AUTHORITY - Upon affirmative action taken by the Mayor and City Commission of the City of Miami Beach, Florida, on July 18,2012 , for approval to award a contract, upon execution between the City of Miami Beach, Florida, and Contractor. B. EFFECT - This Contract is entered into to provide for maintenance of street lighting on state roads with the Miami Beach city limits, pursuant to City Invitation to Bid No. 44- 11/12 and any addenda thereto (the ITB), and Contractor's bid in response thereto (this Contract, the ITB, and Contractor's bid in response thereto may hereinafter collectively be referred to as the "Contract Documents"). C. ORDERING INSTRUCTIONS - All blanket purchase orders shall be issued in accordance with the City of Miami Beach Procurement Division policies and procedures, at the prices indicated, exclusive of all Federal, State and local taxes. All blanket purchase orders shall show the City of Miami Beach Contract Number 44-11/12. D. CONTRACTOR PERFORMANCE - City of Miami Beach departments shall report any failure of Contractor's performance (or failure to perform) according to the requirements of the Contract Documents to City of Miami Beach, Fred Beckmann, Public Works Director at 305-673-7000 ext. 6102. E. INSURANCE CERTIFICATE(S) - The Contractor shall file Insurance Certificates, as required, which must be signed by a Registered Insurance Agent licensed in the State of Florida, and approved by the City of Miami Beach Risk Manager, prior to delivery of supplies and/or commencement of any services/work by Contractor. F. ASSIGNMENT AND PERFORMANCE - Neither this Contract nor any interest herein shall be assigned, transferred, or encumbered by Contractor without the prior written consent of the City. In addition, Contractor shall not subcontract delivery of supplies, or any portion of work and/or services required by the Contract Documents without the prior written consent of the City. 1 Certification of Contract Contractor warrants and represents that all persons providing/performing any supplies, work, and/or services required by the Contract Documents have the knowledge and skills, either by training, experience, education, or a combination thereof, to adequately and competently provide/perform same, or services to City's satisfaction, for the agreed compensation. Contractor shall provide/perform the supplies, work, and/or services required under the Contract Documents in a skillful and respectable manner. The quality of the Contractor's performance and all interim and final product(s) and /or work provided to or on behalf of City shall be comparable to the best local and national standards. G. SERVICE EXCELLENCE STANDARDS — Excellent Customer Service is the standard of the City of Miami Beach. As a Contractor of the City, Contractor will be required to conduct itself in a professional, courteous and ethical manner, and at all times adhere to the City's Service Excellence standards. Training will be provided by the City's Organizational Development and Training Specialist. H. PUBLIC ENTITY CRIMES - In accordance with the Public Crimes Act, Section 287.133, Florida Statutes, a person or affiliate who is a contractor, consultant or other provider, who has been placed on the convicted vendor list following a conviction for a public entity crime may not submit a bid on a contract to provide any goods or services to the City, may not submit a bid on a contract with the City for the construction or repair of a public building or public work, may not submit bids on leases of real property to the City, may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract with the City, and may not transact any business with the City in excess of the threshold amount provided in Section 287.017, Florida Statutes, for category two purchases for a period of 36 months from the date of being placed on the convicted vendor list. Violation of this section by Contractor shall result in cancellation of the Contract and may result in Contractor debarment. I. INDEPENDENT CONTRACTOR - Contractor is an independent contractor under this Contract. Supplies, work, and/or services, provided by Contractor pursuant to the Contract Documents shall be subject to the supervision of Contractor. In providing such supplies, work, and/or services, neither Contractor nor its agents shall act as officers, employees, or agents of the City. This Contract shall not constitute or make the parties a partnership or joint venture. J. THIRD PARTY BENEFICIARIES - Neither Contractor nor City intends to directly or substantially benefit a third party by this Contract and/or the Contract Documents. Therefore, the parties agree that there are no third party beneficiaries to this Contract and that no third party shall be entitled to assert a claim against either of them based upon this Contract and/or the Contract Documents. The parties expressly acknowledge that it is not their intent to create any rights or obligations in any third person or entity under this Contract and/or the Contract Documents. 