AMOUNT OF $9,032
This Amendment to the Agreement made and entered thisLrday of June 2013,to provide testing
services during construction, by and between the City of Miami Beach, a Municipal Corporation
existing under the laws of the State of Florida (hereinafter referred to as CITY), having its principal
offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and Atkins North America,
Inc.,a Florida Corporation having its principal office at 4030 West Boy Scout Boulevard,Suite 700,
Tampa, Florida, 33607 (hereinafter referred to as CONSULTANT).
RECITALS
WHEREAS, pursuant to Request for Qualifications(RFQ)No. 04-10/11,the Mayor and City
Commission adopted Resolution No. 2011-27628 on April 13, 2011, approving and authorizing the
Mayor and City Clerk to execute a Professional Services Agreement with Atkins North America, Inc.,
(CONSULTANT)for Professional Services for the South Pointe Pier Project(PROJECT); and
WHEREAS, the Agreement provides for the design, bid, award and construction
administration services-for the South Pointe Pier Project in the not-to-exceed amount of$369,000;
and
WHEREAS,on February 2012,Amendment No. 1 to the Agreementwas executed approving
additional services required pursuant to the USACOE permit RAI process related to a new coral
recipient site in Government Cut, in the not-to-exceed amount of$12,950; and
WHEREAS, on July 2012, Amendment No. 2 to the Agreement was executed to provide
additional bidding and award services required under a Construction Management at Risk method of
procurement in the not-to-exceed amount of$11,974; and
WHEREAS, Amendment No. 3 to the Agreement shall be executed to provide additional
coordination in the FDEP--CCCL permit RAI process in the not-to-exceed amount of$15,120; and
WHEREAS, on January 16, 2013, Amendment No. 4 to the Agreement was approved by
Commission to provide supplemental Construction Administration services in the not-to-exceed
amount of$300,852; and
WHEREAS, this Amendment No. 5 to the Agreement shall be executed to provide material
and laboratory testing services in the not-to-exceed amount of $9,032. NV5-KACO provided
geotechnical services during design phase therefore the firm is familiar with the design and technical
specifications of the contract and scope of work.
NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants,
agreements, terms, and conditions herein contained, and other good and valuable consideration,
the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true, correct and are incorporated as part of this Amendment No. 5.
2. MODIFICATIONS
The Agreement is amended to include"Schedule A-5", which is attached and incorporated
herein.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The CITY and CONSULTANT ratify the terms of the Agreement, as amended by this
Amendment No. 5.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 5 to be
executed in their names by their duly authorized officials as of the date first set forth above.

Dear Ms. Reyes,
As requested, Atkins herein submits a scope of services and budget proposal to
perform limited concrete and soil materials and laboratory testing services to be
performed during the construction phase of the above referenced project. These
services are outside the current scope of work as defined for the Task 4-Construction
Administration Services and therefore, require City written approval and notice-to-
proceed prior to undertaking these services.
Scope of Services
Since Atkins does not perform materials sampling and laboratory testing services, we
have solicited a written proposal from NV5-KACO. As you know, NV5-KACO is the
geotechnical engineer-of-record for the project under a subcontract agreement with
Atkins and as a result, KACO is very familiar with the project design and technical
specifications.
Atkins has reviewed the KACO proposal dated May 31, 2013 (attached ) and finds the
proposed scope to be consistent with the project requirements with respect to the
sampling and testing of cast-in-place and precast concrete and the sampling and testing
of in-situ and imported soils including density testing of compacted soils. All materials
sampling and testing will be in conformance with applicable ASTM standards.

Compensation
In conformance with the terms and conditions of our Agreement with the City, Atkins
proposes to be compensated for the services to be performed by NV5-KACO under
Task 6 - REIMBURSABLES and more specifically under a proposed new task titled
Task 6.6— Materials Testing during Construction.
The proposed level of effort to be undertaken by NV5-KACO translates to a
reimbursable allowance budget of ten thousand dollars ($10,000.00). NV5-KACO
would invoice Atkins on a time and material basis per,the unit prices/rates contained in
the NV5-KACO proposal. Atkins would oversee the services provided by the
subconsultant as well as, to review and approve the NV5-KACO invoices prior to
submitting to the City for direct reimbursement.

Dear Mr. Pitcher:
NV5-KACO, Inc. (KACO) is pleased to submit this proposal as a result of your recent
request for proposal. This Proposal describes our understanding of the project, lists a purpose for
our work, suggests a scope of work and presents our compensation.
PROJECT INFORMATION
Construction of the new South Pointe Park Pier will involve razing of the existing structure
and construction of a new pier. The pier will be constructed on driven precast concrete piles and
precast concrete elements.
PURPOSE
The purpose of our services on this project is to provide materials testing services related
to the pier construction to comprise of soil and concrete sampling and testing services as outlined
below
PROPOSED SCOPE OF SERVICES
Based on the information provided to KACO by Atkins, the following services will be
provided by KACO during the construction phase of the project.
• Perform construction material testing services in conformance with the project specifications
to include: sampling and testing (compressive strength tests at 7 and 28 days)of cast-in-
place concrete for retaining wall, diaphragms and light bollards, etc. (estimated 15 site visits
to obtain 6 cylinders each visit), and the sampling and testing of in-situ and imported soils
(estimated 5 soil samples), density testing of compacted soils (estimated 6 site visits).
Concrete testing services to include on-site air entrainment, temperature and slump
readings, cylinder pick-up, transporting and curing in accordance with ASTM standards.

COMPENSATION
We can complete the scope of services proposed for the unit prices shown below
based on our Miami-Dade County Public Works Professional Services Agreement E12-PW 02.
