Amendment No. 2 to the Interdepartmental Memorandum of Understanding with Housing and Community Development c40 15—.? AMENDMENT NO. 2 TO THE INTERDEPARTMENTAL MEMORANDUM OF UNDERSTANDING, DATED MAY 6, 2016 BETWEEN THE CITY OF MIAMI BEACH OFFICE OF HOUSING AND COMMUNITY DEVELOPMENT, A DIVISION OF THE OFFICE OF HOUSING AND COMMUNITY SERVICES ("HCD"), AND THE CITY OF MIAMI BEACH OFFICE OF HOUSING AND COMMUNITY SERVICES ("Sub-Recipient"). This Amendment No. 2 ("Amendment No.2") to the Interdepartmental Memorandum of Understanding (MOU)dated May 6, 2016 is entered into this2.kiay of ''i 17 2016 (Effective Date), by and between the City of Miami Beach Office of Housing and Community Development, a division of the Office of Housing and Community Services ("HCD"), and the City of Miami Beach Office of Housing and Community Services ("Sub-Recipient"). WITNESSETH: WHEREAS, on July 8, 2015, the City Commission approved Resolution No. 2015-29080, approving the One-Year Action Plan for Federal Funds for FY 2015/2016, and determined the necessity for engaging the Sub-Recipient to render the following project in Miami Beach: Lottie Apartments Rehabilitation and Relocation of tenants while the rehabilitation takes place; and WHEREAS, pursuant to the MOU, the Sub-Recipient is providing services needed for the rehabilitation of affordable housing which is a high priority need identified in the City's FY 2013- 2017 Consolidated Plan approved by the City Commission through Resolution 2013/28237 on June 5, 2013; and WHEREAS, in the MOU, HCD agreed to make available Community Development Block Grant funds in the amount of $305,047.84 for use by the Sub-Recipient; and WHEREAS, in order to improve the living condition of the tenants, comply with HUD regulations and obtain a Building permit, the Sub-Recipient will conduct environmental testing including but not limited to: asbestos and lead; and WHEREAS, the cost of the environmental testing was not included in the MOU's budget; and WHEREAS, in the project schedule these expenses take place first and will be charged to these funds; and WHEREAS, on May 4, 2016, HCS and Sub-Recipient executed Amendment No. 1 which amended the budget to include temporary tenant relocation and cost of plan reproductions. (The MOU and Amendment No. 1 shall be collectively referred to herein as the MOU). NOW,THEREFORE, in consideration of the mutual promises contained herein,the parties hereby agree to amend the MOU, as follows: 1. The above recitals are true and correct and are incorporated as part of this Amendment No. 2. 2. Exhibit"C"entitled "Budget" is hereby deleted in its entirety and replaced with the attached Exhibit "C". 3: All other terms and conditions of the MOU shall remain unchanged and in full force and effect. In the event there is a conflict between Amendment No.2 and the MOU, the provisions of this Amendment No. 2 shall govern. IN WITNESS WHEREOF, the City of Miami Beach Office of Housing and Community Development, a division of the Office of Housing and Community Services, and the City of Miami Beach Office of Housing and Community Services have executed this Amendment No.2 to the MOU as of the day and year first written above by their duly authorized representatives. Summary,of Proposed Changes - ' The increase of Professional Services previously submitted for approval for$1,950.00 to cover the pre-renovation asbestos survey of the nine-unit apartment complex did not include the Lead based paint testing. These environmental tests are necessary as part of the process to obtain a construction permit and fulfill HUD regulations. We are requesting at this point to increase the Professional Services line item in $6,500.00 to cover both tests that will be carried before construction.