2 Certification of Contract K. NOTICES - Whenever either party desires to give notice to the other, such notice must be in writing, sent by certified United States Mail, postage prepaid, return receipt requested, or by hand-delivery with a request for a written receipt of acknowledgment of delivery, addressed to the party for whom it is intended at the place last specified. The place for giving notice shall remain the same as set forth herein until changed in writing in the manner provided in this section. MATERIALITY AND WAIVER OF BREACH - City and Contractor agree that each requirement, duty, and obligation set forth in the Contract Documents is substantial and important to the formation of this Contract and, therefore, is a material term hereof. City's failure to enforce any provision of the Contract Documents shall not be deemed a waiver of such provision or modification of this Contract. A waiver of any breach of a provision of this Contract shall not be deemed a waiver of any subsequent breach and shall not be construed to be a modification of the terms of this Contract. M. SEVERANCE - In the event a portion of this Contract and/or the Contract Documents is found by a court of competent jurisdiction to be invalid, the remaining provisions shall continue to be effective unless City or Contractor elects to terminate this Contract. An election to terminate this Contract based upon this provision shall be made within seven (7) days after the finding by the court becomes final. 3 Certification of Contract N. APPLICABLE LAW AND VENUE - This Contract and/or the Contract Documents shall be enforceable in Miami-Dade County, Florida, and if legal action is necessary by either party with respect to the enforcement of any or all of the terms or conditions herein exclusive venue for the enforcement of same shall lie in Miami-Dade County, Florida. By entering into this Contract, Contractor and City hereby expressly waive any rights either party may have to a trial by jury of any civil litigation related to, or arising out of the Contract and/or the Contract Documents. Contractor, shall specifically bind all subcontractors to the provisions of this Contract and the Contract Documents. O. AMENDMENTS - No modification, amendment, or alteration in the terms or conditions contained herein, or in the Contract Documents, shall be effective unless contained in a written document prepared with the same or similar formality as this Contract and executed by the City and Contractor. P. This Contract shall not be effective until all bonds and insurance(s) required under the Contract Documents have been submitted to, and approved by, the City's Risk Manager. Q. Additionally, the Procurement Division notified seven (7) local contractors, via e-mail, which resulted in the receipt of four(4) bids from the following vendors: American Lighting and Stabilization, Inc.; Enterprise Electrical Contracting, Inc.; Horsepower Electric, Inc.; and Under Power Corporation. An administrative review of the bidders' qualifications, experience, capability, and performance evaluations was conducted. Based on the analysis of the four(4)bids received, Mr. Mike Alvarez and Mr. Melvin Sarria (the Panel) recommended the lowest and best bidder, Under Power, based on price, experience, a nd past performance in working with the City over the past five (5) years. The Panel also agreed that Under Power's response time has been excellent. By awarding the contract to the lowest total bid, the City will realize a total annual cost savings of $21,608.88 from the current contract. ANALYSIS The purpose of this bid is to establish a contract, by means of sealed bids, for qualified vendor(s) for the supply of all labor, materials, tools, and equipment necessary to provide service, repair, and maintain the State Roadway Street Lighting System located within the limits of Miami Beach, consisting of 812 lighting fixtures and 85 Wi-Fi nodes for power at the pole and photocell located on the light pole and/or pole arm, on an as needed basis. BACKGROUND The Mayor and City Commission, at its April 11, 2007 meeting, approved and authorized the Mayor and City Clerk to execute a State Highway Lighting, Maintenance, and Compensation Agreement between the City and the Florida Department of Transportation for the street light maintenance services for FDOT-owned lighting systems on Miami Beach. The aforementioned authorization was based on the Administration's recommendation that the City of Miami Beach take over the maintenance of FDOT owned lighting systems within the City of Miami Beach to provide sufficient mounting assets for the