A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA
LEGISLATURE AND THE BOARD OF COUNTY COMMISSIONERS
FOR MIAMI-DADE COUNTY TO INCREASE THEIR PARKING
VIOLATION FINES TO A MINIMUM OF $50.00 TO REFLECT
PENALTIES THAT ARE FISCALLY APPROPRIATE AND REFLECTIVE
OF THE GRAVITY OF ILLEGAL PARKING OFFENSES, AND ALSO
URGING THE MIAMI-DADE COUNTY LEAGUE =®F CITIES, AS WELL
AS MUNICIPALITIES AND AGENCIES IN MIAMI-DADE COUNTY, TO
SUPPORT AN INCREASE IN STATE AND COUNTY FINES FOR
PARKING VIOLATIONS.
WHEREAS, the parking fines utilized by the State of Florida and Miami-Dade County are
not commensurate with the gravity of illegal parking offenses nor the costs of enforcement; and
WHEREAS, the penalty for illegal parking offenses that are deemed nonmoving traffic
violations by the State of Florida is $30.00, as provided in Section 318.18 of the Florida
Statutes, which is not an adequate penalty given the seriousness of violations such as parking
on sidewalks, bicycle paths, and within intersections; and
WHEREAS, Section 30-388.32 of the Miami-Dade County Code sets forth a schedule
for various parking offenses, such as hazardous parking and obstructing traffic on streets, as
well as other parking violations that create unsafe and hazardous conditions or otherwise
impede the orderly flow of traffic and the provision of adequate parking; and
WHEREAS, the Miami-Dade County Code currently provides penalties ranging from
$18.00 to $33.00 for parking violations which do not adequately reflect the gravity of these
offenses and are not in keeping with the increasing costs of enforcement; and
WHEREAS, the minimum fine for State and County parking offenses should be $50.00
to more adequately reflect the gravity and costs associated with these violations; and
WHEREAS, the matter of inadequate parking fines is of concern to all citizens in Miami-
Dade County, therefore, the Miami-Dade County League of Cities, and municipalities and
agencies in Miami-Dade County, are also urged to support an increase in State and County
fines for parking violations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Legislature and the Board of County Commissioners for
Miami-Dade County to increase their parking fines to a minimum of $50.00 to reflect penalties
that are fiscally appropriate and reflective of the gravity of illegal parking offenses, and also
urging the Miami-Dade County League of Cities, as well as municipalities and agencies in
Miami-Dade County, to support an increase in State and County fines for parking violations.
