A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1 TO THE CONTRACT BETWEEN THE CITY AND HB HOFFMAN, LLC, PURSUANT TO INVITATION TO BID(ITB) NO. 2015-182-JR FOR CITY HALL HEATING, VENTILATION AND AIR CONDITIONING (HVAC) & VARIABLE FREQUENCY DRIVE (VFD) REPLACEMENT, WITH SAID AMENDMENT NO. 1 IN THE AMOUNT NOT-TO- EXCEED $59,769.00 FOR ADDITIONAL WORK RELATING TO COATING OF COILS,ADDITION OF CERTAIN DUCT HEATERS,ADDITIONAL MOBILIZATION EQUIPMENT, INCLUDING RELOCATION OF A CRANE TO CONVENTION CENTER DRIVE, AND REPLACEMENT OF CERTAIN DAMAGED TURNING VANES. WHEREAS, the Heating, Ventilation and Air Conditioning (HVAC) units at City Hall have reached the end of their useful life and require replacement in order to accurately control the temperature and humidity at City Hall; and WHEREAS, in 2015,the City competitively solicited proposals for HVAC replacement work, through ITB No. 2015-182-JR; and on December 9, 2015,the City Commission awarded a contract to HB Hoffman, LLC, the lowest responsive bidder; WHEREAS,through the City's above-referenced contract with HB Hoffman, LLC,the City is in the process of replacing nine (9) HVAC units at City Hall, and installing new Variable Frequency Drives (VFD) and smoke detectors; WHEREAS,the City has encountered unforeseen conditions related to the replacement of the nine (9) HVAC units at City Hall, and has requested that HB Hoffman, LLC perform additional work, including the coating of the coils,the addition of duct heaters for AHU-4 and AHU-7, additional mobilization equipment(including relocation of crane to Convention Center Drive), and replacement of damaged turning vanes on AHU-11, in the total amount not-to-exceed $59,769.00; and WHEREAS, the Administration recommends that the Mayor and City Commission approve Amendment No. 1, the form of which is attached to the Commission Memorandum accompanying this Resolution, in the amount not-to-exceed $59,769. NOW THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, the City and Consultant hereby agree to amend the Agreement as follows: 1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as part of this Amendment. 2. MODIFICATIONS. a. Contractor agrees to perform the additional work specified in Exhibit 1 attached hereto, for the amounts specified herein, which shall include, at a minimum, coating of all coils relating to the HVAC units, additional duct heaters for AHU-4 and AHU-7, additional mobilization equipment (including relocation of crane to Convention Center Drive), and replacement of damaged turning vanes for AHU-11. b. The total amount for all work related to the services identified in Exhibit 1 hereto shall not exceed the maximum amount of $59,769. All work shall be billed in accordance with the Contract terms. 3. RATIFICATION. Except as amended herein, all other terms and conditions of the Contract shall remain unchanged and in full force and effect. In the event there is a conflict between the provisions of this Amendment and the Contract, the provisions of this Amendment shall govern. 3. RATIFICATION.
