THE CITY OF MIAMI BEACH, FLORIDA, OPPOSING THE
FLORIDA DEPARTMENT OF ENVIRONMENTAL
PROTECTION'S (DEP) WEAKENING OF RESTRICTIONS THAT
WOULD ALLOW AN INCREASE IN THE RELEASE OF TOXIC
CHEMICALS INTO FLORIDA'S WATERS; URGING THE
UNITED STATES ENVIRONMENTAL PROTECTION AGENCY
(EPA) NOT TO APPROVE THE FLORIDA DEP'S NEW
RESTRICTIONS; SUPPORTING THE LAWSUIT FILED BY THE
SEMINOLE TRIBE OF FLORIDA AGAINST THE FLORIDA DEP
AND THE FLORIDA ENVIRONMENTAL REGULATIONS
COMMISSION (FERC) ON AUGUST 5, 2016 TO HALT THE
INCREASE OF TOXINS IN FLORIDA'S WATER; OPPOSING
ANY EFFORT BY THE DEP OR THE FERC TO OPPOSE THE
SEMINOLE LITIGATION; AND DIRECTING THE CITY CLERK
TO TRANSMIT A COPY OF THIS RESOLUTION TO THE
UNITED STATES ENVIRONMENTAL PROTECTION AGENCY,
THE FLORIDA DEPARTMENT OF ENVIRONMENTAL
PROTECTION, THE MIAMI-DADE COUNTY BOARD OF
COUNTY COMMISSIONERS, THE FLORIDA LEAGUE OF
CITIES, AND THE MIAMI-DADE COUNTY LEAGUE OF CITIES.
WHEREAS, the Florida Department of Environmental Protection (DEP) is Florida's lead
agency for environmental management, including protection of Florida's surface waters in
accordance with Chapter 403, Florida Statutes, Chapters 62-302 and 62-303, Florida
Administrative Code, and the Clean Water Act; and
WHEREAS, DEP is in the process of revising its human health-based surface water
quality criteria to update the limits for 43 regulated chemical compounds and to adopt standards
for 39 previously unregulated compounds; and
WHEREAS, DEP held three public workshops in May 2016 during which the public
expressed their concern with the proposed increases to chemical concentrations and the
possible ramifications to public health and the health of our waterways, including the
discrepancy between the United States Environmental Protection Agency's (EPA) and the
DEP's cancer risk measurements used to revise the standards; and
WHEREAS, on July 26 2016, the Florida Environmental Regulations Commission
(FERC) voted to approve DEP's proposed rule changes through revisions to Chapters 62-302
and 62-303 of the Florida Administrative Code; and
WHEREAS, on August 5, 2016, the Seminole Tribe of Florida filed a lawsuit against
DEP and FERC to halt the increase'of toxins in Florida's waters; and
WHEREAS, the City of Miami Beach (City) is a barrier island surrounded by Biscayne
Bay, the Atlantic Ocean, and an interconnected system of waterways that provide habitat for fish
and wildlife, opportunities for recreation, and an enhanced quality of life; and
WHEREAS, protecting the Biscayne Bay watershed and keeping our waterways clean is
critical to our local ecosystem, our residents, and our economy; and
WHEREAS, the City works hard to keep pollutants out of its waterways, but the City
depends on the County, State, and Federal governments to establish water quality regulations
that help preserve local water quality; and
WHEREAS, DEP's revision to the State's surface water quality standards will increase
the discharge limits for several of the compounds under review, allowing the release of these
chemicals in greater concentrations into Florida's waterways and potentially degrading the
quality of local surface waters; and
WHEREAS, opposing the DEP's reduced standards, urging the EPA to not approve
these new restrictions, and supporting the Seminole Tribe's litigation will serve to protect the
health, safety, welfare, and economy of the citizens and residents of Miami Beach.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby oppose Florida DEP's weakening of restrictions that would allow an
increase in the release of toxic chemicals into Florida's waters; urge the EPA not to approve
DEP's new restrictions; support the lawsuit filed by the Seminole Tribe of Florida against DEP
and FERC on August 5, 2016 to halt the increase of toxins in Florida's water; oppose any efforts
by the DEP or the FERC to oppose the Seminole litigation; and, direct the City Clerk to transmit
a copy of this Resolution to the EPA, the DEP, the Miami-Dade County Board of County
Commissioners, the Florida League of Cities, and the Miami-Dade County League of Cities.

ANALYSIS
The Florida Department of Environmental Protection (DEP) is the lead agency for statewide
environmental management, including protection of Florida's surface waters in accordance with
Chapter 403, Florida Statutes, Chapters 62-302 and 62-303, Florida Administrative Code
(F.A.C.), and the Clean Water Act. In 2012, the DEP began the process of revising its human
health-based surface water quality criteria. As part of this revision, the agency is proposing to
update the limits for 43 regulated chemical compounds, which were previously established in
the early 1990s, and to adopt standards for 39 previously unregulated compounds. The new
standards were developed using the United States Environmental Protection Agency's
approved risk levels and methodologies as applied to Florida-specific data, such as frequency
of water-based recreational uses and statewide fish consumption.
In May 2016, the DEP held three public workshops statewide (one in Tallahassee, one in
Stuart, and one in Orlando) to discuss the proposed rule changes. During these meetings, the
public expressed their concern with the proposed increases to chemical concentrations and

the possible ramifications to public health and the health of our waterways. Specifically, the
comments suggested flaws in the DEP's methodology for developing the human health criteria
and opposed its move toward weakened protections. Additionally, the public questioned the
discrepancy between the U.S. Environmental Protection Agency (EPA) standards, which limit
the risk of carcinogenic chemicals to a probability of causing cancer in one of one million
people, and the DEP's cancer risk measurement used in the revised standards which could
cause cancer in one out of 100,000 people or, in cases of people who eat fish daily,
approximately one in 10,000 people.
On July 21, 2016, elected officials from Miami-Dade County, the City of South Miami, the
Village of Pinecrest and the City of Miami sent a letter to DEP Secretary Jonathan Steverson
respectfully requesting the presentation of the revised rules to the Florida Environmental
Regulations Commission (FERC) be postponed until the vacant "Environment" and "Local
Government" seats were filled,
On July 26, 2016, the FERC voted to approve the DEP's proposed revisions to Chapters 62-
302 and 62-303, F.A.C. The water quality standards, as approved by the FERC, will now be
presented to the EPA for final review and approval. On August 5, the Seminole Tribe of Florida
filed a lawsuit against the DEP and the FERC to halt the increase of toxins in Florida's waters.
The City of Pembroke Pines and other Florida municipalities have since adopted resolutions
affirming their opposition to the DEP's weakening restrictions; urging the EPA not to approve
the new restrictions; and, supporting the Seminole Tribe's litigation.
• The City is a barrier island surrounded by Biscayne Bay, the Atlantic Ocean, and an

safety, welfare, and economy of the citizens and residents of Miami Beach.
CONCLUSION
The Administration recommends adopting the Resolution.

CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE UNITED STATES
ENVIRONMENTAL PROTECTION AGENCY, THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION, THE MIAMI-DADE COUNTY BOARD OF COUNTY
COMMISSIONERS, THE FLORIDA LEAGUE OF CITIES, AND THE MIAMI-DADE COUNTY
LEAGUE OF CITIES.
This Resolution was unanimously passed and adopted by the Mayor and City Commission of
the City of Miami Beach on September 14, 2016.