deployment of the City's Wi-Fi system. The FDOT Lighting Systems are located along the following roads: Abbott Avenue—72nd Street to Indian Creek Drive; Alton Road—5th Street to 63rd Street; Collins Avenue 5th Street to 61 st and 72nd Street to 87th Terrace; 5th Street—Alton Road to Ocean Drive; 41 st Street—Alton Road to Collins Avenue; 63rd Street—Alton Road to Collins Avenue; 71 st Street—West of North Bay Causeway to Rue Notre Dame; Harding Avenue—72nd Street to 87th Terrace; Indian Creek Drive—26th Street to 44th Street and 59th Street to 71st Street; Normandy Drive—Rue Notre Dame to West of North Bay Causeway; and MacArthur Causeway—Alton Road to West City Limits. The City agreed to be responsible for energy costs, replacement or system upgrades, location of underground electrical conduits, response to citizen reports of street light malfunctions, and all other maintenance activities, including emergency responses. At its June 6, 2007 meeting, the Mayor and City Commission adopted Resolution No. 2007- 26567(the Resolution) which approved and authorized, pursuant to Section 2-367 (e)of the Miami Beach City Code, a waiver of the competitive bidding process, by 5/7ths vote, a two- year maintenance and service agreement with Under Power Corporation, at the rate of $10.22 per light, per month. The maintenance and service rate of$10.22 per light, per month, was a fixed cost for year one, and additional years were subject to the Consumer Price Index for Miami and Fort Lauderdale, which has not been exercised to date. Invoices for January and February 2012 reflected additional expenses due to repairs to light poles as a result of an accident and theft. The average monthly cost has been $87298.64 for the maintenance of 812 street light poles. The contract with Under Power Corporation expired on May 31, 2012. At its June 6, 2012 meeting, the Mayor and City Commission approved a month to month extension of the contract under the same terms and conditions,-until a new maintenance agreement would be awarded via a bidding process. 2 83 Commission Memo ITB 44-11/10 Maintenance of Street Lighting on State Roads within the Miami Beach City Limits July 18, 2012 ITB PROCESS On June 8, 2012, Invitation to Bid (ITB) No. 44-11/12 was issued, with an opening date of June 29, 2012. Based on the analysis of the four (4) bids received, Mr. Mike Alvarez and Mr. Melvin Sarria (the Panel) recommended the lowest and best bidder, Under Power, based on price, experience, and past performance. The Panel also noted that Under Power's response time has been excellent. The enclosed schedule provides the bid tabulation results for ITB No. 44-11/12. (see Appendix A) It should be noted that three (3) of the four(4) bidders' (including Under Power's) Bid Forms contained minor irregularities, in that the bidder incorrectly interpreted the method by which certain line items were to be filled out. Using Under Power's Bid Form as an example, under the line item pricing for the Wi-Fi Nodes component, the line item for"Total Annual Amount (12 months)" reflects the Unit Price (per node/per month) multiplied by the total number of Wi-Fi nodes (85), but not multiplied by 12 months. Notwithstanding the preceding, the Administration considers that, should the City Commission wish to move forward with the recommended award, it has the discretion, as expressly provided in the ITB, to waive this minor irregularity. Section 1.3 of the ITB, entitled "Price Quoted", provides that "In case of discrepancy in computing the amount of the bid, the UNIT PRICE quoted will govern." (See ITB at pg. 6, also attached as Appendix B hereto). UNDER POWER Under Power has been providing street lighting maintenance and repair services to the City since 2007. Specific article(s) of equipment/supplies shall conform in quality, design and construction with all published claims of the manufacturer. Brand Names: Catalog numbers, manufacturers' and brand names, when listed, are informational guides as to a standard of acceptable product quality level only and should not be construed as an endorsement or a product limitation of recognized and legitimate manufacturers. Bidders shall formally substantiate and verify that product(s) offered conform with or exceed quality as listed in the specifications. The bidder shall indicate on the Bid Form the manufacturer's name and number if bidding other than the specified brands, and shall indicate ANY deviation from the specifications as listed. Lack of knowledge or ignorance by the bidder with/of Applicable Laws will in no way be a cause for relief from responsibility. 