98-22986 RESO RESOLUTION NO. 98-22986 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO ACT ON BEHALF OF THE CITY TO SUBMIT DOCUMENTATION TO MIAMI-DADE COUNTY REQUESTING THAT THE BOARD OF COUNTY COMMISSIONERS TO AMEND THE BOUNDARY OF THE MIAMI BEACH ENTERPRISE ZONE TO ADD PROPERTY ALONG WASHINGTON AVENUE, AS REFLECTED IN THE SCENARIO # 3, TO THE ENTERPRISE ZONE AND TO DELETE CERTAIN AREAS OF THE BEACHES, COLLINS P ARK, LUMMUS PARK, OCEAN BEACH PARK AND THE EASTERN PORTION OF SOUTH POINTE PARK FROM THE ENTERPRISE ZONE. WHEREAS, in 1986 the Florida Legislature authorized municipalities in the state to establish Enterprise Zones; and WHEREAS, Enterprise Zones provide sales tax and corporate tax credits to businesses; and WHEREAS, the designation of Enterprise Zones, pursuant to Chapter 290, Florida Statutes, has provided invaluable assistance to the City in its effort to achieve the economic development objectives of private sector reinvestment and jobs creation; and WHEREAS, the City desires to maximize the potential for private investment by requesting the Miami-Dade County Board of County Commissioners to amend the boundary of the Miami Beach Enterprise Zone to add privately owned property along Washington Avenue and to delete City-owned park property. WHEREAS, the area to be added to the Enterprise Zone is along Washington Avenue, from 11 th Street to 17th Street, all as more particularly described in the legal description and map attached hereto as Exhibits A and A-I, respectively; and WHEREAS, the areas to be deleted are certain areas of beaches and parks owned by the City which are unable to benefit from the tax credits granted by their location within an Enterprise Zone, all as more particularly shown in the attached Exhibit A-I. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission authorize the City Manager, or his designee, to act on behalf of the City to submit documentation to Miami-Dade County requesting the Board of County Commissioners to amend the boundary of the Miami Beach Enterprise Zone to add property along Washington Avenue, as reflected in the Scenario # 3, to the Enterprise Zone, and to delete certain areas of the beaches, Collins Park, Lummus Park, Ocean Beach Park, and the eastern portion of South Pointe Park from the Enterprise Zone, all as more particularly described in the attached Exhibits A and A-I. ADMINISTRATION RECOMMENDATION: Adopt the recommended Resolution. BACKGROUND: The 1986 Florida Legislature authorized municipalities in the State to establish Enterprise Zones to encourage economic development by providing sales tax and corporate tax credits. The initial Enterprise Zone in Miami Beach was established by Resolution No. 86-18459 adopted on June 4, 1986, and amended on July 9, 1986, by Resolution No. 86-18504. The boundary of the Enterprise Zone was further amended on September 16, 1992, by Resolution No. 92-20596 to include the North Shore community development target areas. (See attached Exhibit 1). According to data from the Office of Community and Economic Development of Miami-Dade County, who administers the Enterprise Zone program for all municipalities in the county, 72 businesses in the Miami Beach Enterprise Zone have benefited from tax credits. Ten of these businesses have used both the jobs tax credit and the sales tax rebate, 61 businesses have received the jobs tax credits alone, and one business received only the sales tax rebate. (See attached Exhibits 2 and 2 A.). Following are the specific Enterprise Zone incentives offered to businesses in the City of Miami Beach Enterprise Zone, with a brief description of each. Incentives provided in the City of Miami Beach have no financial impact on City revenues. All benefits are from the County and State level. AGENDA ITEM RlfJ 1'2 -7- -'l~ DATE COMMISSION MEMORANDUM DECEMBER 2, 1998 PAGE 2 Enterprise Zone Property Tax Credit: 96% credit against state corporate income tax on any ad valorem property tax not abated by local government, for a period of up to 5 years. (No impact on City Funds). Enterprise Zone Jobs Tax Credit: 15% credit against corporate income tax or sales and use tax on wages paid to each employee who is a resident of the Enterprise Zone, for a period of up to 5 years. (No impact on City Funds). Sales Tax Refund: 97% of sales tax, up to a maximum of $1 0,000, may be refunded for business property and on building materials purchased for use by the company. (No impact on City Funds). Federal Job Training Tax Credits: Residents of the Miami Beach Enterprise Zone are also eligible for benefits of federal job training programs. (No impact on City Funds). The property tax abatement incentive proposal is specifically exempted in the City of Miami Beach due to the existence of the tax increment districts. Furthermore, the City of Miami Beach does not provide any impact fee refunds within the Enterprise Zone. In response to questions raised by the City Commission and the Finance and Citywide Project Committee, please be advised that the Loews Hotel, while located within the Enterprise Zone has not received any Enterprise Zone benefits. Furthermore, road impact fee exemptions provided to the Convention Center Hotel projects were based upon the Redevelopment Agency's and the City's investment in street improvements and were granted by the County and not granted as an Enterprise Zone benefit. Additionally, public properties in the amended Enterprise Zone boundaries may benefit any private business located therein that qualifies for Enterprise Zone benefits. ANALYSIS: The Florida