Amendment 1 to PSA & ES with Schwebke-Shiskin and Associates AMENDMENT No. 1 TO THE PROFESSIONAL ARCHITECTURE AND ENGINEERING SERVICES FOR THE BAYSHORE NEIGHBORHOOD NO. 8E - SUNSET ISLAND I & II RESIDENT PROJECT REPRESENTATIVE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND SCHWEBKE-SHISKIN & ASSOCIATES DATED DECEMBER 14, 2011, SAID AMENDMENT IN AN AMOUNT NOT-TO-EXCEED $24,999.00; TO PROVIDE ADDITIONAL SERVICES FOR THE RE-ALIGNMENT OF ROADWAY AND DRIVEWAY HARMONIZATION ANALYSIS This Amendment No. 1 to the Agreement, made and entered this /7 day of Q a(_ 2012, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as City), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and SCHWEBKE-SHISKIN & ASSOCIATES, INC, a Florida Corporation, having its offices at 3240 Corporate Way, Miramar, Florida, 33025 (hereinafter referred to as the Consultant). RECITALS WHEREAS, on December 14, 2011, the Mayor and City Commission approved resolution no. 2011-27792 authorizing the execution of an Agreement between the City of Miami Beach and Schwebke-Shiskin & Associates, Inc. (Consultant), for a not-to-exceed amount of $249,995, including reimbursable expenses for Resident Project Representative Services for Neighborhood No. 8 Bayshore (Package E)—Sunset Islands I & II (the Project); and WHEREAS, the Project includes Resident Project Representative Services for a period of up to thirteen (13) months; and WHEREAS, on September 12, 2012, it was determined that additional services needed to be added to the project outside of the original scope of work; and WHEREAS, the consultant submitted a proposal for additional professional services associated with the additional scope of work; and WHEREAS, the total additional fee requested by the Consultant for the additional work is $24,999.00; and WHEREAS, City staff have evaluated the Consultant's cost proposal and are in agreement that the proposal is reasonable; and WHEREAS, additional funds have been appropriated within the capital budget for the additional design work; and WHEREAS, Amendment No. 1 to the Agreement will revise the total contract sum to a not-to-exceed total of$274,994.00. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 1. 2. MODIFICATIONS The Agreement is amended to include and incorporate the additional work, as set forth in Schedule A, attached hereto. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No. 1. I & II SCOPE OF SERVICES Schedule "A" entitled, "Scope of Services", is amended as follows: ADD the following TASK 5—ADDITIONAL SERVICES: Task 5.1 —Additional Services— Realignment of Roadway Baseline: As required by site conditions, the Sunset Islands 1 & 2 Bid Package No. 8E project will require additional design efforts to redesign the stormwater pollution control structures all roadway baselines to coincide with the centerline of the platted rights-of-way. In consideration of existing encroachments it was determined that in some areas the centerline of the proposed roadway may deviate from the centerline of the platted rights-of-way. Specifically, it was determined that the Sunset Drive roadway baselines on Sunset Island No. 2 and the corners of both perimeter roads on Sunset Island No. 1 & 2 may deviate from the centerline of the platted rights-of-way to minimize disturbance to existing right-of-way encroachments. Also, in consideration of the proposed infrastructure improvements by Chen-Moore &Associates, Inc., it was decided that the CONSULTANT shall analyze the impact of the realigned baseline to the proposed infrastructure improvements to confirm that the realignment of the baseline will not significantly impact the original design. It was agreed that minor adjustments to the infrastructure improvements may be required to insure conformance with the previously approved plans. However, it was agreed that the CONSULTANT will not address any errors and omissions that may exist in the construction plans prepared by Chen-Moore &Associates, Inc. Professional services to be provided by the CONSULTANT shall include: - Realignment of all roadway baselines to coincide with the center of the platted rights- of-way, with the exception of the Sunset Island No. 1 and 2 perimeter road corners and Sunset Drive on Sunset Islands No. 2. - The corners of the perimeter roadway baselines on Sunset Island No. 1 and 2 will be designed, as needed, to minimize impacts to existing encroachments. These corners shall be designed with geometrically tangential curves. Basis of Scope: The above scope was prepared based on the following assumptions: - The previously designed infrastructure improvements originating from Chen-Moore & Associates, Inc. are free of any errors and omissions. - The purpose of this work is to provide the contractor's surveyor with a CAD file for their use to layout all proposed infrastructure improvements and roadways. Deliverables: A CD of the CAD files with the realigned roadway baselines showing the infrastructure improvements from Chen-Moore &Associates, Inc. Schedule: - Additional services will commence upon notification of Notice to Proceed (NTP) by the City. Fee: - This additional service will be completed for a lump sum fee of$11,500. SS&A will invoice the City on a monthly basis based on the percentage complete. \\miamibeachI526\files\capi\$all\project files\bayshore e-sunset islands 1&2\schwebke agreement(rpr)\amendments\additional services0l - schedule a.doc Task 5.2—Additional Services— Driveway Harmonization Analysis: As required by site conditions, the Sunset Islands 1 & 2 Bid Package No. 8E project will require additional design efforts to harmonize driveways beyond the extent shown on the Chen-Moore Construction Sets dated December 5, 2011. In consideration of the proposed infrastructure improvements by Chen-Moore & Associates, Inc., it was decided that the CONSULTANT shall analyze the impact of the raised roadway to the existing driveways to confirm that the driveways will not be able to positively sheet flow to the proposed valley gutters. It was agreed that additional elevations will be surveyed within the private residences by the CONSULTANT so that the DESIGN CONSULTANT can determine a course of action to provide positive drainage of the driveways found to be lower than the proposed valley gutters. Professional services to be provided by the CONSULTANT shall include: - Walkthrough of the project for analysis of existing conditions. - Analysis of roadway construction drawings. prepared by Chen-Moore &Associates and existing elevations of driveways to determine which driveways will require driveway harmonization beyond the limits shown on the Chen-Moore & Associates construction drawings. - Perform topographic surveys at requested locations. - Update topographic survey provided by Chen-Moore &Associates to reflect the additional topographic information. Basis of Scope: The above scope was prepared based on the following assumptions: The purpose of this work is to provide the Engineer of Record, Chen-Moore & Associates with a CAD file for their use to prepare design sketches for harmonization of driveways within private properties. Deliverables: - A CD of the CAD files with additional existing elevations surveyed will be provided. Schedule: - Additional services will commence upon notification of Notice to Proceed (NTP) by the City. Fee: This additional service will be completed for a lump sum fee of$13,499.
