A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA,APPROVING AND AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE AN UNDERGROUND EASEMENT AGREEMENT
FOR FLORIDA POWER & LIGHT COMPANY (FPL), ATTACHED HERETO AS
EXHIBIT 1, FOR THE UNDERGROUNDING OF EXISTING UTILITIES AND
UTILITY LINES, AND TO GRANT FPL A NON-EXCLUSIVE UNDERGROUND

THE WESTERN PORTION OF ATLANTIC (AIROSO) WAY.
WHEREAS, the Office of Capital Improvement Projects is proceeding with the
redevelopment of Altos Del Mar Park(the Park), and the refurbishment of adjacent Parking Lot 106,
located on Collins Avenue between 76th and 77th Street (7600 Atlantic Way, Miami Beach FL
33141); and
WHEREAS, on July 23, 2014, pursuant to a series of community and staff workshops,
presentations and a unanimous recommendation for approval from the Neighborhood/Community
Affairs Committee, the Master Plan for the redeveloped Park was presented to and adopted by the
City Commission, and a contract for architectural and engineering design services was issued with
Stantec; and
WHEREAS, as part of the Park project, existing aerial mount utility facilities (including
cables, conduits, transformers and poles) will be "undergrounded," as shown in the park master
plan, to service the park and surrounding community; and
WHEREAS, Florida Power and Light requires that the City grant a non-exclusive 10' wide
utility easement for electrical utility purposes, for construction, operation and maintenance of its
facilities; and
WHEREAS, the City desires to execute the attached proposed utility easement, which will
consist of a total area of approximately 3,000 square feet, running along 300.0 feet of the west side
of Atlantic (Airoso) Way; and
WHEREAS,the proposed nonexclusive underground easement agreement(including sketch
and legal description of the Easement) is attached as Exhibit "1" hereto.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, the Mayor and City Commission
approving and authorizing the Mayor and the City Clerk to execute an underground easement
agreement for Florida Power & Light Company (FPL), attached hereto as Exhibit 1, for the
undergrounding of existing utilities and utility lines, and to grant FPL a non-exclusive underground
utility easement at the Altos Del Mar Park, located at 7600 Collins Avenue, for the operation and
maintenance of associated underground utility facilities including, but not limited to, cables,conduits,
appurtenant equipment, and appurtenant above-ground equipment,along the proposed 10 foot wide
easement, between 76 Street and 77TH Street along the western portion of Atlantic (Airoso) Way.

undergrowth and other obstructions within the Easement Area; the rignt to trim and cut and keep trimmed and cut all dead,
weak, leaning or dangerous trees or limbs outside of the Easement Area, which might interfere with or fall upon the lines or
systems of communications or power transmission or distribution; and further grants,to the fullest extent the undersigned has
the power to grant, if at all, the rights hereinabove granted on the Easement Area, over, along, under and across the roads,
streets or highways adjoining or through said Easement Area.

Stantec.The redesigned facility will include a defined entry plaza,pedestrian beach access and walkways,amphitheater type
seating, open lawn area, sand volleyball courts, a designated area for future playground, Florida Native landscaping and
environmentally sensitive site lighting.Parking to support the new facility will be available in the adjacent parking lot P106,with
refurbished paving and upgraded lighting and landscaping.
A duly advertised design review community meeting is scheduled for April 5th,2016 and the Historic Preservation Board is
scheduled to review the project on April 1211,2016.
ANALYSIS

The Administration recommends adopting the Resolution and granting.the easement.