1.19 PATENTS & ROYALTIES: The bidder, shall indemnify and .save harmless the City of Miami Beach, .Florida, and its officers,employees,contractors,and/or agents,from liability of any nature or kind,including cost and expenses for, or on account of,any copyrighted,patented, or unpatented invention, process, or article manufactured or used in the performance of the contract,including its use by the City of Miami Beach, Florida. Bidders must be able to demonstrate a good record of performance for a reasonable period of time, and have sufficient financial capacity, equipment, and organization to ensure that they can satisfactorily execute the services if.awarded a contract under the terms and conditions of this bid. In determining the lowest and best bidder, in addition to price,there shall be considered the following: a. The ability, capacity and skill of the bidder to perform the contract. b. Whether the bidder can perform the contract within the time specified,without delay or interference. C. The character, integrity, reputation,judgment, experience and efficiency of the bidder. d. The quality of performance of previous contracts. e. The previous and existing compliance by the bidder with laws and ordinances relating to the contract. 1.37 ASSIGNMENT: The successful bidder shall not assign,transfer, convey,sublet or otherwise dispose of the contract, including any or all of its right, title or interest therein, or his/her or its power to execute such contract,-to any person, company or corporation, without the prior written consent of the City. 1.38 'LAWS, PERMITS AND REGULATIONS: The bidder shall obtain and pay for.all licenses,permits,-and inspection fees required for this project; and shall comply with all Applicable_Laws. 1.39 OPTIONAL CONTRACT USAGE: As provided in Section 287.042(17), Florida Statutes, other State agencies may purchase from the resulting contract,.provided the Department of Management Services, Division of 'Procurement, has certified its use to be cost effective.and in the best interest of the State. Bidders havethe option of selling these commodities or services certified by the-Division to the other State.agencies at the agencies' option. ^� 1.40 SPOT MARKET PURCHASES: It is the intent of the City to purchase the items specifically listed in this bid from the successful bidder. Estimates are based upon the City's actual needs and/or usage .--during-_a-.previous. contract-period.-The.City-_may--use.-said-estimates--for- purposes-of-- --- --- determining whether the low bidder meets specifications. 1.44 COLLUSION Where two (2) or more related parties each submit a bid or bids for any contract, such bids or bids shall be presumed to be collusive. The foregoing presumption may be rebutted by presentation .of evidence as to the extent of ownership, control and management of such related parties in the preparation and submittal of such bid or bids. "Related parties"means bidders or the principals thereof which have a direct or indirect ownership interest in another bidder for the same contract, or in which a parent company or the principals thereof of one (1) bidder have a direct or indirect ownership interest in another bidder for the same contract. Bid or bids found to be collusive shall be rejected. The City may,-at its discretion,provide reasonable"cure period for any contractual violation prior to termination of the contract; should the successful bidder fail to take the corrective action specified in-the City's notice of default within the allotted cure period, then the City may proceed to-terminate the contract for cause in accordance with this subsection 1.56. 1.54 TERMINATION FOR CONVENIENCE OF CITY The City may, for its convenience,terminate the work and/or services then remaining to be performed,at any time, by giving written notice to the successful bidder of such'termination, which shall become effective'thirty (30) days following receipt by bidder of such notice. In that event, all finished or unfinished documents and other materials shall be properly delivered to the City. If the contract is terminated by the City as provided in this subsection, the City shall compensate the successful bidder in accordance with theterms of the contract for all and without cause and/or any resulting liability to the City, work and/or services actually performed by the successful bidder, and shall also compensate the bidder for its reasonable direct costs in assembling and delivering to City all documents. Such payments shall be the total-extent of r the City's liability to the successful bidder upon a termination as provided for in this i subsection. ! 