Last Friday, while you were out, Mr. Del Toro came in to see me
regarding the amount owed the city for late filing. I told him that
there must have been some mis-understanding between him and myself.
He had no questions about anything that transpired between us, he just
wanted to review his file and the letters we previously sent him to
see how we came to the total sum of $600.00.
He said he will be paying this sum shortly, as he stated in his letter
to you.

Dear Miss Smith:
Thank you for your letter of March 24, 1998.
I would like to request in writing, how the City Clerk's office has come up with the amount of
$600.00, as in my initial discussion with the City Clerk on November 14, 1997 indicated a lessor
amount.
Please be aware that in accordance with Florida Election Statutes, I have indeed responded to
each of your inquiries. HOWeV€ir, there is clearly a misunderstanding concerning policy, as in my
and my campaign treasurer's conversations with you, we are advised not to pay based on
precedent with previous candidates in the City of Miami Beach. Now you are threatening to turn
the matter over to the Florida Elections Commission, which I find disturbing after following your
instructions. A decision needs to be made as to which policy guidelines are the official ones.
I will pay the official balance due by April 30, 1998.

Dear Mr. Del Taro:
This letter shall serve as a reminder that in accordance with State Law, specifically
106.07(8)(b) F.S., that when a Campaign Treasurer's Report is late, and not submitted on
the date due, that the filing officer is obligated to advise the candidate of this failure and
assess fines for each day the required report is late.
As related to you in our previous letter to you dated October 31, 1997, the total amount
due for your Campaign Treasurer's Report being late is $600.00. Fines for filing Campaign
Treasurer's Reports late shall not be an allowable campaign expenditure and shall be paid
only from personal funds of the candidate.
These funds are to be paid to the filing officer unless an appeal is made to the Florida
Elections Commission pursuant to paragraph (c). As of this date, we have not received
your payment.
Therefore, would you kindly submit this past due amount so that we may close your
account.

Dear Mr. Del Toro:
Pursuant to 106.07(8)(b)F.S., upon determining that a report (Campaign Treasurer's Report) is late,
the filing officer shall immediately notify the candidate as to the failure to file a report by the
designated due date and that a fine is being assessed for each late day. The fine shall be $50 per
day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is
greater. Upon receipt of the report,. the filing officer shall determine the amount of the fine
which is due and shall notify the candidate.
Please be advised that my office received a copy of your Campaign Treasurer's Report (OS-DE 12-
13-and 14) on October 24, 1997. The due date was October 3rd. The total late days are 21.
Multiplying the total late days 21 times the $50 per day late fee assessment equals $1,050.00.
Your total contributions as reported were $2,400 and your total expenditures were $864.00.
Using the greater of the two, $2,400 times 25% equals $600.00.
The fine shall not exceed 25% of the total receipts or expenditures, therefore the total amount
of the late fee is $600.00.
Again, pursuant to 106.07(8)(b) F.S. such fines shall be paid to the filing officer within 20 days
after receipt of the notice of payment due, unless appeal is made to the Florida Elections
Commission pursuant to paragraph {c).
In the case of a candidate, such fine shall not be an allowable campaign expenditure and shall
be paid only from personal funds of the candidate.
Per my conversation with the Florida Division of Elections, I have no latitude in this matter. If

Dear Mr. Del Toro:
In accordance with Chapter 106.07 of the State of Florida Election laws,
"each campaign treasurer designated by a candidate pursuant to S. 106,021/
shall fi Ie regular reports of all contributions received, and all expenditures
made, by or on behalf of such candidate,"
Your first campaign report was due in our office on October 3, 1997 and
would have covered the period September 5, 1997 through September 26,
1997. This was never received by this office, Your second report would
have covered the period of September 27, 1997 through October 10, 1997
and was due on October 17, 1997. We received your "Waiver of Report"
filed with this office on October 20, 1997, which is one day late.
Mr. Del Toro, you need to submit to this office a Campaign Report for the
period mentioned above as soon as possible.
PENAL TV FOR LATE FILING: In accordance with Florida State Statute
106.07(8)(b) "Upon determiining that a report is late, the City Clerk shall
immediately notify the candidate or chair of the political committee as to the
failure to file a report by the designated due date and that a fine is being
assessed for each late day,
The fine shall be $50.00 per day for each late day, not to exceed 25% of
the total receipts or expenditures, whichever is greater, for the period
covered by the late report.
Upon receipt of the report, the City Clerk shall determine the amount of the
fine which is due and shall notify the candidate or chair. The City Clerk
shall determine the amount of the fine due based upon the earliest of the
following: ~
1. When the report is actually received by such officer.
2. When the report is postmarked.
3. When the certificate of mailing is dated.
4. When the receipt from an established courier company is dated.
Such fine shall be paid to the City Clerk within 20 days after receipt of the
notice of payment due, unless appeal is made to the Florida Elections
Commission pursuant to paragraph (c). In the case of a candidate, such fine
shall not be an allowable campaign expenditure and shall be paid only
from personal funds of the candidate. An officer or member of a political
committee shall not be personally liable for such fine."

Bob:
I have left several messages on Mr. Del Toro's answering machine, with
no response to date. This week I was fortunate enough to actually get
Mr. Del Toro on the phone. I explained to him that he has missed the
reporting date and he must file a report and/or a waiver otherwise he
will be be fined, and these funds do NOT come out of the campaign
account, but out of his own pocket. Before ending our conversation
this week I reminded him that another report is due on 10/17/97, and to
please make every attempt to bring us these reports so that his records
will be accurate and up to date.
Mr. Del Toro brought no report in as of this date, 10/17/97.