Legislature, during the 1998 Session, adopted HB 3225 which enables the governing body of a county to amend the boundaries of the Enterprise Zone for the purpose of replacing areas not suitable for development. The most limiting criterion is that boundary modifications cannot increase the overall size of the Enterprise Zone. Therefore, for any acreage added to the Enterprise Zone, the same number of acres must be deleted. (The boundaries of the Enterprise Zone cannot be reduced to exclude any existing developable area within the zone.) The Miami Beach Enterprise Zone was surveyed and found to contain city-owned parks and beaches which were not suitable for development by businesses that could benefit from the tax credits of the Enterprise Zone. The total area of beaches, Collins Park, Lummus Park, Ocean Beach Park and the eastern portion of South Pointe Park was calculated to contain 66.27 acres. All of these parks are located within the portion of the Enterprise Zone that is located in South Beach. (See attached Exhibit 3). COMMISSION MEMORANDUM DECEMBER 2, 1998 PAGE 3 It was noted that there is a primarily commercial area along Washington Avenue where the tax credits of the Enterprise Zone may stimulate new businesses to locate and encourage improvements to the buildings as well as provide new jobs to area residents. It was also determined that the Enterprise Zone boundary along Collins Avenue between 11th Street and 17th Street could be adjusted to the west to include the privately owned properties that front on both sides of Washington A venue. Pursuant to the Finance and Citywide Project Committee comments. the City Administration is proposing the following three amended boundary scenarios. Maps of each scenario are attached for your review. Scenario # 1 shows the area originally submitted to the Commission. It was determined that the Enterprise Zone boundary along Collins Avenue between 11 th Street and 17th Street could be adjusted west to include the privately owned properties that front on both sides of Washington Avenue. The total area of this addition is 57.81 acres, resulting in a net reduction of approximately 8 acres. Scenario # 2 extends the area to the north and south of Espanola Way from the lot lines half way between Washington and Drexel Avenues to the lot lines halfway between Drexel and Pennsylvania Avenues. The total area of this addition is 59.56 acres, resulting in a net reduction of approximately 6 acres. Scenario # 3 includes the areas proposed in Scenario # 2 plus the City-owned parking lots south of 17th Street between Washington and Pennsylvania Avenues. The total area of the addition proposed in Scenario # 3 is 65.39 acres, resulting in a net reduction of less than one acre. Based on the foregoing, the City Administration recommends Scenario # 3 as stated above. The Miami-Dade County Board of County Commissioners is expected to approve the county-wide modifications to the Enterprise Zones at their regular meeting on December 15, 1998. CONCLUSION: The Administration recommends approval of the attached resolution authorizing the City Manager, or his designee, to act on behalf of the City to submit documentation to Miami-Dade County requesting the Board of County Commissioners to amend the boundary of the Miami Beach Enterprise Zone to add property along Washington A venue, as reflected in the Scenario # 3, to the Enterprise Zone, and to delete certain areas of the beaches, Collins Park, Lummus Park, Ocean Beach Park, and tlJ~ eastern portion of South Pointe Park from the Enterprise Zone. Cable mainstay The Box. a music video network that plays songs ' requested by viewers, has .accepted $335,500 in county and state incen- tives' and will stay at its Miami Beach location. "I think it's important because it helps solidify South Florida as an entertainment production cen- ter," said Frank Nero, president of the Beacon Council, the coun- ty's economic development agency. . Before accepting the incentives, the cable networlc was con,sidering locations in Fort Lauderdale, Los Angeles and New York City. "[The Box] is a marquee com- pany that will continue to produce the lc:ind of software and pI'Ograms . that. will fInd a. worldWIde audi- ence/' . Nero said. "We're very . happy about. their. decision to stay." ' .' The original incentive. applica- tion had asked for $1.065 million in Qualified Target Industry tax refunds, or $7,500 for each of the 142 jobs that The Box intends to; create through its expansion. The state normally, sets the maximum . refund amount at $5,000 per job, . or $1,500 per job for businesses in enterprise zones, such as The Box. , "[State officials] use a formula to calculate what. percentage of that maximum amount is actually granted," Nero said. "The for- mula looks at the taxes that could . be generated. the average salary of each job and over how long a , period of time." . The Box will receive the incen- ' tive funds over the next three to . four years as it adds the promised . new jobs.. Twenty percent of the funds, or $61,100, will be paid by the county, with the rest coming . from the state. "In deciding to stay here and expand, The Boxsces.. a lot of opportunity . in South Florida. '! said Box public relations manager Carl Zablotny. "We're on a roll ri~t now, and moving forward WIth new dca1s." Zablotny said The Box also could qualify for training funds. from Enterprise Florida, and that the company was waiting to hear about additional incentives for being based in an enterprise zone. The Box can be' seen on 125 'cable systems nationwide.
