A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION TO THE US DEPARTMENT OF JUSTICE FOR THE FISCAL YEAR 2014 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM, FOR FUNDING IN THE AMOUNT OF $68,128 FOR THE CITY'S POLICE DEPARTMENT PRIORITIES; APPROPRIATING THE ABOVE GRANT, FUNDING REQUEST, MATCHING FUNDS, AND CITY EXPENSES, IF APPROVED AND ACCEPTED BY THE CITY AND AUTHORIZING THE EXECUTION OF ALL NECESSARY DOCUMENTS RELATED TO THE AFORESTATED APPLICATION, INCLUDING, WITHOUT LIMITATION, AUDITS, AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO TAKE ALL NECESSARY ACTIONS RELATED TO THIS GRANT AND FUNDING REQUEST. WHEREAS, the Edward Byrne Memorial Justice Assistance Grant (JAG) Program (42 U.S.C. 3751(a)) is the primary provider of federal criminal justice funding to state and local jurisdictions and provides critical funding necessary to support a range of program areas including law enforcement, prosecution and court programs including indigent defense, prevention and education programs, corrections and community corrections, drug treatment and enforcement, crime victim and witness initiatives, and planning, evaluation, and technology improvement programs; and WHEREAS, JAG funds may be used for state and local initiatives, technical assistance, strategic planning, research and evaluation (including forensics), data collection, training, personnel, equipment, forensic laboratories, supplies, contractual support, and criminal justice information systems that will improve or enhance such areas as: law enforcement programs, prosecution and court programs including indigent defense, prevention and education programs, corrections and community corrections programs, drug treatment and enforcement programs, planning, evaluation, and technology improvement programs, and crime victim and witness programs (other than compensation); and WHEREAS, the Department of - Justice requires that prior to application submission the applicant agency must make information on the JAG grant available to the governing body, in addition, information regarding the Fiscal Year 2014 JAG application is made available to the public on the City's website at: www.miamibeachfl.gov; and WHEREAS, the budget for this project will be $68,128 and it is anticipated that the funding may be used for the city's eligible technology needs; and WHEREAS, supplanting is prohibited under JAG, applicants cannot replace or supplant non-federal funds that have been appropriated for the same purpose however, a unit of local government may use up to 10 percent of the award, including interest, for costs associated with administering JAG funds; and WHEREAS, the Administration requests approval to submit a grant application to the US Department of Justice, Edward Byrne Memorial Justice Assistance Grant (JAG) for FY 2014 funding in the approximate amount of $68,128 for local criminal justice programs that meet the Department of Justice's criteria; and WHEREAS, this grant does not require matching funds. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH that the Mayor and City Commission hereby approve and authorize the City Manager or his designee to submit a grant application to the US Department of Justice for the Fiscal Year 2014 Edward Byrne Memorial Justice Assistance Grant (JAG) Program for funding in the approximate amount of $68,128 for the City's Police Department priorities; appropriating the above grant, funding request, matching funds, and city expenses, if approved and accepted by the City, and authorizing the execution of all necessary documents related to the aforestated application, including, without limitation, audits, and authorizing the City Manager or his designee to take all necessary actions related to this grant and funding request. The JAG Program provides states and units of local governments with critical funding necessary to support a range of program areas including law enforcement, prosecution and court programs including indigent defense, prevention and education programs, corrections and community corrections, drug treatment and enforcement,crime victim and witness initiatives, and planning, evaluation, and technology improvement programs.
