ThattheappropriateandproperMiami-DadeCountyelectionofficialsshallconductthe saidSpecialElectionherebycalled, withacceptanceofthecertificationoftheresultsofsaid SpecialElection tobe performed by theCity Commission. Theofficialreturnsforeachprecinct shallbefurnishedtotheCityClerkoftheCityofMiamiBeachassoonastheballotsfromall precinctshavebeentabulated. SECTION3. ThatthesaidvotingprecinctsintheCityofsaidSpecialElectionshallbeasestablished by the properandappropriateMiami-DadeCounty ElectionOfficials. Notlessthanthirtydays' noticeoftheadoptionofthisResolutionandofitsprovisions callingthisSpecialElectionshallbegivenbypublicationintheMiamiHerald, anewspaperof generalcirculationinMiami Beach, Miami-DadeCounty, Florida. Astatementshallnotbefiled eveniftherehavebeennoexpendituresorandcompensationduringthe reportingperiodbutiftherehavebeenexpendituresand/orcompensation thenastatementshallbefiledlistingsuchdetail. Inconsiderationofthismatter, theCityAttorneyhasconsultedtheCityClerk (asthe City personnel responsiblefor oversightofthe City's lobbyistlaws), andtheClerkhas providedthefollowinginformationwhichmaybeusefulintheCommission'sdeliberation ofthismatter: For reportsduein2015, 528lobbyistswererequiredtosubmitannualfinancial disclosurestatements. Of the528 lobbyists, 107 (20.3%) filedanappealwiththeCountyEthics Commissiontoreduce/eliminatefinesincurredforuntimelyfilingofthedisclosure statement. Ofthe107lobbyistfilingappeals, only17reportedanytypeofcompensationor expenditures (15.9%), leaving 90 (84.1%) ofthelobbyistswhoappealedwithno compensationorexpenditurestoreport. ThisrequirementhasledtonumerousinvestigationsbytheEthicsCommissionstafftolocateandcommunicate withregistered lobbyists, notify them of theirfailure tofile, andtobringeachofthesematterstotheEthics Commissionfor resolution atapublicmeeting. Duetotheadministrativefineimposedinthesecasesonaper diembasis, someofthesecasesarepresentedtotheCommissionwithapresumptivefinetotalinginthetensof thousands ofdollars. Thefines are routinely waived by theCommissionforfirst offenders, duetotherelative insignificance of the offenseofalobbyist'sfailure to reportthathe orshehad nothing to report. Thefines imposed arealmostalways drastically reduced by theEthicsCommissionbecause ofthe obvious disproportionalityofthepenaltytotheoffense. Mostoftheviolatorsarenotregularlobbyists, butindividualswhoareretainedtoworkonaparticularissueand areunfamiliarwith filing requirements. Weexpendasubstantialamountofstafftimeonthesecases, whichseem notto serveasignificantpublicpurpose. ThemembersoftheEthicsCommission, whoencouragedmetoseek thischange, haveexpressedfrustrationwithcasesthatfailtopromoteanimagethattheEthicsCommissiondeals withseriousethicalissuesdeservingoftheattentionofanimportantquasi-judicialbody. Wehavenoproblemin dealing withthose whofail to reportexpenditures actually incurredin lobbying, buttheprosecutionofthe technical failure tofile astatement listing noexpenditures, punishable by unrealisticand draconianfines, isa pooruseoftheresourcesofanypublicagency. PleasenotethatthisissuehasalreadybeenraisedwiththeMiami-DadeCountyCommission, whichpreviously had the samerequirement in the County lobbyist ordinance. AttherequestoftheEthicsCommission, theCounty Commissionamendedtheordinancetodispensewiththefilingrequirementifnoexpenditureshavebeenincurred duringthereportingperiod.
