SUBJECT: VILLAGE OF KEY BISCAYNE RESOLUTION
Attached for your information is Resolution No. 2016-33, adopted by the Mayor and Council of
the Village of Key Biscayne on November 1, 2016.
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY
BISCAYNE, FLORIDA, RELATING TO AMENDMENT 1 BALLOT QUESTION
ENTITLED "RIGHTS OF ELECTRICITY CONSUMERS REGARDING SOLAR
ENERGY CHOICE", SCHEDULED FOR THE NOVEMBER 8, 2016 GENERAL
ELECTION; URGING THE REJECTION OF AMENDMENT 1; AND PROVIDING
FOR AN EFFECTIVE DATE.
The Village of Key Biscayne has requested that a copy of this resolution be provided to the
Miami Beach Mayor and Commissioners.

RESOLUTION NO. 2016-33
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, RELATING TO
AMENDMENT 1 BALLOT QUESTION ENTITLED"RIGHTS
OF ELECTRICITY CONSUMERS REGARDING SOLAR
ENERGY CHOICE",SCHEDULED FOR THE NOVEMBER 8,
2016 GENERAL ELECTION;URGING THE REJECTION OF
AMENDMENT 1; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, solar photovoltaic energy offers many potential benefits, including: lower
electricity costs for homeowners, businesses, and governments; local jobs and economic
development;reduced dependence on imported fuels;pollution-free electricity generation;no water
use; and contribution to a more resilient electric grid; and
WHEREAS, increased solar-generated electricity, including customer-sited systems on
residential and commercial properties,will be a key strategy for achieving this community-wide goal
of maximizing the utilization of Florida's abundance of sunlight; and
WHEREAS,Amendment 1,titled "Rights of Electricity Consumers Regarding Solar Energy
Choice,"will be presented to voters at the November 8,2016 general election; and
WHEREAS, Amendment I purports to provide a new"choice" for solar power in its title,
but no choices are provided in Amendment 1 and no new solar rights are created, but instead,
Amendment 1 will place critical restrictions on existing solar rights in the Florida Constitution; and
WHEREAS,the ballot question for Amendment 1 is titled "Rights of Electricity Consumers
Regarding Solar Energy Choice" and, as it is described above, it is detrimental to the Village of Key
Biscayne's previously expressed support for efforts to increase solar energy generation and other
forms of renewable energy in the Village of Key Biscayne and in the State of Florida.
NOW, THEREFORE, BE.IT RESOLVED BY THE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Opposition to Amendment 1 Ballot Question. The Village Council deems
Amendment 1 to be deliberately misleading as to its purpose and effect. The Village Council
opposes the adoption of Amendment 1 and urges all Village electors to understand that Amendment
1 is adverse to compellingly important sustainable energy policies
Section 3. Instructions. The Village Clerk is hereby instructed to publish a copy of this
Resolution to all voters of the Village of KeyBiscayne, as well as to all subscribers to Village media
outlets, and to email this Resolution to all municipal and county governments of the State of Florida
so as to disseminate the Village of Key Biscayne's position relative to Amendment 1..
Section 4. Effective Date. That this Resolution shall be effective immediately upon
adoption hereof
