Amendment No. 1 to the Interdepartmental Memorandum of Understanding (3) AMENDMENT NO. 1
TO THE INTERDEPARTMENTAL MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF MIAMI BEACH OFFICE OF HOUSING AND
COMMUNITY DEVELOPMENT AND THE CITY OF MIAMI BEACH OFFICE OF
HOUSING AND COMMUNITY SERVICES
This Amendment No. 1 ("Amendment No.1")to the Intercte artmental Memorandum of
Understanding (MOU)dated July 20, 2016 is entered into this LLft. day of QcZ�o
2016 (Effective Date), by and between the City of Miami Beach Office of
Housing and Community Development, a Division of the Office of Housing and
Community Services ("HCD"), and City of Miami Beach Office of Housing and
Community Services ("Sub-Recipient").
WHEREAS, the City is an entitlement recipient of U.S. Department of Housing
and Urban Development (HUD) grant programs, Community Development Block Grant
(CDBG) funds, and HOME Investment Partnership funds (HOME), and the City expects
to continue to receive entitlement funds from these grant programs to operate the City's
housing and community development activities; and
WHEREAS, each year, the City prepares a One-Year Action Plan detailing how it
intends to allocate funds received from HUD to conduct eligible activities for the benefit
of low-and-moderate-income residents; and
WHEREAS, on July 8, 2015, the City Commission approved Resolution No.
2015-29080, approving the One-Year Action Plan for Federal Funds for FY 2015-2016,
and determined the necessity for engaging the Sub-Recipient to render the following
project in Miami Beach: Lottie Apartments Rehabilitation and Relocation of tenants, as
needed, while the tenting takes place; and
WHEREAS, the Sub-Recipient is providing services needed for the rehabilitation
of affordable housing which is a high priority need identified in the City's FY 2013-2017
Consolidated Plan approved by the City Commission via Resolution No. 2013-28237 on
June 5, 2013; and
WHEREAS, the City through resolution 2016-29383, adopted on May 11, 2016,
authorized HCD to recapture $111,313.24 remaining from the CDBG allocation made in
FY 2011-2012 to the Façade Program; and
WHEREAS, the City through resolution 2016-29316, adopted on March 9, 2016,
authorized HCD to recapture $5,816.59 remaining from the CDBG allocation made in FY
2011-2012 to Jewish Community Services of Greater Miami for the Senior Center
Improvements; and
WHEREAS, the project is in progress and it needs to be extended to allow for the
rehabilitation to take place.
NOW, THEREFORE, in consideration of the mutual benefits contained herein,
HCD and Sub-Recipient agree as follows:

1. Section 10, on page 3 of the MOU, is deleted in its entirety and replaced with the
following:
Term: This Agreement shall be deemed to have commenced retroactively on
October 1, 2015 and terminate on or before September 30, 2017.
2. The Section 12 of the MOU is hereby deleted in its entirety and replaced with
the following:
Section 12. No Discrimination; Equal Employment Opportunities: The
Provider shall comply with Executive Order 11246, entitled "Equal Employment
Opportunity", as amended by Executive Order 11375, and as supplemented in
Department of Labor Regulations, relative to equal employment opportunity for
all persons without regard to race; color, religion, sex or national origin.
The Provider hereby agrees that it will comply with City of Miami Beach Human
Rights Ordinance as codified in Chapter 62 of the City Code, as may be
amended from time to time, prohibiting discrimination in employment, housing,
public accommodations, or public services, on the basis of actual or perceived
race, color, national origin, religion, sex, intersexuality, sexual orientation, gender
identity, familial and marital status, age, ancestry, height, weight, domestic
partner status, labor organization membership, familial situation, political
affiliation, or disability.
3. All other terms and conditions of the MOU shall remain unchanged and in full
force and effect.
IN WITNESS WHEREOF, the City of Miami Beach Office of Housing and
Community Development, a division of the Office of Housing and Community
Services, and the City of Miami Beach Office of Housing and Community Services
have executed this Amendment No.1 to the MOU as of the day and year first written above
by their duly authorized representatives.
