SUBJECT: Venetian Islands Right of Way Im ents — Encroachment Process
The purpose of this Letter to Commission (LTC) is to provide an update on the Venetian
Islands Right of Way Improvements project and the City's encroachment policy.
The Venetian Islands Right of Way Improvement Project is comprised of extensive
scope of work that will upgrade the infrastructure and certain hardscape as follows:
• New water mains and services
• New stormwater drainage system with new concrete valley gutters that includes
7 new outfalls and 7 restored outfalls
• Lining of sanitary sewer
• Reconstruction of the roadway
• Sidewalk replacement at certain locations and installation of new ramps that
meet the Americans with Disabilities Act (ADA) Standards
• Installing new pedestrian lighting
• Installing landscape
The entirety of the scope of work will be developed within Public Right of Way (ROW).
There are numerous private property encroachments, i.e. gates, landscaping, mailboxes,
fences, walkways, irrigation that may be impacted by the installation of new
infrastructure improvements.
However, the Office of Capital Improvement Project's construction management
approach is to minimally impact the resident by only requiring encroachments affecting
the work in the ROW to be removed. CIP has been meeting with residents one -on -one to
mitigate the construction's effect on existing encroachments.
CIP is not citing code compliance issues or requesting the removal of non - permitted
encroachments in the ROW; this is handled by the jurisdictional agency /department. Of
the 300 properties on the islands, the project team has worked closely with over 70
residents to mitigate encroachments and address any concerns.
The CIP Project Team has worked extensively on encroachment issues as follows:
1. CIP has inspected every residence to identify only those encroachments affected
by the proposed improvements.
2. CIP has notified each property owner of their specific encroachments via the
Public Works Department, the authority having jurisdiction (See Exhibit A).
3. Our CIP Public Information Specialist and Project Public Information Officer work
together to coordinate every aspect of the encroachment notification process as
follows:
a. Distribution of encroachment door hanger
b. First encroachment letters mailed out
c. Second encroachment letter mailed out as certified mail
d. Attended Homeowner's Association meeting held June 5 1h
e. Held Community Pre - Construction Kick Off Meeting on June 11 1h
f. Developed contact information log to ensure tracking of items and for
dissemination of project information and updates to residents
g. Email summaries are provided to avoid misunderstandings of discussions
at meetings with individual residents
In. CIP Team contact information has been made available to each resident to
facilitate voicing of concerns and requests for clarification
All Venetian Islands residents have received the first Notice of Encroachment letters.
Second Notice of Encroachment Letters were mailed to San Marino Island residents on
June 25, 2013, requesting compliance by July 26, 2013. DiLido Island second Notice of
Encroachment letters have been mailed in August, requesting compliance by August 23,
2013. Rivo Alto Island second Notice of Encroachment letters will be issued in
September 2013.
In relation to any impacted landscaping, the project team has worked closely with the
city's urban forester and the Public Works Department Surveyor to determine the extent
of the impact. Several properties have been reviewed and inspected by the urban
forester in order to make sure that existing trees, if left in place, will survive impact from
machinery /equipment /materials.
The Capital Project Team will continue to work closely with residents to address any
questions.

NOTICE OF INTENT TO REMOVE ENCROACHMENT(S) IN PUBLIC RIGHT OF WAY
Dear Venetian Island Neighborhood Resident/Owner:
The City of Miami Beach will soon begin construction on the Venetian Island Neighborhood
Improvement Project, which includes your neighborhood of San Marino Island. The project
entails the replacement of the existing water main; upgrading the existing stormwater
drainage system; installation of a concrete valley gutter; installation of decorative street
lighting and landscaping; repaving and restriping of the roadway.
In preparation for this work, the City performed an analysis of private property encroaching
into the public right of way that interferes with the proposed improvements (See Attachment
A). Items in front of your property have been identified as such encroachments (See
Attachment B).

Removal is necessary to complete the proposed improvements.
The City is providing you with the opportunity to remove or relocate the encroachments to
your property. If you do not remove or relocate the encroachments, the City will proceed with
the removal of the encroachments through its contractor at no cost to you.
