Attached for your information are two. (2) resolutions passed by the Town of Bay
Harbor on October 14, 2013:
Resolution 1178:
A Resolution Affirming Support For The Installation Of Fiber Optic Cable
For Public Use In The Florida East Coast Rail Corridor; Urging All
Municipalities Of Miami -Dade County To Support The Installation Of
Fiber Optic Cable For Public Use In The Florida East Coast Rail
Corridor.
And
Resolution 1179:
A Resolution Directing The Creation Of An Anti - Bullying Policy That
Establishes An Awareness Campaign And Reporting System For
Bullying, Harassment, And Intimidation Of Children In Town Facilities;
Directing The Town Manager To Create A Program Of Education And
Reporting Of Bullying; And Requesting Surrounding Communities Join
In Such Efforts And To Establish A Collaborative Initiative Through An
Interlocal Board To Develop And Implement An Awareness Campaign
And Anti - Bullying Policy.
The Town of Bay Harbor encourages the adoption of similar resolution by their
surrounding municipalities.

RESOLUTION NO. 1178
A RESOLUTION OF THE TOWN COUNCIL OF
THE TOWN OF BAY HARBOR ISLANDS,
FLORIDA AFFIRMING SUPPORT FOR THE
INSTALLATION OF FIBER OPTIC CABLE FOR
PUBLIC USE IN THE FLORIDA EAST COAST
RAIL CORRIDOR; URGING ALL
MUNICIPALITIES OF MIAMI-DADE COUNTY TO
SUPPORT THE INSTALLATION OF FIBER OPTIC
CABLE FOR PUBLIC USE IN THE FLORIDA
EAST COAST RAIL CORRIDOR; PROVIDING
FOR APPROVAL AND AUTHORIZATION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Bay Harbor Islands is responsible for the
public health, safety, and welfare of the citizens of the Town of Bay Harbor Islands and those
co ming to the Town; and
WHEREAS, the Town Council of the Town of Bay Harbor Islands is charged with
preserving and maintainin the high quality and standards, and aesthetic beauty contained within
the Town; and
WHEREAS, the Treasure Coast Regional Planning Council representing the local
governments of Indian River, Martin, Pabii Beach, and St. Lucie counties unanimously passed
on July 19, 2013 Resolution No. 13 -01 to support the installation of fiber optic cable for public
use in the Florida East Coast rail corridor; and

WHEREAS, fiber optic technology provides a high speed broadband communication
system that is a catalyst to enhance job creation, economic development, healthcare, and
education; and
WHEREAS, Southeast Florida does not have fiber optic infrastructure available for
public use throughout the region; and
WHEREAS, the All Aboard Florida project is a proposal by Florida East Coast
Industries to introduce express passenger rail service between Miami and Orlando follows the
Florida East Coast rail corridor, and
WHEREAS, the Florida East Coast rail corridor is an ideal location for the co- location
of fiber optic infrastructure because it links most of the urban areas in Southeast Florida; and
WHEREAS, the Town of Bay Harbor Islands urges other Municipalities of Miami -Dade
County to support the installation of fiber optic cable for public use in the Florida East Coast rail
corridor.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF BAY HARBOR ISLANDS, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the above stated recitals are hereby adopted,
confirmed, and incorporated herein.
Section 2. Approval and Authorization. The Town Council approves and authorizes
the Town Manager and/or his designee to take all actions necessary to implement this
Resolution.

Section 3. Direction to the Town Clerk. The Town Clerk is hereby directed to transmit a
copy of this Resolution to the Miami -Dade County Municipal Clerks and the Treasure Coast
Regional Planning Council.
Section 4. Effective Date. This Resolution shall become effective immediately upon its
adoption.

RESOLUTION NO. 1174
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF BAY
HARBOR ISLANDS, FLORIDA, DIRECTING THE CREATION OF AN
ANTI- BULLYING POLICY THAT ESTABLISHES AN AWARENESS
CAMPAIGN AND REPORTING SYSTEM FOR BULLYING,
HARASSMENT, AND INTEKIDATION OF CHILDREN IN TOWN
FACILITIES; DIRECTING THE TOWN MANAGER TO CREATE A
PROGRAM OF EDUCATION AND REPORTING OF BULLYING; AND
REQUESTING SURROUNDING COMMUNITIES JOIN IN SUCH
EFFORTS AND TO ESTABLISH A COLLABORATIVE INITIATIVE
THROUGH AN INTERLOCAL BOARD TO DEVELOP AND
IMPLEMENT AN AWARENESS CAMPAIGN AND ANTI- BULLYING
POLICY; PROVIDING FOR AUTHORIZATION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Bay Harbor Islands (the "Town ") is concerned about the health, safety, and
welfare of its citizens and desires to provide a healthy, positive, and safe atmosphere for its
children; and
WHEREAS, it appears that incidents of bullying are increasing to such a degree, and
research suggests that such incidents directly affect a student's health and well -being and thus
contribute to excess absences from school, physical sickness, mental and emotional anguish, and
long -term social and mental consequences, such that in 2011, the Florida legislature adopted
Section 1006.147 Florida Statutes defining and prohibiting bullying and harassment in the public
schools; and
WHEREAS, bullying, harassment, and intimidation can take many physical, verbal, and
written forms, including physical bullying; teasing or name - calling; social exclusion; peer sexual
harassment; bullying about race, ethnicity, religion, disability, sexual orientation, gender
identity,, and cyber bullying (bullying through email, text messaging, social media sites, and or
other electronic means); and

WHEREAS, in addition to the public schools, many municipalities across the region are
already engaged in anti- bullying education and prevention efforts; and
I
WHEREAS, the Town Council believes it is in the best interest of the Town to be
proactive in these matters and to assure that every child is to be valued and respected regardless
of perceived differences, and therefore wishes to condemn all forms of bullying and affirms the
j Town's commitment to equality and freedom from discrimination and violence for all of its
residents, and particularly its children.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF BAY HARBOR ISLANDS, FLORIDA, AS FOLLOWS:
Section 1. Recitals That the above stated recitals are true and correct and are
incorporated herein by reference.
Section 2. Adoption of Anti-Bull _m* Policy and Recommendations. That the Town
Council wishes to take a leadership role in adopting an Anti- Bullying Policy that establishes an
awareness campaign and reporting system for bullying, harassment, and intimidation and hereby
directs the Town Manager to take time following actions:
a) To develop a policy that includes an awareness campaign which shall consist of an
education program (including promotion and modeling of respectful language,
fostering an understanding of and respect for diversity, and an annual training
program for staff, signage referencing the Anti- Bullying Policy posted at all Parks
and Recreation Department facilities, and a reporting system for these incidents of
bullying or retaliation, in all Town facilities; and

b) To coordinate and encourage the surrounding communities of Bal Harbour Village
and Surfside, whose children utilize Town facilities (as well as other neighboring
municipalities and schools) to join with the Town in effectuating such an effort; and
c) Send a certified copy of this resolution to the municipal clerks of the surrounding
communities of Bal Harbour Village, Miami Beach, North Bay Village, Surfside,
Sunny Isles Beach, Aventura, North Miami Beach and North Miami as well as the
Principals of Ruth K Broad K -8 Center and the surrounding public and private
schools encouraging similar efforts.
Section 3. Implementation. That the Town Manager is hereby authorized to take any
and all action necessary to implement this Resolution.
Section 4. Effective Date. This Resolution becomes effective upon adoption.
