2016-29266 Reso RESOLUTION NO.' 2016-29266 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING MIAMI-DADE COUNTY TO IMPLEMENT COMPREHENSIVE AMENDMENTS TO ITS PARKING FINES AND URGING THE FLORIDA LEGISLATURE TO AMEND THE FLORIDA STATUTES IN ORDER TO INCREASE STATE PENALTIES FOR VARIOUS PARKING VIOLATIONS. WHEREAS, the City of Miami Beach recently increased public parking rates with the primary objective of modifying behavior, promoting transportation alternatives and improving traffic conditions by providing less expensive parking alternatives in public parking garages and lots; and WHEREAS, the parking violations fine schedule was last amended by the County Commission in 1996; and WHEREAS, Section 30-388.32 of the Miami-Dade County Code sets forth the schedule for various parking offenses such as hazardous parking and willfully obstructing streets, as well as other parking violations that create unsafe and hazardous conditions or otherwise impede the orderly flow of traffic and the provision of adequate parking; and WHEREAS, the Miami-Dade County Code currently provides penalties ranging from $18.00 to $33.00 for parking violations, which do not adequately reflect the gravity of these illegal parking offenses, are not in keeping with the increased/current parking rates or the increasing costs of enforcement; and WHEREAS, the penalties for illegal parking offenses in the State of Florida set forth in Section 318.18 of the Florida Statutes, similarly do not reflect penalties that are adequate given the seriousness of these violations; and WHEREAS, inadequate parking fines is a concern to all citizens in Miami Beach and Miami-Dade County, and the City urges other municipalities to support an increase in County and State fines for parking violations, which would serve as an appropriate deterrent to these parking offenses. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby urge Miami-Dade County to implement comprehensive amendments to its parking fines and urge the Florida Legislature to amend the Florida Statutes in order to increase State penalties for various parking violations. Key Intended Outcome Supported: Enhance Public Safety and Emergency Preparedness Item Summary/Recommendation: Miami-Dade County performs all collection, processing, and adjudication of parking violations for all jurisdictions in the County. In addition,the Miami-Dade County Commission is charged with approving all fine schedules for said violations. The Florida Legislature regulates the maximum fine schedule that may be imposed by all counties in the State. The parking violation fine schedules utilized by the State of Florida and Miami-Dade County are not commensurate with the gravity of illegal parking offenses, current parking rates or the costs of enforcement. In fact,the parking violations fine schedule was last amended by the County Commission in 1996. The penalties for illegal parking offenses in the State of Florida, set forth in Section 318.18 of the Florida Statutes, similarly do not reflect penalties that are adequate given the seriousness of these violations. Additionally, the fine schedule for life safety parking violations for prohibited and restricted parking are similarly inadequate. Increasing parking fines to the highest levels allowed will not only serve to improve parking payment compliance but would also increase the City's parking citation revenue. For example, it is estimated that increasing parking violation fines for overtime, restricted and prohibited parking from their current rates to $33.00 for each of these violations would increase the City's annual parking citation revenue by over$2 million dollars. In the 19 years since the County Commission last raised parking fines,the City of Miami Beach increased public parking rates on various occasions. Recently, the City again increased parking rates with the primary objective of modifying behavior, promoting transportation alternatives and improving traffic conditions by providing cheaper parking alternatives in public parking garages and lots. The Federal Highway Administration (FHWA) estimates that 30% of vehicular traffic congestion is attributable to on- street parking. Changing the City's parking rate structure to higher on-street parking rates(as compared to off-street), should serve to reduce the number of parkers impacting traffic lanes as they line up waiting for an on-street parking space. Any amendment passed by the County Commission would affect all jurisdictions;therefore, it is important that each jurisdiction endorse this initiative. To this end, the Administration is working closely with the Dade County League of Cities in order to garner the support of the League as well as all other jurisdictions in the County. The attached Resolution shall serve as the City's endorsement of this initiative and urges the Florida Legislature to pass enabling legislation and the County Commission to amend the parking violation fine schedule.Additionally, if the attached Resolution is adopted, it will be forwarded to each and every jurisdiction in the County for their respective support. On a separate but related topic, the City Commission may want to consider approving a referral to a Commission Committee and/or the Disability Access Committee regarding waived parking fees for parkers with disabled parking placards. The committee(s)would evaluate support for an amendment to Section 30-388.2 of the Code of Miami-Dade County to alleviate the abuse of disabled placards and allow municipalities to collect parking fees for parkers with disabled placards except for specially equipped vehicles, as provided by Florida law, as is currently allowed for the following MDC facilities: Miami International Airport and Port of Miami.
