A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE
CITY MANAGER PERTAINING TO THE RANKING OF PROPOSALS WITH
RESPECT TO PHASE II OF THE RFP SELECTION PROCESS, PURSUANT
TO REQUEST FOR PROPOSALS (RFP) NO. 2015-133-YG, FOR DESIGN
BUILD SERVICES FOR NEIGHBORHOOD NO. 8: CENTRAL BAYSHORE
SOUTH RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENTS;
AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS
WITH RIC-MAN INTERNATIONAL, INC.; AND SHOULD THE
ADMINISTRATION NOT BE SUCCESSFUL IN NEGOTIATING AN
AGREEMENT WITHIN THE AVAILABLE BUDGET WITH RIC-MAN
INTERNATIONAL, INC., AUTHORIZING THE ADMINISTRATION TO
TERMINATE NEGOTIATIONS AND ENTER INTO NEGOTIATIONS WITH
LANZO CONSTRUCTION CO.; AND SHOULD THE ADMINISTRATION NOT
BE SUCCESSFUL IN NEGOTIATING AN AGREEMENT WITH LANZO
CONSTRUCTION CO., AUTHORIZING THE ADMINISTRATION TO
TERMINATE NEGOTIATIONS, AND THAT THE CITY MANAGER PROVIDE A
RECOMMENDATION FOR FURTHER REVIEW BY THE CITY COMMISSION;
AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AGREEMENT UPON CONCLUSION OF SUCCESSFUL
NEGOTIATIONS BY THE ADMINISTRATION.
WHEREAS, on March 11, 2015, the Mayor and City Commission authorized the
issuance of RFP No. 2015-133-YG, For Design/Build Services Neighborhood No. 8: Central
Bayshore South Right-of-Way Infrastructure Improvements (the "RFP"); and
WHEREAS, the RFP was issued on May 5, 2015, with an opening date of July 15, 2015;
and
WHEREAS, a voluntary pre-proposal conference to provide information to the proposers
submitting a response was held on May 13 and 18, 2015; and
WHEREAS, the RFP provided for a two-step, phased evaluation process; and
WHEREAS, the Phase I selection process, related to the qualifications, experience and
availability of the proposers and key members of the design-build team, including the lead
designer and lead contractor; and
WHEREAS, only those proposers short-listed during Phase I were authorized to proceed
to Phase II of the RFP, in which price and detailed technical proposals, based on the approved
Design Criteria Package (the "DCP"), would be considered; and
WHEREAS, under Phase I, the City received proposals from the following two (2) firms:
Ric-Man International, Inc. and Lanzo Construction Co.; and
WHEREAS, on June 16, 2015, the City Manager, via Letter to Commission (LTC) No.
250-2015, appointed an Evaluation Committee (the "Committee"), which convened on
September 23, 2015 to consider the proposals submitted under Phase I; and
WHEREAS, the Committee's rankings were as follows: 1) Ric-man International, Inc.,
top-ranked; and 2) Lanzo Construction Co., second ranked; and
WHEREAS, after reviewing the proposals and the Evaluation Committee's scores and
rankings, the City Manager exercised his due diligence and recommended that the Mayor and
the City Commission short-list the top two (2) ranked proposers to proceed to Phase II of the
RFP evaluation process; and
WHEREAS, in accordance with Addendum No. 7 to the RFP, published July 10th, 2015:
"If the City receives proposals from three (3) or fewer responsive
Proposers and, after review of proposals by the Evaluation Committee,
are all deemed qualified by the City Manager [...], Phase ll may
proceed without interruption. If the City wishes to limit the number of
responsive Proposers eligible for Phase ll (commonly known as short-
listing), the City Manager may shall submit a recommendation to the
City Commission to short-list one or more proposers at the conclusion
of the Phase I evaluation,"; and
WHEREAS, on October 27, 2015 the City Manager approved for Phase I of the
evaluation process to short-list both firms submitting proposals, Ric-Man International, Inc. and
Lanzo Construction Co., to be further considered in Phase II of the evaluation process; and
WHEREAS, on December 24, 2015, via Addendum No. 8 to the RFP, the Procurement
Department issued Phase II of the RFP to the short-listed proposers; and
WHEREAS, on March 3, 2016, the City received proposals in response to Phase II of
the RFP from the two short-listed proposers; and
WHEREAS, the Evaluation Committee, appointed by the City Manager via LTC # 250-
2015, convened on March 10, 2016 to consider the technical proposals received under Phase II;
and
WHEREAS, the Committee's rankings for'Phase II were as follows:
(1) Ric-Man International, Inc.; and
(2) Lanzo Construction Co.; and
WHEREAS, the City Manager exercised his due diligence and concurs with the
Committee's Phase II rankings.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby accept the recommendation of the City Manager pertaining to the ranking
of proposals with respect to Phase II of the RFP selection process, pursuant to Request for
Proposals (RFP) No. 2015-133-YG, for Design Build Services for Design/Build Services
Neighborhood No. 8: Central Bayshore South Right-of-Way Infrastructure Improvements;
authorizing the Administration to enter into negotiations with the top ranked proposer Ric-Man
International, Inc. Should the Administration be unable to negotiate an agreement within the
available budget with the top ranked proposer, the City Manager recommends that the
Administration be authorized to terminate negotiations and enter into negotiations with the
second ranked proposer, Lanzo Construction Co. and should the administration not be able to
negotiate an agreement within the available budget with the second ranked proposer,
authorizing the administration to terminate negotiations. If negotiations are terminated, the City
Manager will provide a recommendation for further review by the City Commission.

