PIRST AMENDED AND RESTATED ACQUISITION AGREEMENT
BETWEEN THE CITY OF MIAMI BEACH AND THE SCHOOL
BOARD OF DADE COUNTY, FLORIDA, FOR THE EXPANSION
AND REOPENING OF THE SOUTH POINTE ELEMENTARY
SCHOOL
Background:
The City of Miami Beach and the School Board of Dade County, Florida, entered into an
Acquisition Agreement on February 2, 1987, pursuant to City Commission Resolution
No. g6-18712, which was passed on December 17, 1986. The Acquisition Agreement
provided for the expansion and reopening of the South Pointe Elementary School. Pursuant
to this agreement, the City was obligated to front all costs for the acquisition of the lands
to the east of the existing school and a strip of land to the south of the school site. Due to
the passage of the recent school bond issue, the City expressed the desire that the School
Board absorb the cost of the school site expansion. The ownership of the land would then be
vested with the School Beard.
Current Status:
The School Beard, at its meeting of 3uly 27, 1988, approved the proposed amendment to the
South Pointe Land Acquisition Agreement with the City of Miami Beach. The relative terms
and conditions of this amendment are as follows:
1. The City is to continue the administration and the responsibility for
completion of the land acquisition.
2. Subject property, prior to transfer to the School Board, is to be cleared and
all structures demolished.
3. The City shall close 3rd Street and the alleyway, thereby making these areas
part of the school site.
The School Board's buyback ol the land shall not exceed $2,000,000. Any expenditure over
this amount shall be absorbed by the City of Miami Beach. Additionally, any costs related
to City staff time and related Administrative and City Attorney charges shall be excluded
from the School Board cost responsibility.
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the Mayor be authorized to execute the first amended
and restated Acquisition Agreement between the City of Miami Beach and the School Beard
of Dade County, Florida, for the expansion and reopening of the 5outh Pointe Elementary
School.
