RESOLUTION NO: 9364
WHEREAS, the Alton Beach Realty Company executed
an instrument dated June 29, 1925, filed July 21, 1925 and
recorded in Deed Book 681 at page 137 of the Public Records
of Dade County, Florida, which instrument purported to grant
an easement for certain purposes (as set forth in detail
therein) in the subdivisions referred to in said instrument,
and
WHEREAS, Victor H. Lindlahr and Helene Lindlahr,
husband and wife are the owners of
Lot 19, Block 41' of BELLEVIEW SUBDIVISION
OF ALTON BEACH, as the same is shown,
marked and designated on a plat of said
Subdivision recorded in Plat Book 6,
page 114, of the Public Records of Dade
County, Florida,
and
WHEREAS, Victor H. Lindlahr and Helene Lindlahr,
husband and wife, are the contract vendees of
Lot 20, Block 41, of ALTON BEACH REALTY
COMPANY'S Plat of BELLEVIEW SUBDIVISION,
according to the Plat thereof recorded
in Plat Book 6, page 114, of the Public
Records of Dade County, Florida,
and
WHEREAS, Ray Shainess, an unmarried woman, is the
owner of
Lot 3, and Twenty (20) feet _off the
North side of Lot 2, of Block 41 of
BELLEVIEW 'SUBDIVISION of ALTON BEACH,
as the. same is .shown, marked and
designated on a plat of said subdivision
recorded in Plat Book 6 at page 114
in the office of the Clerk of the Circuit
Court in and for Dade County, Florida,
and
WHEREAS, Evelyn J. Douglas ( a married woman, who
together with her husband, Lee P. Douglas, have executed this
instrument) is the owner of
All of Lot 1 and Lot 2 less the North
Twenty (20) feet thereof, of Block 41
of BELLEVIEW SUBDIVISION, according to
the plat thereof recorded in Plat Book
6 at page 114 of the Public Records of
Dade County, Florida,
and
WHEREAS, the above-named owners are of the belief
that the description, the nature, the location and the extent
of the rights created by the instrument hereinabove referred
to as being recorded in Deed Book 681 at page, 137 of the Public
Records of Dade County, Florida, are not described with
certainty therein, and

WHEREAS, the City of Miami Beach is willing to
enter into an agreement with said owners whereby the rights
of the said owners and the City. of Miami Beach shall be
correctly expressed and defined, and
WHEREAS, the City Attorney has prepared such
agreement, the terms of which are familiar to the City
Council, and
WHEREAS, the City Council deems it to be to the
best interest of the City that such agreement be entered
into,
NOW; THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk be and they are hereby authorized and directed
to execute said agreement for and in behalf of the City of
Miami Beach, Florida.
