdin Mayor, City of Miami Beach and Sergio Rodriguez, Manager City of Miami Beach 1700 Convention Center Drive Miami Beach, FL 33139 Dear Mr. Mayor and Manager: The purpose of this letter is to confirm our understanding mutually agreed upon at our meeting on Friday, September 18th which included Commissioner Bruno Barreiro, Greater Miami Convention & Visitors Bureau (GMCVB) Past Chair Richard Fain and Acting President & CEO Bill Talbert. This understanding will be memorialized in a written agreement to be negotiated and submitted for the approval of the Miami-Dade County and City of Miami Beach Commissioners respectively, and the GMCVB Executive Committee. Essentially, the County will aSSume responsibility for lifeguards and beach cleanliness. The agreement shall also deal with concessions, revenue therefrom, and City police protection. Substantively, it was agreed that Miami-Dade County would provide $500,000 in Fiscal Year (FY) 98/99 to support the operation of the Miami Beach Convention Center, which should assist Miami Beach in freeing up otherwise committed dollars for additional tourist-oriented services on Miami Beach. The GMCVB will, in FY 98/99, pay $900,000 in two installments of $450,000 each in accordance with a previous bilateral agreement between the GMCVB and the City of Miami Beach. In FY 98/99, the GMCVB will contribute an additional $600,000 perhaps to further assist Miami Beach in funding the new Loews and African-American Hotel projects. In FY 99/2000 Miami-Dade County will assume responsibility for $1.2 million of the expenses related to beach expenses, the "beach" being defined as that land from the dune line to the water's edge. This represents the first annual payment with increasing contributions which, after four years, will ultimately lead to the establishment of the beach as a regional park operated by Miami-Dade County. 125 STEPHEN P. Further, in FY 99/2000, the GMCVB will contribute $800,000 to support the new convention hotel projects. In FY 2000/01, Miami Dade County will contribute a total of $2,000,000 (approximately 50% of the operating cost of the beach), subject to the terms in the aforementioned agreement. There will be no further payments by the GMCVB. In 01/02, Miami-Dade County will assume $3,000,000, and in 02/03, Miami-Dade County will assume $4,000,000, at which time, the County will take over the operation of the Beach as a regional park. It was agreed that as a condition of this agreement, the CitY of Miami Beach andlor its agencies would make no further financial demands nor change its funding formula for the GMCVB for the 5-year duration of this agreement and hopefully beyond. One of the primary reasons for County support is that Miami Dade County, as the major contributor to the GMCVB, believes that the marketing and promotion of the Greater Miami destination for tourism and conventions is of vital importance to the overall economy of our community. We wish to extend our appreciation for your support and encouragement of these negotiations and look forward to mutually defining the more exact terms of our agreement in the coming weeks. I spoke to Howard Gregg, Chief of the Research Division. Mr. Gregg told me the County basically follows the definition as provided in the National Recreation and Parks Association's Recreation, Park and Open Space Standards and Guidelines. These guidelines are well accepted in the Parks and Recreation field as valid. In this set of guidelines there are two (2) distinct area defined as "Regional". The first is Regional/Metropolitan Park and the second is Regional Park Reserve. As the explanation of each is lengthy I will fax you the copy for your review.