Item Summary/Recommendation:
On March 11,2015,the City Commission approved the issuance of the subject RFP,which was advertised on May 5,2015. On
July 15, 2015 the City received proposals in response to the RFP from the following two(2)firms: Lanzo Construction Co., and
Ric-Man International, Inc. In accordance with Section 287.055 of the Florida Statutes, the RFP provides for a two-step,
phased evaluation process. During Phase I, the evaluation committee considers proposers qualifications. During Phase II, the
evaluation committee considers price and detailed technical proposals.
On June 16, 2015,the City Manager appointed the Evaluation Committee via LTC#250-2015,which convened on September
23,2015 to consider proposals received under Phase I.After reviewing all the qualifications of each firm and having considered
the Evaluation Committee's comments and rankings, as well as the fact that only two proposals were received, the City
Manager,on October 27, 2015,approved for Phase I of the evaluation process to shortlist both firms submitting proposals, Ric-
Man International, Inc.and Lanzo Construction Co.to be further considered in Phase II of the evaluation process.
On December 24, 2015, via Addendum No. 8, the Administration issued Phase II of the RFP process to the short-listed
proposers. A pre-proposal conference to provide information to the short-listed proposers was held on January 7, 2016. On
March 3, 2016, the City received proposals in response to Phase II of the RFP from the two short-listed proposers: Lanzo
Construction Co., and Ric-Man International, Inc.
The Evaluation Committee once again convened on March 10, 2016 to consider the technical proposals received under Phase
II. The Evaluation Committee ranked the Phase II proposals as follows: Ric-Man International, Inc., top-ranked, and Lanzo
Construction,second-ranked.
The City Manager recommends that the Mayor and City Commission authorize the Administration to enter into negotiations
with the top ranked proposer Ric-Man International, Inc. Should the Administration be unable to negotiate an agreement within
the available budget with the top ranked proposer, the City Manager recommends that the Administration be authorized to
terminate negotiations and enter into negotiations with the second ranked proposer, Lanzo Construction Co. Should the
Administration not be able to negotiate an agreement within the available budget with the second ranked proposer, the City
Manager recommends that the Administration be authorized to terminate negotiations. If negotiations are terminated, the City

BACKGROUND
Request for Proposal No. 2014-187-SR (RFP) for Design/Build Services Neighborhood No. 8:
Central Bayshore South Right-of-Way Infrastructure Improvements was issued on May 19,
2014, with an initial opening date of June 26, 2014. A voluntary pre-proposal meeting was held
on June 3, 2014. On June 9th, 2014, Addendum No. 1 was published indicating that the
project had been delayed until further notice.
The reason for this hold was to allow for AECOM, the City's Flood Mitigation Consultant, to
review and update the Design-Criteria in order to accommodate the City's new enhanced
stormwater criteria, thereby making the project consistent with current City drainage projects.
On or about November 2014, the project was further delayed pending the identification of
additional funds needed for the financial impact of the enhanced stormwater criteria.

Given the amount of time that had passed since the RFP was issued, it was in the City's best
interest to withdraw the RFP and authorize the issuance of a new RFP No. 2015-133-YG
which incorporated the updated Design-Criteria as well as changes to the Evaluation
Methodology and Determination of Award sections which were revised to include a two-step
process. On March 11, 2015, the City Commission approved the issuance of the subject RFP,
which was advertised on May 5, 2015.
RFP PROCESS — PHASE I
RFP 2015-133-YG was issued on May 5, 2015, with an opening date of July 15, 2015. A pre-
proposal conference to provide information to the proposers submitting a response was held
on May 13 & 18, 2015.
In accordance with Section 287.055 of the Florida Statutes, the RFP provides for a two-step,
phased evaluation process. The Phase I selection process, relates to the qualifications,
experience and availability of the proposers and key members of the design-build team,
including the lead designer and lead constructor. Only those Proposers short-listed during
Phase I are authorized to proceed to Phase II of the RFP selection process, in which price and
detailed technical proposals based on the approved Design Criteria Package (the "DCP") will
be considered.

The Committee convened on September 23, 2015 to consider proposals received under
Phase I. Mr. Bruce Mowry was unable to participate as committee member; therefore Mr. Jose
Rivas and Ms. Mina Samadi served as alternates. The Committee was provided an overview
of the project, information relative to the City's Cone of Silence Ordinance and the
Government Sunshine Law. The Committee was also provided general information on the
scope of services, references, and a copy of each proposal. The Committee was instructed to
score and rank each proposal pursuant to the evaluation criteria established in the RFP. The
evaluation process resulted in the ranking of proposers as indicated below.

MANAGER'S DUE DILIGENCE & RECOMMENDATION
The City Manager recommends that the Mayor and City Commission authorize the
Administration to enter into negotiations with the top ranked proposer Ric-Man International,
Inc. Should the Administration be unable to negotiate an agreement within the available
budget with the top ranked proposer, the City Manager recommends that the Administration be
authorized to terminate negotiations and enter into negotiations with the second ranked
proposer, Lanzo Construction Co. Should the Administration not be able to negotiate an
agreement within the available budget with the second ranked proposer, the City Manager
recommends that the Administration be authorized to terminate negotiations. If negotiations
are terminated, the City Manager will provide a recommendation for further review by the City
Commission.
CONCLUSION
The Administration recommends that the Mayor and City Commission of the City of Miami
Beach, Florida accept the recommendation of the City Manager pertaining to the ranking of
proposals with respect to Phase II of the RFP selection process pursuant to Request for
Proposals (RFP) No. 2015-133-YG for Design Build Services for Design/Build Services
Neighborhood o. 8. Central Bayshore South Right-of-Way Infrastructure Improvements.
