A RESOLUTION APPROVING COIMITIONAL USE
OF ?�T�u 'PROPEIRTY LOS y ED AT 1030-40-
FIFTEENTH STREET FOR PARKING LOT AND
AUTHORIZING ABANDONMENT OF EXISTING
ALLEYWAY AND RELOCATION OF SAME.
WHEREAS, the Planning Board of the City of Miami
Beach has recon-nended the conditional use of an employee
parking lot for Southern Bell Telephone & Telegraph Company
at the prooer'ty Located at 1030-40 Fif�:eenth Street, Miami

Lots 1, 2, 3 and 4 of Block 69,
LINCOLN SUBDIVISION, Plat .Book 9,
Page 69, of the Public Records of
Dade County, Florida,
and
Lots 1 and 24, Block 93, OCEAN
BEACH ADDITION NO. 3 SUBDIVISION,
Plat Book 2, Page 81, of the
Public Records of Dade County,
Florida,
with the following conditions :
1. Southern Bell Telephone & Telegraph Company . .
provide the minimum amount of illumination as required by
y Dade County' s lighting ordinance.
2 . A satisfactory arrangement will be agreed upon
between the City of Miami Beach and Southern Bell. Telephone
& Telegraph Company to provide an exit from the alley prop?-r
or turn-around facilities, and:
WHEREAS, Southern Bell Telephone & Telegraph Company
agreed that in addition to the above conditions, the land-
scaping would exceed minimum landscaping requirements, and
WHEREAS, the owners of the real property described
above and further described as Lots 2, 3. and 4, Block 93,
Ocean Beach Addition No. 3 Subdivision, Plat Book 2, Page 31
of the Public Records of Dade County, Florida, have requested
that the 20 ft. wide public alley which abutts the° southerly
line of Lots 3 and 4 of Block 69, Lincoln Subdivision and
also abutts the west lot line of Lot 1 and the east lot line
of Lot 24 of Block 93 of Ocean Beach Addition No. 3 Sub=-
division be abandoned. In exchange for the described alley,
the aforesaid owners will dedicate a 20 ft. wide alley along-
the ,north 20 ft. "Lot 2, Block 93; Ocean Beach Addition No. 3
Subd i vi lion together t,1 nth a strip of lard on -the westerly
end of Lot 2 to allow for a turning radius and described as
follows :
Beginning at the northeast corner of Lot 2, .
Block 93, Ocean Beach Addition No. 3 Sub-
div.isior_ thence run in a westerly direction
along the no--r-t_h lot line of Lot 2 C-A' distance
of 150 ft. . to a point, thence run sou-t
erly along the westerly lot lima of Lot 2 a

distance of 40 ft. to a point thence run in a
northeasterly direction along the arc of a
circular curve deflecting to the right, said
circular curve having for its elements a central
angle of 90° , a radius of 20 ft. , an arc length
of 31.4 ft. and a point of tangency with a line
parallel to the north lot line of Lot 2 and 20
ft. south of said north lot line at Lot 2, thence
run easterly along said parallel line a distance
of 130 ft. , .thence run northerly along the
easterly lot line of Lot 2 a distance of 20 ft.
to the point of beginning;
and,
WHEREAS, the vacation and abandonment of the afore-
said existing alley and simultaneous acceptance of the
dedication of the aforedescribed alley by the aforesaid
property owners is determined to be in the best interest of
she City and its citizens.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the re
commendation of the Planning Board of the City of Miami Beach
be and it is hereby approved with the condition in addition
to those included in the recommendation of the Planning Board .
that the properly constructed parking lot shall be used for
parking of passenger automobiles of Southern Bell Telephone &
Telegraph Company and its employees only and with the further
condition that the parking of commercial trucks in the approved
Darking lot shall be and is hereby prohibited.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the dedication of the afore-
described alley by the aforesaid property owners be and. it is
accepted by the City of Miami B each, Florida;
BE IT FURTHE R. RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the City surrenders all of its
right, title and interest to the north 71.8 ft. of the 20 ft.
wide public alley which abutts the southerly line of Lots 3
and 4 of Block 69, Lincoln Subdivision, and also abutts -the
west lot line of Lot 1 and- the east lot line of .Lot 24 of Blo^k -
93 of Ocean Beach Addition No. 3 Subdivision, shall be abandoned
by the City of Miami Beach. upon the receipt by the Clerk of the
City of Miami Beach of a proper deed from the owners of Lots 1,
2, 3 and 4 of Block 69, Lincoln Subdivision, Plat. Book 9, page
69 of the Public Records of Dade County, Florida, and Lots 1, 2, 3,
4 and 24, Block 93, Ocean Beach Addition No. 3 Subdivision,
Plat Book 2, page 81, of the Public .Records of Dade County,
Florida, which deed shall dedicate to the public use and the
City of Miami Beach the 20 ft. wide alley along- the -north 20 .ft.
of Lot 2 together with a strip of land on the westerly end of
I,ot 2 to allow for a turning radius, as more fully described
above.
PASSED and ADOPTED this 12th day of December, 1973.
