A RESOLUTION OF THE MAYO)2 AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 2016-091-KB, FOR DESIGN/BUILD SERVICES FOR WEST AVENUE IMPROVEMENTS PHASE II NORTH OF 14 STREET (PHASE II); AND AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH RIC-MAN CONSTRUCTION FLORIDA, INC.; FURTHER, SHOULD THE ADMINISTRATION NOT BE SUCCESSFUL IN ITS NEGOTIATIONS WITH RIC- MAN CONSTRUCTION FLORIDA, INC., AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE SECOND HIGHEST RANKED PROPOSER, LANZO CONSTRUCTION CO., FLORIDA; AND FURTHER PROVIDING THAT THE FINAL NEGOTIATED GUARANTEED MAXIMUM PRICETHEITH PRIORE APPROVALS SHALL BE SUBJECT TO OF THE MAYOR AND CITY COMMISSION. WHEREAS, on March 9, 2016, the City Commission directed the Administration to issue a Request for Proposals (RFP) for Design/Build Services for West Avenue Improvements Phase II North of 14 Street (the "RFP"); and WHEREAS, the RFP was released on March 14, 2016, with an opening date of May 9, 2016; and WHEREAS, a voluntary pre-proposal conference to provide information to the proposers submitting a response was held on March 29, 2016; and WHEREAS, the RFP provided for a two-step, phased evaluation process; and WHEREAS, the Phase I selection process, related to the qualifications, experience and availability of the proposers and key members of the design-build team, including the lead designer and lead contractor; and WHEREAS, only those proposers short-listed during Phase I were authorized to proceed to Phase II of the RFP, in which price and detailed technical proposals, based on the approved Design Criteria Package (the "DCP"), would be considered; and WHEREAS, under Phase I, the City received proposals in response to the RFP from the following five (5) firms: Bergeron Land Development, Inc. ("Bergeron"), David Mancini & Sons, Inc. ("DMSI"), Lanzo Construction Co., Florida ("Lanzo"), Ric-Man Construction Florida, Inc. ("Ric-Man Construction"), and Ric-Man International, Inc. ("Ric-Man International"); and the WHEREAS, the proposal from and,Raic-Mannational deemednon-responsive;on-- respoto ly ns vleh and minimum requirements as stated in the RFP, WHEREAS, on May 17, 2016, via LTC # 215-2016, the City Manager appointed the Evaluation Committee (the "Evaluation Phase I; and which convened on June 13, 2016 to consider the proposals submitted under WHEREAS, the Committee's Phase I rankings were as follows: 1) Ric-Man Construction; 2) DMSI; 2) Lanzo; and 4) Bergeron; and WHEREAS, on July 14, 2016, after reviewing the proposals and the Evaluation Committee's scores and rankings, the City Manager exercised his due diligence and recommended, pursuant to Section 0400 (Proposal Evaluation) of the RFP, that all proposers proceed to Phase II of the RFP evaluation process; and WHEREAS, on November 10, 2016, the Procurement Department issued Phase II of the RFP to the short-listed proposers; and WHEREAS, on January 12, 2017, the City received the technical and price proposals in response to Phase II of the RFP; and WHEREAS, DMSI submitted a "Statement of No Bid" for Phase II of the RFP and therefore received no further consideration; and WHEREAS, the Evaluation Committee, appointed by the City Manager via LTC # 215- 2016, convened on January 19, 2017 to consider the proposals received under Phase II; and WHEREAS, the Evaluation Committee's rankings for Phase II were as follows: (1) Ric-Man Construction; and (2) Lanzo; and (3) Bergeron; and WHEREAS, the City Manager, having considered the proposals and the Evaluation Committee's rankings, recommends award of the contract to Ric-Man Construction, Inc., with a Guaranteed Maximum Price (GMP) in the amount of$30,844,123.00; and WHEREAS, the City Manager further recommends the establishment of a separate ten percent (10%) Owner's Contingency for the Project in the amount of$3,084,412.30. