A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH,FLORIDA,REQUESTING THAT MIAMI-DADE COUNTY AND THE
CITY OF MIAMI WORK COOPERATIVELY WITH THE CITY OF MIAMI BEACH,
AND FOR THE COUNTY AND CITY OF MIAMI TO INVITE THE CITY OF MIAMI
BEACH TO THE TABLE IN ALL MATTERS THAT COULD AFFECT THE CITY;
PARTICULARLY AS IT RELATES TO NEGOTIATIONS RELATING TO WATER
AND SEWER CAPACITY FOR WATSON ISLAND; AND DIRECTING THE CITY
MANAGER TO TAKE ALL NECESSARY ACTIONS TO PARTICIPATE IN THE
NEGOTIATION OF THE SEWER WASTE CONTRACT AGREEMENT THAT MAY
MOVE AN ESTIMATED ADDITIONAL 198,018 GALLONS PER DAY OF SEWAGE
WASTE FROM THE WATSON ISLAND "ISLAND GARDENS" PROJECT TO BE
TREATED AT THE COUNTY'S VIRGINIA KEY PROCESSING FACILITY,AS THE
AGING SEWER INFRASTRUCTURE PUTS BISCAYNE BAY AND MIAMI BEACH
IN JEOPARDY.
WHEREAS, during the July 8,2015 City Commission meeting,Vice Mayor Ed Tobin raised
a concern relating sewer services by Miami-Dade County, and specifically raised concerns over
a proposed tri-party agreement between County, the City of Miami and Flagstone Island
Gardens, LLC to increase sewer capacity on Watson Island under ID 192402a; and
WHEREAS,the proposed tri-party agreement seeks to increase Water and Sanitary Sewer
Facilities to the Island Gardens project on Watson Island; and
WHEREAS, such an agreement is of significant importance to the City of Miami Beach,
and during the July 8 2015 meeting, County Commissioner Bruno Barreiro had advised the City
that the City would be invited to the table to participate in the discussion of the tri-
p art Y
agreement for Water and Sanitary Sewer Facilities for Watson Island; and
WHEREAS,the City Commission, by acclamation, unanimously directed the City Manager
to take all necessary actions to participate in the Water and Sanitary Sewer Facilities discussion
relating to Watson Island and/or the Flagstone Island Gardens project, as the proposed use
would dangerously task the existing sewage system by adding an additional 198,018 gallons,
per day, of sewage waste from the Watson Island Project to be treated at the Virginia Key
facility,thus putting at risk the aging sewer infrastructure of the City/County,and possibly putting
at risk Biscayne Bay and Miami Beach; and
WHEREAS, the proposed tri-party agreement does not address current or projected
capacity of the Virginia Key plant to meet the needs of the County, or Miami Beach, and/or the
feasibility of making the installations proposed; and
WHEREAS, the City is unaware of the capacity of the County sewer system or the
adequacy of the pipes to handle the additional sewage; and
WHEREAS,the City of Miami Beach, in 2000, had the horrendous experience with sewage
pipes that dumped waste onto the City's beaches, which resulted in their closure causing
immeasurable environmental damage; and
WHEREAS, a catastrophe in the installation of a sewer waste facility or in the disposal of
the additional waste would have a severe impact on the health, welfare and safety of the
residents of Miami Beach and could potentially affect the City's beaches and tourist economy;
and
WHEREAS, a copy of this Resolution is to be provided to the City of Miami City
Commission and Manager; Miami-Dade County Mayor and Commission; Miami-Dade County
Manager,the Director of Miami-Dade County Water and Sewer Department;the respective legal
departments; and to the representative of Flagstone Island Gardens, LLC; and
WHEREAS, the City Manager is to obtain a seat at the table during negotiations of any
Water and Sanitary Sewer Agreement relating to Watson Island and Flagstone Island Gardens
project.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby request that Miami-Dade County and the City Of Miami work cooperatively
with the City Of Miami Beach, and for the County and City of Miami to invite the City of Miami
Beach to the table in all matters that could affect the City; particularly is it relates to negotiations
relating to water and sewer capacity for Watson Island;and directing the City Manager to take all
necessary actions to participate in the negotiation of the sewer waste contract agreement that
may move an estimated additional 198.018 gallons per day of sewage waste from the Watson
Island "Island Gardens" project to be treated at the County's Virginia Key processing facility, as
the aging sewer infrastructure puts Biscayne Bay and Miami Beach in jeopardy.

Please add the attached proposed Resolution for consideration by the city commission at its July 8,2015
meeting.
It has been brought to my attention by the Coalition for Causeway Chaos that on June 25,the Miami City
Commission authorized its city manager to negotiate a three-party agreement to move sewage waste
that would be created by the Watson Avenue Flagstone development, under Government Cut and
Biscayne Bay to the county sewage processing facility on Virginia Key. The parties to the agreement
would consist of the City of Miami, Miami-Dade County,and the Flagstone development entity. ["Draft
Agreement: Island Gardens at Watson Island, ID#192402a].
The sewage waste expected to be generated by the development would add an estimated 198,018
gallons of sewage per day to that already produced by other uses on Watson Island,for treatment at the
County's Virginia Key sewage facility. [Exhibit"C"of proposed agreement,attached.]The draft
agreement does not address the current or projected capacity of that plant to meet County needs nor
the feasibility of making the installations proposed.
Miami Beach has reason to be concerned because of past sewage pipe ruptures into Biscayne Bay,and
its recent experience with the installation of a county sewage line from South Pointe Park under
Government Cut to Fisher Island.
A catastrophe in the installation of a sewage waste facility or in the disposal of those wastes would have
severe impacts on the health,welfare and safety of the residents of Miami Beach,and could potentially
affect the city's beaches and tourist economy.
For this reason, I urge the mayor and commissioners to adopt a resolution instructing the City Manager
to take all necessary actions to participate,either formally or informally,in the process of this sewage
waste contract review and to advise this body of any developments that should concern our residential,
business and tourist community as well as steps the Mayor and Commissioners should take in order to
protect our interests in the natural and economic environment.

the Watson Island Flagstone Development,and advise this body of any aspect of this undertaking that
should concern our residential, business and tourist community as well as steps the Mayor and
Commissioners should take in order to protect the City's interests in the natural and economic
environment.
