2016-3990 Ordinance ORDINANCE NO. 2016-3990 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE CODE OF THE CITY OF MIAMI BEACH, ENTITLED "ADMINISTRATION," BY AMENDING ARTICLE VI, ENTITLED "PROCUREMENT," BY AMENDING DIVISION 3, ENTITLED "CONTRACT PROCEDURES," BY AMENDING SECTION 2-375, TO BE ENTITLED "NON-DISCRIMINATION; CONTRACT REQUIREMENTS; WAIVER," TO PROVIDE THAT THE CITY SHALL NOT PROCURE GOODS OR SERVICES FROM, OR OTHERWISE CONTRACT WITH, A BUSINESS WHICH ENGAGES IN THE BOYCOTT OF A NATION OR COUNTRY, OR A BUSINESS WHICH BLACKLISTS OR OTHERWISE REFUSES TO DEAL WITH A PERSON OR ENTITY BASED ON RACE, COLOR, NATIONAL ORIGIN, RELIGION, SEX, INTERSEXUALITY, GENDER IDENTITY, SEXUAL ORIENTATION, MARITAL OR FAMILIAL STATUS, AGE, OR DISABILITY, AND PROVIDING DEFINITIONS, REQUIREMENTS FOR CITY CONTRACTS, AND WAIVER PROVISIONS; PROVIDING FOR REPEALER, CODIFICATION, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission strongly oppose the practice of economic discrimination and boycotts of nations or countries, and of persons and/or entities on the basis of race, color, national origin, religion, sex, intersexuality, gender identity, sexual orientation, marital or familial status, age, or disability; and WHEREAS, the Mayor and City Commission desire to protect the interests of the citizens of Miami Beach by ensuring that the City will not be party to such discriminatory business practices and boycotts, and that procurement contracts are protected from the practical and legal instability inherent in agreements with parties that support or engage in such discriminatory practices. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS: SECTION 1. That Division 3 of Article VI of Chapter 2 of the Code of the City of Miami Beach is hereby amended as follows: Chapter 2 ADMINISTRATION * * * Article VI. Procurement * * * Division 3. Contract Procedures * * * Section 2-375. Non-discrimination; contract requirements; waiver. Lal Definitions. As used in this section, the following terms shall have the following meaning: Boycott means to blacklist, divest from, or otherwise refuse to deal with a nation or country, or to blacklist or otherwise refuse to deal with a person or entity when the action is based on race, color, _ national on in reli ion sex, intersexuality, gender identity, sexual orientation, marital or familial status, age, or disability . The term boycott does not include a decision based upon business or economic reasons, or boycotts, embargoes, trade restrictions, or divestments that are specifically authorized or required by federal law or state law. Business means any sole proprietorship, organization, association, corporation, limited liability partnership, limited liability company, or other entity or business association, including wholly owned subsidiaries, majority-owned subsidiaries, parent companies, or affiliates of those entities or business associations awarded a contract pursuant to this article. 022 Contract requirements: waiver. The city shall not enter into a contract with a business unless the contract includes a representation that the business is not currently engaged in, and an agreement that the business will not engage in, a boycott, as defined in this section. (2) The city commission may, in its sole discretion, elect to waive the requirements of this section upon a 5/7 affirmative vote when the city commission deems the waiver necessary for the health, safety, or welfare of the city. Sec. 2-3766—2-390. Reserved. SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of the City of Miami Beach, Florida. The sections of this Ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. SECTION 5.
