SUBJECT:August 30, 2016—The Final Date That A Ballot Question Could Be Removed From The
November 8, 2016 General/Special Election.
At the July 20, 2016 Presentations/Commission Meeting, I was instructed to find out what is the final date
the City would have to notify the Elections Department in order for a City Commission approved ballot
question not to appear/print on the November 8, 2016 General/Special Election ballot.
The Miami-Dade Elections Department, via the attached email, notified me that based on the
compressed election schedule, the final date that the Elections Department would be able to remove a
question from the November 8, 2016 General/Special Election ballot is August 30,2016. Should the City
wish to remove ballot content after this date, ballots would be printed with the question included, and the
Elections Department would follow State procedures for voter notification and signage to alert affected
voters of the ballot removal.

As you are aware, our deadline for municipalities to submit their executed legislation for ballot questions on the
November 8, 2016 General Election is August 9, 2016.
Based on our compressed election schedule, the latest date that we would be able to remove a question from the
General Election ballot is August 30, 2016. Should the City wish to remove ballot content after this date, ballots would
be printed with the straw ballot question included and we would follow State procedures for voter notification and
signage to alert affected voters of the ballot removal.

Good morning Carolina,
It was a pleasure speaking to you yesterday.

The City Miami Beach has passed three ballot questions, one of which is a straw
ballot, for inclusion in the November 8, 2016 General Election. I will transmit to
you the resolutions related to these three ballot questions shortly.
As we discussed, the City Commission directed me to obtain information
regarding the following:
A. If the City Commission where to determine that it no longer wanted to
include the straw ballot question on the November 8 General Election,
what is the latest date the City would have to notify the Elections
Department in order for the straw ballot question not to appear/print on
the ballot?
B. If the City Commission were to determine that it no longer wanted to
include the straw ballot question on the November 8 General Election
after the deadline referenced in the prior question, and therefore being
too late to remove the straw ballot question from the ballot, is there: 1) a
mechanism for the Elections Department to provide written notice to
voters at the polls that the straw ballot question has been withdrawn; and
2) if votes are nevertheless cast, contrary to the written notification, is
there a mechanism for the Elections Department not to not to count,
tabulate, or release any votes cast in connection with the City straw ballot
question?
As time is of the essence, I respectfully request a response as soon as
practicable.
