AMENDMENT NO. 1 TO THE CONTRACT
BETWEEN THE CITY OF MIAMI BEACH, FLORIDA
AND
BARRY UNIVERSITY, INC,
DATED AUGUST 1, 2014
FOR YOUTH SERVICES RELATED TO THE CITY'S EARLY CHILDHOOD
DEVELOPMENT INITIATIVE ("CONTRACT")
RECITALS
This Amendment No. 1 (Amendment) to the Contract is made and entered into
this 1ST day of May, 2015 (Effective Date), by and between the City of Miami Beach,
Florida (City), and BARRY UNIVERSITY, INC, a Florida Non Profit Corporation, whose
,address is 11300 NE 2nd Avenue, Miami Shores, Florida 33161 (Contractor), and
hereby amends the Contract as follows:
WHEREAS, the City is a recipient of The Children's Trust (TCT) funds as part of
its Early Childhood Development Initiative for the period from August 1, 2014, to July 31,
2015; and
WHEREAS, on May 21, 2014, the Mayor and City Commission passed
Resolution No. 2014-28586, authorizing the City to accept a Contract Renewal from The
Children's Trust for the Early Childhood Development program for funding in the
approximate amount of$150,000 for the City's Parent-Child Home Program; and
WHEREAS, on August 27, 2014, the City and Contractor executed the Contract
(Contract) with respect to The Children's Trust Early Childhood Development Grant,
which services include home-visiting for youth and their families, as set forth in Exhibit A
of the Contract; and
NOW THEREFORE, in consideration of the mutual promises and conditions
contained herein, and other good and valuable consideration, the sufficiency of which is
hereby acknowledged, the City and Contractor hereby agree as follows:
1. The above recitals are true and correct and are incorporated as part of this
Amendment No. 1.
2. Section 3, on page 2 of the Contract, is deleted in its entirety and replaced with
the following:
3.1 FIXED FEE
Contractor shall be compensated for the Services, as set forth in
Section 2 and Exhibit "A", as follows: (a) Provision of home visits for up to
thirty-two (32) families with program-required supervision and training, at
Thirty Dollars and Fifty Cents ($31.50) per home visit, for a maximum not
to exceed Twenty Four Thousand Four Hundred and Seventy Five
Dollars and Fifty Cents ($24,475.50).
Contractor's compensation shall be further subject to and conditioned
upon all or any portion of the Services to be provided herein being
allowable and within the Scope of Services delineated in Exhibit"A".
Notwithstanding the preceding, Contractor's total compensation
during the term of this Agreement shall not exceed the maximum
allowable sum of Twenty Four Thousand Four Hundred and Seventy Five
Dollars and Fifty Cents ($24,475.50).
3. Except as amended herein, all other terms and conditions of the Contract shall
remain unchanged and in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to be
executed by their appropriate officials, as of the date first entered above.
