THE CITY OF MIAMI BEACH, FLORIDA
AND
WOLFBERG/ALVAREZ AND PARTNERS, INC.

FOR THE PROVISION OF ADDITIONAL PROFESSIONAL ARCHITECTURAL AND
ENGINEERING SERVICES FORTHE PROPERTY MANAGEMENT FACILITY PROJECT
IN THE AMOUNT OF$22,560
This Amendment No. 5 to the Agreement made and entered this3 day of :v1r4
2015, by and between the CITY OF MIAMI BEACH, a municipal corporation existing under
the laws of the State of Florida (hereinafter referred to as City), having its principal offices at
1700 Convention Center Drive, Miami Beach, Florida 33139, and WOLFBERG/ALVAREZ
AND PARTNERS, INC., a Florida corporation, having its offices at 3225 Aviation Avenue,
Suite 400, Miami, FL 33133 (hereinafter referred to as Consultant).
RECITALS
WHEREAS, pursuant to Request for Qualifications (RFQ) No. 10-09/10, the Mayor
and City Commission adopted Resolution No. 2010-27383 on May 12, 2010, approving and
authorizing the Mayor and City Clerk to execute an Agreement with Wolfberg/Alvarez and
Partners, Inc., for the Planning, Design, Bid, Award, and Construction Administration Services
for the Property Management Facility Project (the Agreement); and
WHEREAS, the Agreement provides for the detailed planning, design, permitting,
bidding /award and construction administration services for the Project; and
WHEREAS, the Agreement was executed for a not-to-exceed amount of $315,216.28;
and
WHEREAS, Amendment No. 1 for the provision of additional architectural and
engineering services associated with revisions to the approved Basis of Design Report for the
Property Management Facility was executed on August, 17, 2011, in the amount of $6,036.72;
and
WHEREAS, Amendment No. 2 for the provision of additional architectural and
engineering services related to revisions to the construction documents to mitigate construction
cost increases associated with the extended project schedule for the Property Management
Facility was executed on August 19, 2013 in the amount of$9,285; and
WHEREAS, Amendment No. 3 for the provision of additional architectural and
engineering services related to revisions to the permit drawings associated with changes in
elevations for the Property Management Facility was executed on November 2, 2014, in the
amount of$11,614; and
WHEREAS, Amendment No. 4 for the provision of additional architectural and
engineering services related to revisions to the permit drawings associated with the request
from Public Works Department to delete the drainage well and connect to the City's drainage

system for the Property Management Facility was executed on April 28, 2015 in the amount of
$2,720; and
WHEREAS, Amendment No. 5 for the provision of additional architectural and
engineering services includes revisions to the permit drawings associated with the incorporation
of new offices and associated mechanical and electrical modifications as requested by the
Parking Department and the Property Management Division, in the amount of$22,560; and
WHEREAS, the Capital Improvement Projects Office has evaluated the Consultant's
cost proposal and finds that it is fair and reasonable; and
WHEREAS, this Amendment No. 5 to the Agreement will revise the total contract sum to
a not-to-exceed total of$367,432.
NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises,
covenants, agreements, terms, and conditions herein contained, and other good and valuable
consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this
Amendment No. 5.
2. MODIFICATIONS
a. The Consultant's name is amended to reflect Wolfberg/Alvarez and Partners, Inc.
b. The Agreement is amended as defined in Schedule "A-5", attached herein.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by this
Amendment No. 5.

be executed in their names by their duly authorized officials as of the date first set forth

SCOPE OF SERVICES:
Schedule "A" entitled, "Scope of Services", is amended as follows:
Add the following under Task 5—ADDITIONAL SERVICES
Task 5.5-Additional Design Services:
For the provision of additional architectural and engineering services related to permit drawing
revisions associated with the incorporation of new offices and associated mechanical and
electrical modifications for the Parking Department and Property Management Division:
1. Incorporate new offices, storage rooms, etc. in Rooms 113 and 115, including associated
mechanical and electrical modifications. These rooms will not have ceilings.
2. Incorporate new offices, conference room, reception, etc. on second floor, including
associated mechanical and electrical modifications.
Permitting assistance at the City of Miami Beach and DERM is included, and includes
submitting documents for permit, responding to comments made by reviewers, and meeting with
reviewers as required. Assistance also included for reviewing and negotiating change orders.
It will take approximately three (3) weeks to complete revisions.
PAYMENT AND COMPENSATION
The total fee proposed for this Scope of Work is a not-to-exceed amount of $22,560 (refer to
Exhibit A-5 attached herein).
• Original Agreement amount $315,216.28
• Amendment No. 1: For the provision of additional architectural and engineering
services associated with revisions to the Basis of Design Report approved by the
Design Review Board on June 7, 2011 in the amount of$6,036.72.
• Amendment No. 2: For the provision of additional architectural and engineering
services related to revisions to the construction documents to mitigate construction
cost increases associated with the extended project schedule in the amount of
$9,285.
• Amendment No. 3: For the provision of additional architectural and engineering
services related to revisions to the permit drawings associated with changes to
sidewalk elevation in the amount of$11,614.
• Amendment No. 4: For the provision of additional architectural and engineering
services related to the revisions to the permit drawings associated with deletion of the
drainage well in the amount of$2,720.
• Amendment No. 5: For the provision of additional architectural and engineering
services related to the revisions to the permit drawings associated with the
incorporation of new offices and associated mechanical and electrical modification for
the Parking Department and Property Management Division in the amount of$22,560.
• Revised Agreement amount $367,432.

Subj: Interior Modifications for Parking Dept.
Dear Ms. Sotelo:
Pursuant to our meeting on March 10, 2010 with representatives from the City of Miami Beach Parking Dept.
and Property Management, following is our Proposal for Professional Design Services to incorporate the
following revisions requested,and indicated in the attached sketches:
1. Incorporate new offices, storage rooms, etc. in Rooms 113 and 115, including associated mechanical and
electrical modifications. These rooms will not have ceilings.
2. Incorporate new offices, conference room, reception, etc. on second floor, including associated mechanical
and electrical modifications.
Permitting assistance at the City of Miami Beach and DERM is included,and includes submitting documents for
permit, responding to comments made by the reviewers, and meeting with reviewers as required. Assistance is
also included for reviewing and negotiating change order.
Our fee to perform these changes is a stipulated sum of$22,560.00. See attached Schedule B.
It will take approximately three(3)weeks to complete the revisions.