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida hereby accept the recommendation of the City Manager, pursuant to Request for Proposals (RFP) No. 2016-091-KB for Design/Build Services for West Avenue Improvements Phase II North of 14 Street (Phase II); authorize the Administration to enter into negotiations with the top-ranked proposer, Ric-man Construction Florida, Inc.; further, should the Administration not be successful in its negotiations with Ric-man Construction Florida, Inc., authorize the Administration to enter into negotiations with the second highest ranked proposer, Lanzo Construction Co., Florida; and further providing that the final negotiated Guaranteed Maximum Price with the successful proposer shall be subject to the prior approval of the Mayor and City Commission. RECOMMENDATION Adopt the Resolution. ANALYSIS At its March 14, 2007 meeting, the City Commission adopted the Basis of Design Report (BODR)for the West Avenue — Bay Road Neighborhood right-of-way improvement Project. The improvements include road reconstruction, sidewalks and bicycle circulation, installation of stormwater drainage systems, upgrade to the water distribution system, landscaping and street parking. At its February 12, 2014 meeting, the City Commission adopted a resolution to approve a design build contract to construct stormwater drainage pump stations at 14th, 10th and 6th Streets. In addition, the City approved change orders 1 thru 5 to the design build contract to include the initial Improvements of the West Avenue Neighborhood in the following roads: West Avenue from 6th to 8th Streets; 14th, 10th and 6th Streets from Alton Road to Biscayne Bay; 17th street from Alton Road to Collins Canal; West Avenue from Lincoln Road to Collins Canal; and the construction of a new pump station at the intersection of 17th Street and West Avenue. All improvements mentioned above are considered to be the Phase I of this neighborhood improvement project. Now that Phase I is currently under construction and expected to be completed this Fiscal Year, the Public Works Department has initiated the procurement process for Phase II of this Page 667 of 1025 neighborhood improvement project. Due to the size of this project, Phase II has been broken into two separate contracts: Phase II South of 14th Street and Phase II North of 14th Street. Both phases will be constructed at the same time. This item is only for the South portion of the project. The City of Miami Beach requested proposals from qualified vendors for the survey, design, permitting, community outreach for construction administration and the construction of the infrastructure site work for Right of Way Infrastructure Improvement Program Neighborhood No. 11: West Avenue North of 14th Street. The work will include but not be limited to site preparation; earthwork; roadway reconstruction; water, sewer and drainage installation and/or relocation; water services relocation; landscaping; and streetscape improvements. The selected Design/Build (DB) Firm pursuant to the RFP will be responsible for the design and construction associated with the Project. The contract with the successful DB Firm will be awarded in accordance with the established requirements for award of design build contracts. RFP PROCESS— PHASE I On March 9, 2016, the City Commission directed the Administration to issue a Request for Proposals (RFP) for Design/Build Services for West Avenue Improvements Phase II North of 14 Street. The RFP was released on March 14, 2016, with an opening date of May 9, 2016. A pre-proposal conference to provide information to the proposers submitting a response was held on March 29, 2016. In accordance with Section 287.055, Florida Statutes, the RFP provides for a two-step, phased evaluation process. The Phase I selection process relates to the qualifications, experience and availability of the proposers and key members of the design-build team, including the lead designer and lead constructor. Only those Proposers short-listed during Phase I are authorized to proceed to Phase II of the RFP selection process, in which price and detailed technical proposals based on the approved Design Criteria Package (the "DCP")will be considered. Under Phase I, the City received proposals in response to the RFP from the following five (5)firms: • Bergeron Land Development, Inc. • David Mancini & Sons, Inc. • Lanzo Construction Company • Ric-Man Construction, Inc. • Ric-Man International, Inc. The proposal from Ric-Man International, Inc. failed to comply with the minimum requirements as stated in the RFP, and, accordingly was deemed non-responsive. On May 17, 2016 the City Manager appointed the Evaluation Committee via LTC # 215-2016. The Evaluation Committee (the "Committee")consisted of the following individuals: Josiel Ferrer, Transportation Manager, Transportation Department, City of Miami Beach Sabrina Baglieri, Senior Capital Projects Coordinator, Capital Improvement Program, City of Miami Beach Gayle