AN ORDINANCE RELATING TO THE COIN13TRUCT ION
AND INSTALLATION OF SEPTIC TANKS IN THE CITY
OF kI "I' BEACH, FLORIDA, AND PROVIDIZIG A PEN-
ALTY FM THE VIOLATION MEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA:
SECTION All septic tanks shall be constructed and located under
he conditions and requirernents hereafter set forth:
SECTION 2. Upon application, permits will be given for the oon-
ruc tion o f septic tanks , but all permits are given on condition
that the owner, builder ,, or occupant assume all risk of damage that
may result from the installation of same ,
SECTION 3. All designs and plans of septic tanks and the oons truc-
on o' same shall be approved bar the Oity-- - I2t3c
Ample notice must be ,given the -Sanitary �� r so that the c on-
alruc tion may be inspected by hire. Upo:Z application a suitable
design will be furnished by the City.
UCTION 4. Whenever possible , septic tanks shall be loo ated in a
place convenient or nearest to where the main sewer will possibly
be located, so that a change of pipe will not be necessary.
SECTION 5. The sizeof septic tanks shall be proportional to the
.neer So'persons using same. .A minimum allowance for oapauity
being ' gallons per person perAhour_; with a minim= retention •
period of eight hours and a maximum period of twenty hours , depend-
-ing upon the nature of the soil in which the outlet drains are
located. There shall beat least, two lines .cif drain tile with a

minimum length of twenty-five feet each.
SECTIUN 6. Any violation of any provision of this ordinance shall
q punis ed by a fine of not less than ten ( -" 10.00) dollars and
not exceeding two hundred ( ';4'200.00' dollars or -by imprisonment, not
exceeding ninety ( 90) days or- by both fine and imprisonment, at
the discretion of the trial court.
SECTION 7. All laws and- parts of laws in conflict with this ordi-
nanae be-and in the same are hereby repealed.
ECTION 8, It is hereby declared by the City Council that the
health and welfare of the City of 1,iami Beach are in peril and
that this ordinance is for the immediate preservation of the pub-
lio peace, health and safety, e