1.55 INSURANCE AND INDEMNIFICATION: _ --- (See..Ch.e.ck_List.fo.r_app.li.cability-to this.bid)_ ____ The successful bidder shall be responsible for his work and every part thereof, and for all materials, tools, appliances and property of every description, used in connection with this particular project. The bidder shall specifically and distinctly assume,and does so assume, all risks of damage or injury to property or persons used or employed on or in connection with the work and of all damage or injury to any person or property wherever located, resulting from any action or operation under the contractor in connection with the work. It is understood and agreed that at all times the bidder is acting as an independent contractor, and not as an agent or employees of the City. The successful bidder,at all times during the full term of the contract, shall comply with the following requirements: No change or cancellation in insurance shall be made without thirty(30)days written notice to the City of Miami Beach Risk Manager. All insurance policies shall be issued by companies authorized to do business under the laws of the State of Florida and these companies must have a rating of at least B+:VI or better per Best's Key Rating Guide, latest edition. Original signed certificates of insurance, evidencing such coverages and endorsements as required herein, shall be filed with and approved by the City is Risk Manager before work is started. The certificate must state Bid Number and Title. Upon expiration of the required insurance,the successful bidder must submit updated certificates of insurance for as long a period as any work and/or services are still in progress. It is understood and agreed that all policies of insurance provided by the bidderr are primary coverage to any insurance or self-insurance the City of Miami Beach possesses that may apply to a loss resulting from the work and/or services performed in this contract. All policies issued to cover the insurance requirements herein shall provide full coverage from the first dollar of exposure. No deductibles will be allowed in any policies issued on this contract unless specific safeguards have been established to assure an adequate fund for payment of deductibles by the insured and approved by the City's Risk Manager. The liability insurance coverage shall extend to and include the following contractual indemnity and hold harmless agreement: The contractor hereby agrees to indemnify and hold harmless the City of Miami Beach,a municipal corporation,its officers,agents,and employees from all claims for bodily injuries to the public, in and up to the .amount of $1,000,000.00, for each occurrenceand for all damages to the property of others, in and up:to the amount of $1,000,000.00, for each occurrence per the insurance requirement under the specifications including costs of investigation, all expenses of litigation, including reasonable attorney fees and the cost of appeals arising out of any such claims or suits because of any and all acts of omission or commission of any by-the contractor, his agents, servants, or employees, or through the mere existence of the project under contract. The bidder will obtain and maintain contractual liability insurance in adequate limits for the _ --- -— --sole'purpose of_protecting--the City of Miami Beach under the Hold Harmless Agreement from any and all claims arising out of this contractual operation. The bidder will secure and maintain policies of subcontractors. All policies shall be made available to the City upon demand.Compliance by the contractor and all subcontractors with the foregoing requirements as to carrying insurance and furnishing copies of the insurance policies shall not relieve the contractor and all subcontractors of their liabilities and obligations under any section of this contract. The successful bidder's employees must work as a __._cooperative.te.am.of_well-trained professionals, and._must..serve_th.e_pu.blic with_dignity_and.__ respect.All business transactions with the City will be conducted with honesty,integrity,and dedication. 2.21 COMPLIANCE WITH CITY'S LIVING WAGE LAW: Pursuant to Section 2-408 of the Miami Beach City Code, as same may be amended from time to time, bidders shall be required to pay all employees who provide services pursuant to this Agreement, the hourly living wage rates listed below: • Commencing with City fiscal year 2011-12(October 1,2011),the hourly living wage rate will be$10.72/hr with health benefits, and $12.17/hr without benefits; and • Commencing with City fiscal year 2012-13 (October 1, 2012), the hourly living rate will be $11.28/hr with health benefits, and $12.92/hr without benefits. The living wage rate and health care benefits rate may, by Resolution of the City Commission be indexed annually for inflation using the Consumer Price Index for all Urban Consumers(CPI-U)Miami/Ft. Lauderdale,issued by the U.S. Department of Labor's Bureau of Labor Statistics. Notwithstanding the preceding, no annual index shall exceed three percent(3%). The City may also, by resolution,elect not to index the living wage-rate in any particular year, if it determines it would not be fiscally sound to implement same (in a particular year). Minimum Requirements: Prospective