TO COMMUNITY DEVELOPMENT BLOCK GRANT MEMORANDUM OF UNDERSTANDING
(MOU),
DATED OCTOBER 17, 2012, BETWEEN THE CITY OF MIAMI BEACH OFFICE OF HOUSING
AND COMMUNITY DEVELOPMNT AND
THE CITY OF MIAMI BEACH ECONOMIC DEVELOPMENT DIVISION, FLORIDA
THIS AMENDMENT NO. 1 (the Amendment)TO COMMUNITY DEVELOPMENT BLOCK
GRANT MOU dated October 17, 2012, the MOU is entered into this 81"'` day of
®c.fo bR Y" 2013,by and between the CITY OF MIAMI BEACH OFFICE OF HOUSING AND
COMMUNITY DEVELOPMENT, and the CITY OF MIAMI BEACH ECONOMIC DEVELOPMENT
DIVISION, (the Provider).
WITNESSETH:
WHEREAS, the City is an entitlement recipient of U.S. Department of Housing and Urban
Development(HUD)funds as part of its Community Development Block Grant(CDBG)Program for
the period from October 1, 2011, to September 30, 2012; and
WHEREAS,on July 13, 2011,the Mayor and City Commission passed Resolution No.2011-
27694, adopting the City's One-Year Action Plan for Federal funds for Fiscal Year 2011/2012;
authorized the Mayor and City Clerk to sign the MOU in the amount of $120,000, for the North
Beach Fagade Improvement Program, (the Project), and further authorized the City Manager to
extend the expiration dates of the FY 2011/2012 CDBG agreements; and
WHEREAS, the Project has encountered implementation delays that prevented its
completion by September 30, 2013 as originally planned.
NOW,THEREFORE, in consideration of the mutual promises contained herein,the parties
hereby amend the Agreement as follows:
1. Section 10, on page 2 of the MOU, is deleted in its entirety and replaced with the following:
Term: This Agreement shall be deemed to have commenced retroactively on October 1,
2011, and terminate on December 31, 2014, (the Term), with the understandinq that at the
end of the Term, the City has the authority to re-appropriate any remaining unused Funds.
2. Attachment I — Statement of Work and Goals, is deleted in its entirety and replaced.
3. Attachment II — Budget, is deleted in its entirety and replaced.
4. The Owner of the of the Served Property is prohibited from selling his property of at least
180 days from program completion.
5. Tenants must be aware of the program.
6. All other terms and conditions of the Agreement shall remain unchanged and in full force
and effect.
IN WITNESS WHEREOF, the parties hereto execute this Amendment No. 1 as of the day