Durham, City of Miami Beach Resident Mark Wohl, City of Miami Beach Resident Page 668 of 1025 The following individuals were appointed as alternates: Roger Buell, Assistant City Engineer, Public Works Department, Engineering Division, C'ty of Miami Beach Luis Soto, Civil Engineer III,Public Works Department, Engineering Division, City of Miami Beach The Committee convened on June 13, 2016 to consider proposals received under Phase I. The Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance and the Government Sunshine Law. The Committee was also provided general information on the scope of services, references, and a copy of each proposal. The Committee was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFP. The evaluation process resulted in the ranking of proposers as indicated in Attachment A. On July 14, 2016, after reviewing all the qualifications of each firm and having considered the Evaluation Committee's comments and rankings, the City Manager approved for all firms submitting responsive proposals to be shortlisted for Phase II consideration, including: Bergeron Land Development, Inc., David Mancini & Sons, Inc., Lanzo Construction Company, and Ric-Man Construction, Inc. RFP PROCESS— PHASE II Upon receipt of the Design Criteria Package (DCP) from Public Works Engineering, on November 10, 2016, the Procurement Department issued Phase II of the RFP process to the short-listed proposers. A pre-proposal conference to provide information to the short-listed proposers was held on November 23, 2016. On January 12, 2017, the City received proposals in response to Phase II of the RFP from the short-listed proposers: • Bergeron Land Development, Inc. • David Mancini & Sons, Inc. (DMSI) • Lanzo Construction Company • Ric-Man Construction, Inc. DMSI submitted a"Statement of No Bid" for Phase II of the RFP. The Evaluation Committee, appointed by the City Manager via LTC # 215-2016, convened on January 19, 2017 to consider the technical proposals received under Phase II. The Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance and the Government Sunshine Law. The Committee was also provided general information on the scope of services, a copy of each proposal, and engaged in a question and answer session with each proposer. The Committee was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFP for Phase II. The evaluation process resulted in the ranking of proposers as indicated in Attachment B. After considering the proposals received, the evaluation process, and staff due diligence the City Manager recommend that the Mayor and City Commission of the City of Miami Beach, Florida, approve the award of contract to Ric-Man Construction Inc., and further authorize the Mayor and City Clerk to execute the contract. Please be aware that, while Ric-Man Construction, Inc., has not performed construction work in the City of Miami Beach since 2014, the references provided indicate that the firm is well qualified to do the work and stated they have performed Page 669 of 1025 exceptionally well on difficult projects. Additionally, the Supplier Qualifier Report completed by Dun and Bradstreet indicates that the firm is at medium risk of financial challenges. It is important to note that there is a shortage of above ground funding for this project in the amount of approximately $4M. As a result, it is our recommendation that the contract reflect that a separate notice to proceed (NTP) will be issued when the above ground funding is secured since this work typically occurs at the end of the project. We bring this up to put on the record that we will need to identify a funding source and bring that forward in a budget amendment in the future. CONCLUSION After reviewing all the submissions and the results of the evaluation process, the City Manager recommends that the Mayor and City Commission approve the resolution authorizing the Administration to award Ric-Man Construction, Inc., pursuant to Request for Proposals (RFP) No. 2016-091-KB for Design/Build Services for West Avenue Improvements Phase II North of 14 Street (Phase II) with the Guaranteed Maximum Price (GMP) in the amount of $30,850,663.00; and authorize a ten percent (10%) Owner's Contingency in the amount of $3,085,066.30; and further authorize the Mayor and City Clerk to execute a Design Build Agreement with Ric-Man Construction, Inc. with a separate notice to proceed for above ground improvements.
