Dear Greg:
Enclosed please find my personal check in the sum of $205.90 to cover an
overdraft in the above account which is now closed.
Apparently, a check made payable to "Miami Beach Citizens Alliance", check
No. 1073, dated October 28, 1997, had not been paid by Union Planters until March 3,
1998. When we closed the account we assumed (but had not verified) that this check
had been paid. It had not.
This will also confirm my telephone conversation with Crystal that the $27.5C
service charge will be waived.
If you have any questions concerning this matter please let me know.

placement of political signs.
3. Enclosed is section 9-4 of the Miami Beach Zoning Ordinance. Section 9-4 deals with
temporary signs and specifically with elections signs. Please note that each candidate may
have up to four campaign headquarters which shall be registered with the City Clerk.

PLACEMENT OF POLITICAL SIGN
Dear l.2.21 Candidate:
The placement of political signs within the City limits is governed under Section 9 of the City of
Miami Beach Zoning Ordinance.
Signs in a single-family district are limited to four (4) square feet in size and are limited to one
sign for each legal parcel. Signs in the business district, multi-family, and industrial districts are
.restricted to one (1) square foot per three (3) lineal feet of the property's street frontage for a
;" ma;'(imum of seventy-five (75) square feet. No signs are permitted on the City rights-of -way.
Failure to comply with the 'above requirements ,viII result in a $50.00 fine, and a $23.00
Administrative cost for the removal of the sign. The sign vriII also be confiscated and destroyed.

1. ORIGINAL REPORTS must be filed with the City Clerk, 1700 Convention CE nter

2. The Campaign Treasurer is required to maintain a copy of each report.
3. All candidates must file a final Financial Report by December 4, 1997. This

includes candidates who drop out of the election, those who do not win, those
who are in a runoff, as well as the elected individuals. Candidates who are
unopposed must also file this report.
4. PENAL TV FOR LATE FILING: In accordance with Florida State Statute 106.070Hb)
"Upon determining that a report is late, the City Clerk shall immediately notif) the
candidate or chair of the political committee as to the failure to file a report b) the
designated due date and that a fine is being assessed for each late day. The fine ~hall
be $50.00 per day for each late day, not to exceed 25% of the total receipl s or
expenditures, whichever is greater, for the period covered by the late report. L pon
receipt of the report, the City Clerk shall determine the amount of the fine which is due
and shall notify the candidate or chair. The City Clerk shall determine the amou 1t of
the fine due based upon the earliest of the following:
1. When the report is actually received by such officer.
2. When the report is postmarked.
3. When the certificate of mailing is dated.
4. When the receipt from an established courier company is dated.
Such fine shall be paid to the City Clerk within 20 days after receipt of the notice
of payment due, unless appeal is made to the Florida Elections Commission
pursuant to paragraph (c). In the case of a candidate, such fine shall not be an
allowable campaign expenditure and shall be paid only from personal funds of
the candidate. An officer or member of a political committee shall not be
personally I iable for such fine."

The Florida law on political advertisements states: "No political advertise~t of
a candidate who is not an incumbent of the office for which he or she is running shall USf:
the word "re-elect.'s Additionally, such advertisement must include the word "for"
between the candidate's name and the office for which he or she is running, in order
that iJIcumbency is not implied. This subsection does not apply to bumper stickers or
items designed to be worn by a person. Florida Statute 106.143(4). Emphasis added.
Dear Mr. Smith:
Your bus stop signs, banners, and literature violate Florida law.
The language employed on your signs, ironically, is "Integrity, Above All. Elect
Jose Smith Commissioner". Obviously, that does not include "for" between your name
and the name of the office for which you are running. Therefore, they are clearly in
violation of the law.
In lieu of making a formal complaint to the State Division of Elections at this
time, I call upon you to remove the offending signs immediately and stop distributing tht
offending literature. I hope you will correct your advertising in the future.
I would have no interest in overseeing your campaign, but as you are advertising
your integrity above all, I presume you wish to be held to the highest standard. I am
sending copies of this letter to the city and the media for them to monitor compliance if
they wish. Best wishes to you and your family for a clean and enjoyable campaign.

remitted to the qualifying officer. Any reimbursement for
petition verification costa which are reimbursable by the
state shall be rorwarded by the qualifying officer to the
state for deposit in the General Revenue Fund. All reim.
bursements for the amount of the election assessment
shall be forwarded by the qualifying officer to the
Department of State for deposit in the Elections Com.
mission Trust Fund.
(7) Any candidate required to dispose of campaign
funds pursuant to this section shall do so within the time
required by this section and shall, on or before the date
by which such disposition is to have been made. file with
the officer with whom reports are required to be filed
pursuant to s. 106.07 a form prescribed by the Division
of Elections listing:
(a) The name and address of each person or unit of
government to whom any of the funds were distributed
and the amounts thereof;
(b) The name and address of each person to whom
an expenditure was made, together with the amounl
thereof and purpose therefor; and
(c) The amount of such lunds transferred to an office
account by Jhe candidate. together with the name and
address of the bank in which the oHice account is
located .
Such report shall be signed by the candidate and the
campaign treasurer and certified as true and correct
pursuant to s. 106.07, Any candidate failing to file a
report on the designated due date shall be subject to a
fine as provided in a. 106.07 for submitting late reports.
(8) Any candidate elected to office who transfers
surplus campaign funds into an office account pursuant
to subsection (5) shall file a report on the' Oth day follow-
ing the end of each calendar Quarter until the account
is closed. Such reports shall contain the name and
address of each person to whom any disbursement of
funds was made. together with the amount thereof and
the purpose therefor, and the name and address of any
person from whom the elecled candidate received any
refund or reimbursement and the amount thereof. Such
reports shall be on forms prescribed by lhe Division of
Elections, signed by the elected candidate. certified 8S
true and correct. and filed with the officer with whom
campaign reports were filed pursuant to .. 106.07(2).
(9) Any candidate, or any person on behalf of e can-
