. 12 DRUGS; PROVIDING FOR AN EFFECTIVE DATE

15 W 18REAS, certain' synthetic hallucinogenic drugs. marketed as "bath salts'. are
lb powerful stimulant drugs that are suspected to have been designed to avoid prosecution; and
. 118. WHEREAS, "Ivory Wave ", "Purple Wave ", "Vanilla Sky ", and "Bliss" are all
19 `among the many street'names of a so -called designer drug known as "bath salts "; and

21 WHEREAS, with recent developments involving individuals' use of "bath salts"
22 containing dangerous synthetic drugs,. stricter measures must be taken to stop the growing
23 prevalence.of this designer drug; and
24
25 WHEREAS, dangerous drugs like "bath salts" containing dangerous synthetic drugs
26 are terrorizing our communities and destroying lives; and
27
28 WHEREAS, . citing an "imminent threat to public safety :the U.S. Drug
29 Enforcement: Administration (`DEA ") made illegal the possession or sale of all known
30 chemicals used to make "bath salts" for a one -year period; and .

32 WHEREAS, the Mayor and Commission of the Village of Biscayne Park urge the
_33 DEA to make the ban permanent, in order to protect our. communities;:and

35 WHEREAS, by marketing these products as "bath salts and labeling them "not for.
36 human consumption", specifically enumerating them as illegal has been avoided; and
37
38 WHEREAS, in recent years, the abuse of "bath salts" has been increasing and have
39 become. increasingly popular due to the perception that they pose a seemingly safer
40 alternative to illegal methods of getting "high' "and
41
42 • - WHEREAS, "bath salts" are readily available on the internet, at convenience stores,
.43 discount tobacco outlets, gas stations, pawnshops, tattoo parlors, and other locations; and
44
45 WHEREAS, the Mayor and. Commission ;.believe that legislation banning the
'46 marketing, possession, trafficking and furnishing of "bath salts " - containing -dangerous
47 synthetic:drugs will give law enforcement the tools they need to keep our streets safe from
48 this new and emerging. drug that -ruins lives and causes havoc in communities across the
49 country.

51 NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COMMISSION

55 Section 1. The foregoing "WHEREAS" clauses are true and correct and hereby
56 ratified and confirmed by the Village Commission.

2 Section 2. The Mayor and Commission of the Village of Biscayne Park, Florida,
3 hereby urge and encourage the State Legislature to enact legislation that bans the marketing,
4 possession, trafficking and furnishing of "bath salts" containing dangerous synthetic drugs
5 within the State of Florida.
7 Section 3 . The Village Clerk is hereby directed and authorized to send a copy of
8 this resolution to Governor Rick Scott, and to all State Representatives, State Senators, the
9 presiding Officers and Council members of the municipalities in Miami -Dade County, and
10 to Richard Kuper, Esquire, Executive Director of the Miami -Dade County League of Cities.

12 Section 4. This Resolution shall become effective upon adoption.
