AN ORDINANCE RELATING TO THE CONSTRUCTION
OF SIDEWALKS AND CURBS IN THE CITY LFF 1IA ,1I
BEACH, FLORIDA, AND FROVfDI4G A FE ALLTY FOR
Td E VIOLATION THEREOF.

CITY OF kI.A iI BEACH, FLORIDA:
SECTION 1. All sidewalks ,, curbs and gutters tp be built within
the o ity limits of Miami Beach shall conform in every detail to
ti1e spedifications adopted at the time, as standard by the city
SECTION 2. Wherever sidewalk is to be built the city engineer
shall establish lines and grades without loss of time to either
the owner or the contractor; the contractor shall notify the
engineer at least twenty-four hours before the contemplated be-
ginning of the construction; the contractor shall furnish suit-
able stakes and after same are in place he shall provide ways
for preserving same; in replacing said stakes which the contract-
for or his subordinates may have failed to preserve; the contrac-
tor shall pay at the rate of ; 1.00 for the first two stakes so

reset and .25' for each additional stake thereafter. The engin-
eer shall also designate where spaces are to be left for poles
or other necessary obstructions . After completion of the work
it shall be the duty of the engineer to inspect said work, and
see that it is built to conform to the lines and grades furnish-
ed by him. An inspector shall be appointed by the city engineer
who shall have access to all parts of the work at all times , and
whose duty shall be to point out to the contractor any neglect "
or disregard of the specifications. The duties and functions of
said official are purely supervisory and his decisions shall al-
ways be subject to the final approval of the city engineer. The
inspection and acceptance of material and construction during
the progress of the work shall not relieve the contractor from
any of the obligations assumed under the contract to furnish
material and perform all work strictly in -ccordance with the
specifications , and all work not in accordance therewith, al-
though overlooked and passed, shall be made good, and all infer-
ior or defective materials shall be removed and replaced with
proper material upon written demand of the Street Bommitteeman
and the City Engineer at any time prior to the expiration of
six months after completion of the work. Upon the completion
and acceptance of any sidewalk work, the contractor or builder
shall file a written notice in the office of the City Engineer,
specifying the amount of work done, the location and date of
completion.
SECTION 3. All work on sidewalks , including the laying out of
aame , shall be under the supervision of the committeeman on
streets , with such assistance as he may require from the city
engineer. All sidewalk work shall be approved by the city
council.

SECTICH 4. All approaches or places where vehicles cross side-
walks , shall be made into the Sidewalk with a slant, grade, or
rise from the outside of the curb line toward the center of the
walk, sufficient to enable all vehicles to cross with safety,
said grade to be furnished by the city engineer, and the work
to be done under his supervision,,
SECTION 5. Any person, firm or corporation violating any pro-
vision of this ordinance shall , upon conviction, be fined not
exceeding Fifty ( $50*00) dollars or imprisonment for not more
than sixty ( 60) days , or both such fine and imprisonment in
the discretion of the judge.
S110TION 6. The city council finds and declares that this ord-
inanoe is necessary for the immediate preservation of the pub-
lic peace, health and safety and that it shall go into effect
upon its approval by the mayor and by posting for one time in
three conspicuous places in the city of hiami Beach, one of
which shall be at the .City Hall.
