A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING THE RETROACTIVE ASSIGNMENT,
EFFECTVIE APRIL 1, 20069 OF CONTRACT BY AND BETWEEN THE CITY AND
BEST MAINTENANCE, FOR CITYWIDE JANITORIAL SERVICES, TO OMARCIO
CLEANING.
WHEREAS, during the leadership transition in the Property Management Division of
Public Works Department a procedural error in the contract reassignment was discovered;
and
WHEREAS, in March 2006, Best's Maintenance relinquished its portion of the
janitorial services contract to its subcontractor, Omarcio Cleaning; and
WHEREAS, letters between the two companies were provided to the City; and
WHEREAS, the reassignment of work was accepted by the City, and Omarcio
Cleaning assumed responsibility for the buildings previously assigned to Best's
Maintenance; and
WHEREAS, Best's Maintenance, by letter dated March 31, 2006, requested that its
Citywide janitorial services contract be assigned to Omarcio Cleaning Services; and
WHEREAS, Omarcio Cleaning, by letter dated March 31, 2006, agreed to receive the
assignment of Best's Maintenance's contract; and
WHEREAS, Omarcio Cleaning agreed to all legal terms and conditions,
responsibilities, and cost outlined in the contract with Best's Maintenance; and
WHEREAS, in order to correct the procedural error, the retroactive assignment is
being brought to the City Commission for action; and
WHEREAS, A review of Omarcio's performance and the cost involved has revealed
that the City is receiving quality service at the same cost of the original contract for Citywide
Janitorial Services approved by the Mayor and City Commission and awarded to several
contractors on May 5, 2004.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approving retro-active assignment of contract by and between the City
and Best Maintenance, for citywide Janitorial Services, to Omarcio Cleaning; and further
authorizing the Mayor And City Clerk To Execute a consent to assignment effective as of
April 1, 2006.

Item Summary/Recommendation:

has taken measures to preclude this type of situation from occurring in the future.

CONCLUSION
Based on aforementioned, the Administration recommends that the Mayor and City
Commission approve the assignment of Best Maintenance's contract for Citywide
Janitorial Services to Omarcio Cleaning Services with an effective date of April 1, 2006.

confirming that Best Maintenance&Janitorial Scrviccs Inc. is proposing to fnlalize the
services it is providing to certain city of Miami Beach facilities effective March 31, 2006,
and proposes that this work be awarded to OMARCIO Best Maintenance Corp.: nur
current sub-contractor for most of these facilities. The following are the facilities and
properties which would be affected by the proposed changes and for which OMARCIO
is willing to begin providing services immediately:
