Amendment No. 1 to the Development Block Agreement with HOPE, Inc. ;U/&- a 99iav AMENDMENT NO. 1 TO COMMUNITY DEVELOPMENT BLOCK GRANT AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND HOUSING OPPORTUNITIES PROJECT FOR EXCELLENCE, INC. (HOPE, INC.) This Amendment No. 1 ("Amendment") to the Community Development Block Grant Agreement dated December 23, 2016 ("Agreement") by and between the CITY OF MIAMI BEACH, a Florida municipal corporation, having its principal office at 1700 Convention Center Drive, Miami Beach, Florida, 33139, (hereinafter referred to as "City"), and HOUSING OPPORTUNITIES PROJECT FOR EXCELLENCE, INC. (HOPE, INC.), a Florida not-for profit corporation, having its principal office at 11501 NW 2 Avenue, Miami, Florida 33168 (hereinafter referred to as "Sub-Recipient") is entered into this ICS day of rt (LC t ,2017. WHEREAS, the City is an entitlement recipient of U.S. Department of Housing and Urban Development (HUD) grant programs, Community Development Block Grant (CDBG) funds, and HOME Investment Partnership funds (HOME), and the City expects to continue to receive entitlement funds from these grant programs to operate the City's housing and community development activities; and WHEREAS, each year, the City prepares a One-Year Action Plan detailing how it intends to allocate funds received from HUD to conduct eligible activities for the benefit of low-and-moderate- income residents; and WHEREAS, on June 8, 2016, the City Commission approved Resolution No. 2016- 29420, approving the One-Year Action Plan for Federal Funds for FY 2016/2017, and providing CDBG funds in the amount of One Hundred and Sixty-Six Thousand, Nine Hundred and Thirty-Nine Dollars ($166,939.00) for administrative allowance equal to 20% of the Fiscal Year 2016/2017 CDBG HUD entitlement amount; and WHEREAS, the City is required by HUD to administer HUD-funded programs and activities in a manner affirmatively furthering the policies of the Fair Housing Act of 1968; and WHEREAS, activities carried out pursuant to this responsibility may be charged to Program Administration; and WHEREAS, the City has allocated Fourteen Thousand Dollars ($14,000) to cover expenses related to these efforts; and WHEREAS, the Sub-Recipient has agreed to provide Fair Housing Services ("Program") within the City limits; and WHEREAS, the One-Year Action Plan for FY 2016/2017 was made available to the public for comment at the City Commission meeting on June 8, 2016; and for a 30-day public review and comment period, from May 5, through June 6, 2016; and WHEREAS, on December 23, 2016, the City and Sub-Recipient executed the Agreement; and WHEREAS, at least sixty (60) percent of the allotted grant funds have to be expended by June 30, 2017, to assist the City with compliance of CDBG guidelines requiring timeliness in the expenditure of funds; however, this language was omitted from the executed Agreement. NOW, THEREFORE, in consideration of the mutual benefits contained herein, the City and Sub-Recipient agree as follows: 1. Section 9 of"Applicable Rules and Regulations" in Exhibit"A" "Scope of Services" is hereby amended to read as follows: 1 9. Timeliness of Reimbursement Requests Reimbursement requests must be submitted no later than sixty (60) days from the incurrence of the expense. The City will strictly monitor this element. Please note that cancelled checks signing sheets and event materials must be submitted in conjunction with all reimbursement requests. Therefore, the Sub-Recipient should calendar itself accordingly to ensure that reimbursement requests are submitted to the City in a timely manner. Furthermore, at least sixty (60) percent of your allotted grant funds must be expended by June 30, 2017 as demonstrated by the total value of reimbursements processed. Capital Projects will be reviewed and judged based on their implementation schedule. 2. Except as amended herein, all other terms and conditions of the Agreement shall remain unchanged and in full force and effect. In the event there is a conflict between the provisions of this Amendment and the Agreement, the provisions of the Amendment shall govern.
