A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING THE MAYOR AND CITY CLERK TO GRANT A
NON-EXCLUSIVE UTILITY EASEMENT OF APPROXIMATELY
1,056.40 SQUARE FEET (SF), TO FLORIDA POWER AND LIGHT
(FPL) AT THE MAURICE GIBB MEMORIAL PARK PROPERTY,
LOCATED AT 1790 PURDY AVENUE, FOR THE OPERATION AND
MAINTENANCE OF DUCTBANKS, PAD MOUNTED TRANSFORMER
AND ASSOCIATED EQUIPMENT SERVING THE SUNSET
HARBOUR STORMWATER PUMP STATION No. 2, WHICH
EASEMENT IS ATTACHED HERETO AS EXHIBIT A.
WHEREAS, the City approved the expansion of the existing Pump Station No. 2
to increase the capacity of the Sunset Harbour Neighborhood to meet City drainage
requirements; and
WHEREAS, the new pump station will require a separated electrical connection
to a new power source to be built by LANZO in the vicinity of the proposed location of
the new pump station; and
WHEREAS, an FPL pad-mounted transformer, associated equipment and
underground utilities will be required to service this pump station; and
WHEREAS, in order for FPL to schedule and install its electrical service
equipment, FPL needs a non-exclusive easement to provide and install the electrical
equipment.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission authorize the Mayor and the City Clerk to execute a non-exclusive access
to use easement of approximately 1,056.40 square feet, providing Florida Power & Light
(FPL), at the Maurice Gibb Memorial Park Property, located at 1790 Purdy Avenue, for
the operation and maintenance of ductbanks, pad mounted transformer and associated
equipment serving the new stormwater pump station, which easement is attached hereto
as Exhibit A.

SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND

RECOMMENDATION
The Administration recommends approving the Resolution.
ANALYSIS
The City has a Design/Build contract agreement with Lanzo Construction Co. (Lanzo) for work
associated with the neighborhood improvements to be completed within the Sunset Harbour
Neighborhood. On April 13th, 2016 City Commission Resolution 2016-29366 approved the
expansion of the existing Pump Station No 2 to increase the capacity of the Sunset Harbour
Neighborhood to meet City drainage requirements. The work includes the design and
construction of a stand-alone pump adjacent to Pump Station No. 2 and the design and
construction of a discharge outfall pipe. The new pump will require a separate electrical
connection and power source to be built by Lanzo.
An FPL pad-mounted transformer, associated equipment and underground utilities will be
required to service this pump. In order for FPL to schedule and place its electrical service, the
City is required to execute a non-exclusive easement, which grants FPL access to service its
equipment.A survey describing the limits of the easement to be recorded per FPL requirements
is attached as Exhibit A.
CONCLUSION
The Administration recommends approving the Resolution.
