RESOLUTION NO. 98-23009
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY
MANAGER OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION
FOR FUNDING, IN A TOTAL AMOUNT OF $2,100,000, FROM THE
MIAMI-DADE COUNTY'S SAFE NEIGHBORHOOD PARKS BOND
PROGRAM, FOR THE PURPOSE OF RENOVATING NORTH SHORE
OPEN SPACE PARK; ESTABLISHING THE SAFE NEIGHBORHOOD
PARKS BOND PROGRAM RENOVATION PROJECT WORK ORDER, AND
APPROPRIA TING THE GRANT FUNDING, IF AWARDED, TO A WORK
ORDER; AND FURTHER AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE ALL NECESSARY DOCUMENTS RELATED TO
THIS APPLICATION AND THE GRANT.
WHEREAS, the citizens of Miami-Dade County have authorized the issuance of general
obligation bonds (the Bonds) for the purpose of financing capital improvement programs for certain
parks, beaches, natural areas and recreation facilities; and
WHEREAS, to implement and give effect to the bond program, Miami-Dade County,
Florida enacted Ordinance 96-115, the Safe Neighborhood Parks Ordinance (the Ordinance); and
WHEREAS, it is necessary and desirable to improve the quality of life, to benefit property
values, to promote prevention of juvenile crime by providing positive recreation opportunities, and
to improve the recreation facilities of youth, adult, and senior citizens in this community through
the improvement of our parks and natural areas; and
WHEREAS, these funds will be used to renovate North Shore Open Space Park in
accordance with the recommendations of the approved Parks Master Plan; and
WHEREAS, pursuant to the terms of the Ordinance, the passage of this resolution and the
acts contemplated by this resolution are conditions to obtaining a grant; and
WHEREAS, the City of Miami Beach wishes to make application for the grant monies for
the project listed as North Shore Open Space Park subject to all terms and conditions of the
Ordinance.
NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AS FOLLOWS:
Section 1.
The City hereby authorizes the City Manager or his designee to make application for a grant in
connection with such application, to execute such grant agreements and other contracts and
documents, subject to approval. Authorize the City Manager and the Mayor to make application for
a grant for the North Shore Open Space Park Project in the amount of $2.1 Mil, and in connection
with such application to execute such grant agreement and other contracts and documents, to expend
Safe Neighborhood Parks bond funds received for the purposes described in the funding request, to
execute any necessary amendments to the grant application and contracts, and take such other acts
as may be necessary to bind the City of Miami Beach and accomplish the intent of this resolution.
Section 2.
The City of Miami Beach shall complete the Project in accordance with the terms of the grant
agreement, the Ordinance, and the administrative rules authorized by the Citizen's Oversight
Committee (the Committee) to implement the Ordinance. If the total cost ofa Project exceeds the
value allocated in the grant, then the City of Miami Beach will provide any supplemental funds
required to complete the Project. In the event that supplemental funds are necessary for completion
of the Project, as of the point in time that it is known the supplemental funds are needed, the City
of Miami Beach will demonstrate that such supplemental funds have been committed to the Project
prior to and as a condition of disbursement or further disbursement of grant funds. The requirement
for the City of Miami Beach to provide any supplemental funds required to complete the Project
may, at the sole discretion of the Committee, be modified in whole or in part by a reduction in scope
of work consistent with the Ordinance.
Section 3.
The City Miami Beach recognizes and directs that any beach, park, or other public facility acquired,
developed, rehabilitated or restored with bond funds, including this Project, shall be open and
accessible to the public without discrimination as to race, color, gender, age, religion, belief,
residence, natural origin, marital status or disability.
Section 4.
To the extent allowed by law, the City of Miami Beach shall commit any and all funds which may
be required to operate, maintain and provide programming at this park project upon its completion.
Section 5.
No substitution in capital project funding by the City of Miami Beach shall occur as a result of the
grant for which the City of Miami Beach is applying.
Section 6.
The Mayor and City Clerk are authorized to execute all necessary documents related to the grant
application.

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
On November 5, 1996, the citizens of Miami-Dade County approved a $200 million bond issue to
improve neighborhood and regional parks, restore and acquire recreational areas, beaches and natural
lands. The primary goal of this bond program was to promote neighborhoods safety, reduce juvenile
crime and improve quality of life.
Through this grant process, the City of Miami Beach applied for funding in the amount of $29
million and was recommended for a total of $7,266,000 J.)y the Citizen's Oversight Committee.
Included in this recommendation was $2.1 million for the North Shore Open Space Park Project.
In December of 1997, the City Commission authorized the Administration to apply for $5,166,000
of the original award with the understanding the allocation for North Shore Open Space Park would
be applied for when the related Altos Del Mar issues were near resolution.

ANAL YSIS:
The project schedule for the North Shore Open Space Park program has been on hold pending the
resolution of the State of Florida/Altos Del Mar issues. In anticipation of a resolution, the
Administration intends to submit an application to the Miami-Dade County Safe Neighborhood
Parks Bond Program for the City's allocation of$2.1 million designated for this park. Applications
for the next year's funding cycle must be submitted to Miami-Dade County the last week of
December. According to Miami-Dade County, the bonds will be sold in May 1999, and the funds
will be available in June/July of 1999. Timely submission of this application will ensure the funding
is available for the City to begin the restoration of North Shore Open Space Park as proposed.
CONCLUSION:
Approve the attached Resolution.