bidders must have been in business for a minimum of three (3) years, which represent established business relationships of two (2) or more years in the provision of street light maintenance for cities, counties, states or big malls. Bidders are required to submit their equipment Inventory with the Bid. 3.2. SPECIFICATIONS/SCOPE OF WORK Service, repair,and maintain the State Roadway Street Lighting System(hereinafter referred to as the Lighting System)consist of a minimum of 812 lighting fixtures located along FDOT arterial roadways. A high percentage of the poles are aluminum cobra head lights and, smaller percentage decorative poles. In addition, troubleshoot 85 WI-FI Nodes for power onto the pole and check photocell. Perform continuous repairs and maintenance to the Lighting System in accordance with the requirements of the Contract Documents or as directed by Mike Alvarez, Infrastructure (Operations) Director and/or Marvin Sarria, Street Lighting Operations Supervisor herewith called Public Works-Operations located at 451 Dade Boulevard, Miami Beach, Florida. (see attachment of street lighting locations) This technical specification covers the furnishing of all labor, materials, tools, testing, and equipment necessary to maintain the Lighting System within the latest minimum standards of the National Electrical Code and the electrical standards of the City Of Miami Beach. 3.2.1 MATERIALS AND CONSTRUCTION: All materials and construction shall be in compliance with this section of these specifications. A.All materials delivered to the job shall be new, best quality of their respective grades, in accordance with the following specifications and packed in their original sealed containers. All materials to be installed shall bear the Underwriters Laboratories., Inc. (U.L.) label. B.The Contractor shall use materials mentioned in these specifications as standard,and in no case will a substitute be allowed without written approval by Public Works- Operations. C.All work and material shall be protected at all times. Conduit openings shall be closed with protective caps during installation and all materials shall be covered and protected against dirt,water, and mechanical or other injury.All materials damaged during course of construction shall be replaced or repaired to original condition by the Contractor. D. The .Lighting System includes light pole assemblies, foundation base, wiring, luminaire assembles, conductors, grounding system, pole cable distribution system, fuses, ballast assemblies, pull boxes, conduits, load center, transformers, control 23 of 48 ITB-45-11/12 618/2012 Street Lighting Maintenance of State Roads devices, photocells, service points and other related miscellaneous subsystems and appurtenances. 3.2.2. CONDUIT AND WIRING: --- ------ -Conduit-and wiring are especially-the same.in all locations with-minor changes-as needed- -- .- per locations. (see sheets 1 thru sheet 3) and ( STL 1 thru 6 ) Underground Conduit shall be 2 inch, schedule 40 PVC electrical grade conduit. Wiring shall consist of#6 THW Copper, and#6 THW copper ground. Conduit shall be installed a minimum of 36 inches below grade. Conduit shall be connected with approved couplings to the base sleeves incorporated within the light pole bases and Electrical Pull Boxes. Electrical Pull boxes 13 x 24 Quazite shall be installed at the base of each pole. A. Pull boxes shall be Quazite, Box with brass hold down bolts. B.The cover shall be marked "Street Lighting". C. Electrical Pull Box Installation shall conform to the City Of Miami Beach standard pull box installations. 3.2.3. GROUND ROD: Eight (8) foot copper/clad ground rod shall be installed in each electrical pull box and electrical light pole shall be securely grounded as per the National.Electrical Code. Electrical wiring will extend through the bases for connection to each pole. The work shall include all excavation, backfill,materials, labor.Where such surface restoration is required, all work shall be performed in accordance with the City of Miami Beach standards. Warning tape shall be installed a minimum of 1 foot above all electrical conduit. Standoffs shall be used in accordance with the serving public utility company or as directed. The Contractor shall also supply and install all items necessary to insure proper functioning of the Lighting System, including photocell(s), ground wire to be made to the ground lug in . the pole base as shown on the electrical diagram, inline fuses and holders, non-delay fuses 5 amp 300 volt or 600 capacity for each pole accordingly, and appropriate connectors, miscellaneous wiring-and.appurtenant items. 3.2.4. UTILITY LOCATIONS: It is the responsibility of the Electrical Contractor to call for and coordinate all Electrical Utilities marking with Sunshine State One Call; 3.2.5. VOLTAGE: Electrical Contractor shall verify on site the appropriate Voltage on the work to be performed. 