A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA,APPROVING AND ACCEPTING AN EASEMENT FROM
TALMUDIC COLLEGE 4000 ALTON ROAD, INC. AND M-4000 ALTON OWNER,
LLC, SAID EASEMENT TO BE LOCATED IN THE NORTHWEST CORNER OF
THE PROPERTIES,WESTERLY AND ADJACENT TO THE CITY'S WATER PUMP
STATION NO. 419 FOR THE MAINTENANCE, REPAIR, REPLACEMENT,
RELOCATION, AND REMOVAL OF THE CITY'S WATER MAIN.
WHEREAS,Talmudic College 4000 Alton Road, Inc. ("Talmudic") is the owner of the parcel
located at 4000 Alton Road, Miami Beach, Florida, 33140; and
WHEREAS, M-4000 Alton Owner, LLC ("M-4000") is the owner of a parcel of land adjacent
to the southern portion of Talmudic's property; and
WHEREAS,the City owns and maintains a subterranean water main in the northwest corner
of the aforementioned parcels, westerly and adjacent to the City's Water Pump Station No. 41,
located at 1050 41St Street, Miami Beach, Florida, 33140; and
WHEREAS, in order for the City to continue to have access to its water main for
maintenance, repair, replacement, relocation and removal, the Public Works Department has
identified an appropriate easement area.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,that the Mayor and City Commission
hereby approve and accept an easement from Talmudic College 4000 Alton Road, Inc.and M-4000
Alton Owner, LLC, said easement to be located in the northwest corner of the properties, westerly
and adjacent to the City's Water Pump Station No. 41, for the maintenance, repair, replacement,
relocation and removal of the City's water main.

Item Summa /Recommendation:
The Talmudic University ("Developer") is the owner of the parcel located at 4000 Alton Road. The City
owns and maintains a subterranean water main in the northwest corner of the parcel,westerly and adjacent
to the City's Water Pump Station No. 41, located at 1050 41St Street.
In addition to the parcel located at 4000 Alton Road,the Developer has also acquired the parcel adjacent to
the southern portion of their property, previously owned by the Florida Department of Transportation
(FDOT).
In order for the City to continue to have access to its water main for maintenance, repair, replacement,
relocation and removal, the Public Works Department and the Developer have identified an appropriate
easement area for the City to access. In addition, the Developer has agreed to the following terms, as
proposed by the City:
• Within sixty (60) days of the approval of this Easement, the Developer, at its sole cost and
expense, shall install and maintain a chain link fence on the western and southern boundary lines
of the easement area, to demark the easement area as off-limits to anyone other than City
employees and contractors,
• Damaged or broken sections, unless caused by the City,shall be repaired by the Developer within
a reasonable timeframe, but not later than five(5)business days after written notice from the City.
• Damaged or broken sections caused by the City,shall be repaired by the City within a reasonable
timeframe, but not later than five (5) business days after written notice from the Developer.
The terms also allow for the City to have full rights to access the easement area.

BACKGROUND
The Talmudic University ("Developer") is the owner of the parcel located at 4000 Alton Road.
The City owns and maintains a subterranean water main in the northwest corner of the parcel,
westerly and adjacent to the City's Water Pump Station No. 41, located at 1050 41 st Street.
In addition to the parcel located at 4000 Alton Road, the Developer has also acquired the parcel
adjacent to the southern portion of their property, previously owned by the Florida Department
