99-23376 ResoRESOLUTION NO, 99-23376 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA URGING PRESIDENT WILLIAM JEFFERSON CLINTON AND FLORIDA GOVERNOR JEB BUSH TO REVIEW AND CONSIDER THE APPROPRIATENESS OF EXTENDING CLEMENCY AND PROVIDING POLITICAL ASYLUM TO ELIGIBLE CUBANS CURRENTLY IMPRISONED IN THE UNITED STATES FOR ACTS COMMITTED BY THESE INDIVIDUALS IN THE FIGHT TO LIBERATE CUBA FROM THE COMMUNIST DICTATORSHIP OF FIDEL CASTRO. WHEREAS, United States President William Jefferson Clinton has extended presidential clemency to certain Puerto Ricans imprisoned in the United States; and WHEREAS, currently there are Cubans in American prisons who have committed acts in the fight to liberate Cuba from the communist dictatorship of Fidel Castro; and WHEREAS, fairness dictates that these imprisoned individuals, whose resumes are attached hereto and incorporated herein by reference, be afforded an opportunity to plead their case for clemency and asylum in the United States of America; and WHEREAS, the cities of Hialeah, West Miami, and Sweetwater have all passed resolutions urging President Clinton and Governor Bush to review and consider the appropriateness of extending clemency and political asylum to said individuals. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that: 1. The Mayor and City Commission of the City of Miami Beach, Florida hereby urge President William Jefferson Clinton and Florida Governor Jeb Bush to endorse the concept that a case- by-case study be conducted to determine if eligible Cubans imprisoned in the United States merit clemency and political asylum; and 2. The Mayor and City Commission of the City of Miami Beach hereby direct the City Clerk to transmit a certified copy of this Resolution to President William Jefferson Clinton, Florida Governor Jeb Bush, and United States Attorney Janet Reno. The Metro Homicide Detectives involved in his case were all under investigation by the F.B.I. at the time of his trial for charges ranging from racketeering and extortion to dealing in narcotics and dangerous drugs. Nine of the eleven detectives were encarcerated after conviction, for crimes ranging from extortion ar:i racketeering to dealing in narcotics. In addition, the F.I..2was able to prove that they were corrupt since June of 1977. The detectives falsified documents .mid treat and badgered witnesses. They also destroyed evidence favorable to the defense of Hernandez. Hernandez was convicted of first degree murder eventhough the stare witness testified it May not in who shot at the individual. The individual t.ho lost his Life had been a captain in Fidel Casrro's army. His brother, a major in Castro's army, requested to have his body ftos.m back to Cui:.a but his wife denied it. A street in Cuba was renamed alter the '!e cased captaii'r. The presiding Judge in Hernandez' trial, Judge Joseph Durant, Jr., wrote several letters through the years, asking governors of the State of Florida to release Mt:. Hernandez. Family and friends of Mr. Hernandez chartered a taus in 1997 to cake many members of our community who wanted to speak to Mr. Lawtcn Chiles in favor of a catmutatLon of sentence at a hearing before the members of the cabinet. As it turned cut, numerous legislatures, members of the media, family and friends addressed Mr. Lawton Crites requesting the release of Cuban political prisoner, Valentin Hernandez. This act was unprecedented in the history of Tallahassee for such a hearing, as expressed by Janet 0. Keels. Even this was not enough to persuade Chiles to grant Hernandez the freedom he deserved. The F.H.L. visited him in prism: as a result of a hugger strike lir. Hernandez submitted himself to. Upon that visitation, he was told by Agent George Gazzinsky, that he would be willing to testify on his behalf at any hearing and say that he felt Valentin posed no threat to society. P1r. Hernandez also worked on his own in our community and never posed a threat to anyone. He traveled from Florida City to Okeechobbe everyday to work, as head. of the Carpenter shop at Dade Correctional Institution and worked outside with little or no supervision.
