The fine shall be $50 per day for each late day, not to exceed 25% of the total receipts or expenditures, which ever is greater. Upon receipt of the report, the filing officer shall determine the amount of the fine which is due and shall notify the candidate. - Please be advised that my office received a copy of your Campaign Treasurer's Report (DS-DE 12-13-and 14) on November 19, 1997. The due date was November 10th. The total late days are nine(9). Multiplying the total late days - 9 times the $50 per day late fee assessment equals $450.00. Your total contributions as reported were $17,060 and your total expenditures were $9,979.25. Using the greater of the two, $17,060 times 25% equals $4,265.00. The fine shall not exceed 25% of the total receipts or expenditures, therefore the total amount of the late fee is $450.00. Payment must be received at the City Clerk's Office by December 16,1997. Payment may be made in person at the City Clerk's Office or by mail. Mail your check, payable to the City of Miami Beach, 1700 Convention Center Dr., Miami Beach, Fl. 33139, attention Robert Parcher. If you have any questions, please do not hesitate to call me at 673-7411. Such fine shall not be an allowable campaign expenditure and shall be paid only from personal funds of the candidate. This subsection does not apply to bumper stickers or items designed to be worn by a person. Florida Statute 106.143(4). Emphasis added. Your bus stop signs, banners, and literature violate Florida law. The language employed on your signs, ironically, is "Integrity, Above All. Elect Jose Smith Commissioner". Obviously, that does not include "for" between your name and the name of the office for which you are running. Therefore, they are clearly in violation of the law. In lieu of making a formal complaint to the State Division of Elections at this time, I call upon you to remove the offending signs immediately and stop distributing the offending literature. I hope you will correct your advertising in the future. I would have no interest in overseeing your campaign, but as you are advertising your integrity above all, I presume you wish to be held to the highest standard. Signs in a single-family district are limited to four (4) square feet in size and are limited to one sign for each legal parcel. Signs in the business district, multi-family, and industrial districts are restricted to one (1) square foot per three (3) lineal feet of the property's street frontage for a ; '; ma.ximum of seventy-five (75) square feet. No signs are permitted on the City rights-of -way. Failure to comply with the 'above requirements \Vill result in a $50.00 fine, and a $23.00 Administrative cost for the removal of the sign. The fine shall be $50.00 per day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report. Upon receipt of the report, the City Clerk shall determine the amount of the fine which is due and shall notify the candidate or chair. The City Clerk shall determine the amount of the fine due based upon the earliest of the following: 1 . When the report is actually received by such officer. 2. When the report is postmarked. 3. When the certificate of mailing is dated. 4. When the receipt from an established courier company is dated. Such fine shall be paid to the City Clerk within 20 days after receipt of the notice of payment due, unless appeal is made to the Florida Elections Commission pursuant to paragraph (c). In the case of a candidate, such fine shall not be an allowable campaign expenditure and shall be paid only from personal funds of the candidate.
