A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF
THE CITY OF MIAMI REACH, FLORIDA, SUPPORTING HEALTHY
FOOD AND BEVERAGE OPTIONS IN VENDING MACHINES IN ALL
CITY-OWNED FACILITIES, AND DIRECTING THE CITY
ADMINISTRATION TO DEVELOP A HEALTHY OPTIONS VENDING
MACHINE POLICY AND, IN THE INTERIM, ENCOURAGING
CURRENT VENDORS PROVIDING VENDING MACHINE SERVICES
TO CITY-OWNED FACILITIES TO SUPPLY HEALTHIER FOOD AND
BEVERAGE OPTIONS.
WHEREAS, the City of Miami Beach is dedicated to creating an environment that
educates and empowers our community to make healthy life choices; and
WHEREAS, in the interest of public health and welfare, the Mayor and City Commission
of the City of Miami Beach wish to improve the nutritional value of food and beverages available
in City-owned facilities in order to promote the public interest in reducing obesity, diabetes, heart
disease, and other diet-related health problems; and
WHEREAS, the Mayor and City Commission desire to provide access to healthy food
options for all City employees and visitors to City-owned facilities, which include such venues as
City Hall, City office buildings and parking garages, and City park and recreational facilities; and
WHEREAS, the Federal Departments of Health and Human Services ("HHS") and the
General Services Administration ("GSA") have adopted guidelines for vending machines
managed by HHS and GSA which guidelines provide that at least 25% of packaged items must
be no more than 200 calories, contain no more than 10% of the item's calories from saturated
fat, and the total weight shall not exceed 35% sugars, subject to certain limited exceptions for
nuts, seeds, fruits, and vegetables; and
WHEREAS, at least 70 states and local governments, including Alabama, California,
Washington State, Chicago, Los Angeles, New York City, San Francisco, the District of
Columbia, Palm Beach County, Miami-Dade County, and the School Board of Miami-Dade
County, have established nutrition policies or standards for foods and beverages available on
government properties, and some have also adopted strategies for the high-visibility placement
of healthier items in vending machines and pricing that encourages the sale of healthier items;
and
WHEREAS, the School Board of Miami-Dade County, Florida ("School Board") has
adopted a "Wellness Policy" which includes initiatives to support a healthier environment for
school students and staff in order to promote, among other things, wellness, health and nutrition
literacy, and preventive healthcare; and
WHEREAS, the City of Miami Beach currently utilizes the Miami-Dade County School
Board's guidelines with regard to permissible foods in its vending machine contracts and these
guidelines specify that food products in vending machines contain no more than 35% of total
calories from fat, no more than 10% of total calories from saturated fat, no more than 35%
added sugar by weight, and that there be no added trans fats; and
WHEREAS, the Miami Beach Mayor and City Commission wish to formerly adopt
guidelines for healthy food and beverage items to be included in all of its contracts with City
vendors who provide food and beverages for vending machines in City-owned facilities; and
WHEREAS, in order to implement healthier options for vending machines on City-owned
properties, the Mayor and City Commission direct the City Administration to develop a healthy
options vending machine policy which, at a minimum, will include the nutritional standards
adopted by HHS, GSA, the School Board, and Miami-Dade County so that such policy may be
included in all future City contracts that concern vending machines in City-owned facilities; and
WHEREAS, in the interim, the Mayor and City Commission encourage all current City
vendors that provide vending machine services in City-owned facilities to supply products that
support the City's initiative for healthier food and beverage options and to implement high
visibility placement of healthier items within the parameters of their current contracts with the
city.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
support healthy food and beverage options in vending machines in all City-owned facilities and
hereby direct the City Administration to develop a healthy options vending machine policy and,
in the interim, encourage all current vendors providing vending machine services to City-owned
facilities to supply healthier food and beverage options.