3.2.6. TRENCH RESTORATION AND COMPACTING: Trench restoration, compacting and .pavement restoration shall be done by the Electrical Contractor, per the City Of Miami Beach Standards and the Florida Department of Transportation Construction Standards. 24 of 48 [TB-45-11/12 6/8/2012 Street Lighting Maintenance of State Roads i 3.2.7 CONTRACTOR PATROL CREWS and MAINTENANCE CREWS: Contractors Dispatch Crews: 1. Dispatch patrol crews shall be responsible for patrolling the system . The system —_.. .shall be.patrolled at least once per week.-.Patrol logs shall.be provided to.the..City—.—.- --and shall include the employee's time card indicating a nighttime inspection / operation and shall be included with the month of invoice. The patrol crew shall immediately report street light outages and/or disruptions found requiring repairs and perform minor work including but not limited to adjusting or replacing luminaries, lamps, parabolic lenses, replacing fuses and photocells. All lighting outages shall be attended within 48 hours reported including WI-FI outages reported by the Public Works-Operations. 2. Log all activities, disruptions, and minor repairs in a Inspection Spreadsheet Form highly Preferable to be GIS comparable for a citywide map if requested monthly, quarterly or annually for all outages/repairs of the Lighting System. The Contractor must maintain at minimum 98 % of the lights working at night as per Contractor nightly inspection as well as the Public Works-Operations staff. 3. Every Monday through Friday, to perform repairs reported by the patrol crews or directed by Public Works-Operations. Lights found working during the day, Contractor must report within 24 hours to correct the problem and, a bi-weekly day inspection is required. .4. Immediately,24 hours a day, 7 days a week, when directed by the Public Works- Operations to respond to emergency or hazardous conditions related to the Lighting System. 5. For all emergency situations and as directed by the Public Works-Operations, dispatch maintenance and repair crews with -sufficient personnel, material and equipment.resources to safely secure the disruption site within 2 hours of an outage being reported to the Contractor or identified by the patrol crew. 3.3. PERMITS: 1) The Contractor must obtain an annual permit for annual maintenance within the State Roadway's from the City of Miami Beach—Engineering Right-of-Way Division and the Florida Department of Transportation. There will be no permit fee by the City of Miami Beach. If the State of Florida requires a permit fee,the Contractor shall pay the annual permit fee. 2) Contractor must meet all the Maintenance of Traffic ( MOT) as per the latest Florida .Department of Transportation Construction Manual. 3) Lane closures are to be approved by the Public Works-Operations.Any major Roadway intersection that requires major work-such as trenching,will require the presence of an Off-Duty police officer. 4) The Contractor shall give adequate notices to-those in control of all properties that may be affected by the maintenance or construction activities. 25 of 48 rrB-45-11/12 6/8/2012 Street Lighting Maintenance of State Roads 3.4. DISPOSAL OF MERCURY,VAPOR AND HIGH PRESSURE SODIUM LAMPS (AT THE EXPENSE OF THE CONTRACTOR) 1) Contractor shall be responsible to select a recycling company that complies with all -- - -- - County,State,-and federal-regulations and-laws.-- - ---- -- - -------- ----------- 2) Disposal of these lamps shall be by one of the recycling companies listed by the Florida Department of Environmental Protection (DEP). The Contractor is responsible for complying at all times with the latest legislature rules regarding of mercury vapor lamps and high-pressure sodium lamps. During the implementation of the Contract,evidence of the recycling process shall be presented to the City by means of a service ticket issued by the recycling company to the Contractor. This ticket shall contain the name and address of the Contractor, date and the amount of items recycled. 3.5. DIAGNOSIS AND MAINTENANCE The Contractor shall ensure that all repairs comply with the following: 1) Check the physical condition of the concrete base, T-base, hand-hole cover and base fasteners. 2) Check the power fee to the fuse to protect the-luminaire. 3) Check the fuse and fuse holder as well as their relative fit. Replace fuse and/or fuse holder as required. 4) Physical check of pole circuit grounding. 5) Check physical condition of the arm and the luminaries, replacing components as required. 6) Check current feed to luminaries-to detect possible wiring problems"inside the pole and arm. 7) Check lamp condition and,replace as required. 8) Check power door and replace as required. 