A RESOLUTION Of THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING, AS A SOLE SOURCE PURCHASE,
THE PURCHASE OF ROCKWELL AUTOMATION EQUIPMENT, PARTS,
SOFTWARE, SERVICE AND RELATED ITEMS, PURSUANT TO SECTION 2-367
(d) OF THE MIAMI BEACH CITY CODE, FOR THE CITY'S PUMP STATIONS,
FROM REXEL, THE EXCLUSIVE AGENT FOR ROCKWELL AUTOMATION
EQUIPMENT, PARTS, SOFTWARE, SERVICE AND RELATED ITEMS IN THE
CITY'S GEOGRAPHIC REGION.
WHEREAS, the City's pump stations currently have installed equipment manufactured by
Rockwell Automation that, from time to time, require parts, service, software and replacement
-equipment to maintain operations; and
WHEREAS, Rockwell Automation, the manufacturer of the equipment, parts and software
installed in certain City pump stations, has notified the City that its exclusively authorized agent in
the City's geographic region for Rockwell Automation equipment, parts, software and related items,
as well as the authorized service provider, is Rexel; and
WHEREAS, Rockwell Automation has also notified the City that purchases of equipment,
parts, software, related items and service from non-authorized agents may void any available
warranties for the purchased items which could jeopardize the safe, efficient and effective
operation of the City's pump stations; and
WHEREAS, Section 2-367 (d) of the Miami Beach Code allows for the purchase of goods
and services without competitive bidding when only one source for the product or service is
evident; and
WHEREAS, Section 2-367(d) of the Miami Beach Code requires that the City Commission,
by simple majority vote, authorize sole source purchases when the purchase amount exceeds
$50,000; and
WHEREAS, the Procurement Department, in its due diligence, released an Intent to Sole
Source (ITS) on November 6, 2015, to publically notify prospective bidders of: 1) the City's
intention to seek the required services directly from Rexel, Rockwell Automation's exclusive agent;
and 2) to allow those bidders who may feel they are also authorized to sell these items to notify the
City and challenge the sole source purchase; and
WHEREAS, no responses to the ITS were received; and
WHEREAS, the City Manager recommends that the Mayor and City Commission of the
City of Miami Beach, 'Florida, approve, pursuant to Section 2-367 (d) of the Miami Beach City
Code, the purchase of Rockwell Automation equipment, parts, software, related items and service
from Rexel, Rockwell Automation's sole authorized agent for these items in the City's geographic
region, to maintain safe, efficient and effective operations at the City's pump stations where this
equipment is installed.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
of Miami. Beach, Florida, hereby approve, pursuant to Section 2-367 (d) of the Miami Beach City
Code, the sole source purchase of the purchase of Rockwell Automation equipment, parts,
software, related items and service from Rexel, the exclusive agent for these items in the City's
geographic region.

Item Summary/Recommendation:
As water and sewer pump stations are built, it is necessary to purchase parts, replacement equipment and services that
are compatible with the equipment currently operating in these pump stations to maintain the pump station's efficiency
and effectiveness.The Public Works Department over the years has attempted to standardize, pursuant to Section 2-
391(a) of the Miami Beach City Code, on the various equipment and parts currently operation in the City's water and
sewer pump stations.Standardization is based on the design originally implemented when the equipment was installed.
Standardization allows equipment to run smoothly and allows for replacement parts and equipment to be readily
available to address breakdowns or maintenance requirements in order to minimize failures.However,standardization,
while highly beneficial to maintaining operations or returning systems to operations in the event of a failure,does require
certain sole source purchases as mandated by the original equipment manufacturer(OEM).
Currently,the brands listed in the table below are deployed throughout the City's pump stations.These brands are only
available, as stipulated by the manufacturer of the items, from the authorized sources listed.

The City currently has 23 Sewer Pump Stations, and 6 Water Pump Stations over ten years old.These pump stations
and the equipment installed in them require maintenance, parts and replacement equipment to keep them operating at
efficient and effective levels, and to quickly return them to full function in the event of a failure.
The City has received documentation from the manufacturers of the noted brands that the required items are only
available from the sole source stated in the table above. Nonetheless, in its due diligence,the Procurement Department
released Intents to Sole Source(ITS), on November 6, 2015, to notify prospective bidders of: 1)the City's intention to
seek the items or services as sole source purchases from the source listed; and 2)to allow bidders who may feel they
are qualified to challenge the stated sole source assertion to respond. No responses to the ITSs were received.
CITY MANAGER'S RECOMMENDATION
After considering the need to maintain operational and maintenance efficiencies in the City's pump stations and after
review of the results of the Intent to Sole Source issued by the Procurement Department, I recommend that the Mayor
and City Commission approve the Resolutions authorizing sole source purchases, pursuant to Section 2-367(d)of the
Miami Beach City Code,for the purchase of various equipment and parts for the City's water and sewer pump stations
from the source authorized by the manufacturer.
RECOMMENDATION
