Amendment No. 2 to the Interdepartmental Memorandum of Understanding AMENDMENT NO. 2
TO THE INTERDEPARTMENTAL MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF MIAMI BEACH OFFICE OF HOUSING AND COMMUNITY DEVELOPMENT AND
THE CITY OF MIAMI BEACH OFFICE OF HOUSING AND COMMUNITY SERVICES
This Amendment No. 2 ("Amendment No. 2") to the Interdepartmental Memorandum of
Understanding (MOU)dated July 1, 2016 is entered into this3 I day of a c-rc-t . 2016
(Effective Date), by and between the City of Miami Beach Office of Housing and Community
Development, a division of the Office of Housing and Community Services ("HCD"), and the City
of Miami Beach Office of Housing and Community Services ("Sub-Recipient").
WITNESSETH:
WHEREAS,on March 9, 2016,the City Commission approved Resolution No.2016-29316,
approving the recapture and reallocation of Community Development Block Grant(CDBG)funds
previously unspent in the amount of$172,438.92; and
WHEREAS, Staff identified the replacement of water heaters at the Neptune Apartments
as an eligible project, which project would increase the quality of life of the residents of this low-to
moderate-income City owned rental building; and
WHEREAS, in Amendment No..4 we corrected the original MOU amount that was left as
$305,047.84, instead of the $41,690 budgeted for this project(The MOU and Amendment No. 1
shall be collectively referred to herein as the MOU); and
WHEREAS, the project is in progress and it needs to be extended to allow for the
rehabilitation to take place.
NOW, THEREFORE, in consideration of the mutual benefits contained herein, HCD and
Sub-Recipient agree as follows:
1. Section 10, on page 3 of the MOU, is deleted in its entirety and replaced with the following:
Term: This Agreement shall to have commence retroactively on October 1, 2015 and
terminate on or before September 30, 2017.
2. The Section 12 of the MOU is hereby deleted in its entirety and replaced with the following:
Section 12. No Discrimination; Equal Employment Opportunities: The Provider shall
comply with Executive Order 11246, entitled "Equal Employment Opportunity", as amended by
Executive Order 11375, and as supplemented in Department of Labor Regulations, relative to
equal employment opportunity for all persons without regard to race,color,religion,sex or national
origin.
The Provider hereby agrees that it will comply with City of Miami Beach Human Rights
Ordinance as codified in Chapter 62 of the City Code, as may be amended from time to time,
.prohibiting discrimination in employment,,housing, public accommodations, or public services,
on the basis of actual or perceived race, color, national origin, religion, sex, intersexuality, sexual
orientation,..dender,identityJamilial and marital status, age, ancestry, height, weight, domestic
partner status, labor organization membership, familial situation, political affiliation, or disability.
3. All other terms and conditions of the MOU shall remain unchanged and in full force and
effect. In the event there is a conflict between Amendment No. 2 and the MOU, the
provisions of this Amendment No. 2 shall govern.
IN WITNESS WHEREOF, the City of Miami Beach Office of Housing and Community
Development, a division of the Office of Housing and Community Services, and the City of Miami
Beach Office of Housing and Community Services have executed this Amendment No.2 to the MOU
as of the day and year first written above by their duly authorized representatives.