9) Perform a visual inspection of the illumination pattern for correctness. . 3.6. SYSTEM EVALUATION 1) The City will evaluate the street fighting system on as needed basis and any defective situation that falls within the scope of this Contract shall be promptly corrected when requested by the Public Works-Operations. 2) The Contractor shall perform a complete safety check at each location where any maintenance or work of any type is performed; this safety check shall be noted in the streetlight maintenance work order form.This form shall indicate the work order number and signed by the Contractor Master or Journeyman Electrician licensed in Miami-Dade County or the State of Florida. 3.7. UNDERGROUND DAMAGES Underground damages that are not related to activities of a third party will be repaired by the Contractor at no cost to the City; however,documented damages done by other Contractors - -.---- – -- -or---utility Companies shall be promptly repaired by.the Contractorwhen directed by-the Public=-- -— Works-Operations. An estimate labor cost per hour,equipment and materials is required for approval by the Public Works-Operations and invoiced to the City at month ending. 3.9. PULL BOXES 1) New street light pull boxes shall have an open-bottom, Quazite Polymer concrete design constructed of Class 1 Concrete having a minimum compressive strength of 2,500 p.s.i. at twenty eight (28) days. Polymer Concrete Pull boxes shall be Quazite Product No. PG1324BA12 or approved equivalent. Concrete box shall be Brooks 38 series or approved equivalent. In either case, both the pull boxes shall be constructed above specified manufacturers size, materials, and performance specifications. Therefore, below specified box cover shall be fully interchangeable with either Polymer Concrete Quazite Product No. PGL324HA00 approved equivalent. No other design, size, modification, or materials shall be acceptable. Pull box covers should be marked "Street Lighting. 2) In situation where pull box is located outside of sidewalk,i.e.swale area,the pull box is to have a 5 ft. concrete apron (6 inch thick) placed around it. Contractor to provide cost of the pull box and installation to the Public Works-Operations for approval. 3.10, EMERGENCY WORK The Contractor shall -be responsible at all times including normal work hours and on weekends for the removal of knock down poles or parts of a pole mast arm(s) luminaries(s) and repair the electrical system in such a manner as to prevent electrical shock -to the department's work force and to the general public. The Contractor shall respond to-emergency notifications received by the City, within 2 hours after receipt of the notification by the Public Works-Operations and/or Control Room. The Contractor shall also be responsible for responding to all other emergencies determined by the City. This includes,circuit outages, lights determined to be high priority and strong winds or -Hurricanes damages. The Contractor must provide two contact names and cell phone numbers for 24 hours, 7 days, 365 days emergency contacts. Note- All emergency work include immediate action for safety measures at the emergency site. Knock Down: The light poles shall be made safe within 2 hours notification and shall be installed at the location, and in accordance with the details shown on the attached plans. The poles shall be plumbed after erection. Earth shall be thoroughly compacted around the pole base to prevent shifting. This installation shall be completed within 48 hours after notification by the Public Works-Operations. The only exceptions are unavailability of the City issued. materials or if the damage has been done to the foundation that requires. underground work. These-exceptions must be verified by the Public Works-Operations. .3.11. TRAFFIC MAINTENANCE AND SAFETY PROVISIONS The Contractor shall, be responsible for the provisions, installation and maintenance of all traffic control and safety devices, in accordance with the specifications outlined in the 27 of 48 6/8/2012 rrB-45-11/12 Street Lighting Maintenance of State Roads Florida Department of Transportation (FDOT) Roadway and Traffic design Standards. In addition,the Contractor is responsible for the resetting of all traffic control and information signage, as well as pavement marking removed or damaged during the construction period. Excavated or other material store adjacent to a partially upon a roadway pavement shall be adequately marked for traffic safety at all times. 3.12. MATERIALS AND WORKMANSHIP The Contractor shall provide the services of all workmen, electrical, tradesmen and other employees trained and skilled in various occupations;and all materials except such as may be specifically identified; and shall construct completely ready for its intended purpose,the structure of parts thereof covered by this Contract.
